Denied. It is denied that the Answering Defandant was negligent as allegad. Answering Defendant stopped at the stop sign, observed that it was clear to continue and did so. 7, Denied. To the contrary, Plaintiff's decedent proceeded through the Intersactlon striking the front portion of Answering Defendant's vehicle, 8. This allegation is not addressed to Answering Defendant and, thus, no reply is required. 9. Denied. It Is denied that Answering Defendant was negligent, To the contrary, this accident was due to Plaintiff's decedent's negligence. 10. Denied. It is denied that Answering Defendant was negligent as alleged. 11, These allegations are not addressed to Answering Defendant and, thus, no reply is required, Count I WronGful Death Action 12. WHEREFORE, Answering Defendant requests that Count II of Plaintiff's Complaint be dismissed without cost to him. NEW MATTER ADDRESSED TO PLAINTIFF 16. This accident was caused by the negligence of Plaintiff's decodent, which negligance consisted of the following: al failing to stop at the stop sign; bl failing to yield right-of-way to Answering Defendant; cl failing to observe Answering Defendant's vehicle in the intersection before she proceeded Into the Intersection; d) failing to operate her vehicle in such a fashion as to bring it to a stop within the assured cleer distance ahead; e) entering the Intersection before assuring herself that it was clear of treffic; and f) failing to maintain a proper lookout. 17. Defendants JURY TRIAL DEMANDED PRELIMINARY OBJECTIONS OF DEFENDANT. FAHRNEY BUS COMPANY. TO PLAINTIFF'S COMPLAINT AND NOW COMES Defendant. Fuhrney Bus Company (hereinafter "Fahrney"), by and through its attorneys, Hartman & Miller, P,c" and in response to Plaintiffs Complaint sets forth the following Preliminary Objections: I. DEMURRER I, The caption and paragraph 3 of Plaintiffs Complaint name Fahrney Bus Company as a defendant in the above-captioned action. 2, Paragraph 8 of Plaintiffs Complaint alleges as follows: The detendant. Fahrney Bus Company, by and through their agent, lI(:tinl within the scope of said agent's employment, negligently parked a school bus in close proximity to the stop sign controlling the intersection, thereby obstructing the view of the stop sign for tramc traveling in a northerly direction on South West Street. 3. Paragraph II of Plainti ff s Complaint alleges as follows: The defendant. Fahrney Bus Company, by and through their agent, was negligent in the lilllowing respects: regarding parking a vehicle in proximity of an intersectional crosswalk or stop sign as set torth at 75 Pa, C,S,A, ~3353(a)(2). 8, There are no other applicable statutory or regulatory requirements for parking in proximity to an intersectional crosswalk or stop sign, and Plalntitl's Complaint sets forth no additional source to create any duty in addition to the above"cited statutory section, 9, A fundamental principal of negligence law is that there be a duty and brellCh of duty on which to claim a negligent act or omission and seek damages based on causation, 10, Plaintiff's Complaint fails to state a claim or cause of action based upon any duty or breach of duty upon which relief may be granted. The traflic accident giving rise to the wrongful death action and survival action set forth in Counts I and II of Plaintiffs Amended Complaint was investigated by the Carlisle Police Department, and a police accident report was issued on the date of the accident, October 20, 1995, A true and correct copy of the police accident report is attached hereto and made a part hereof as Exhibit "A", 6. The aloresaid police accident report contains a diagram of the intersection at block 86, showing the location of the school bus owned by Fahrney. including measurements from the front of the school bus to the stop sign and from the front of the blls to the curb and the rear of the bus to the curb, In addition to the aforesaid diagram. the aforesaid police accident report contains the lallowing narrative in block 87 thereof: " I noticed that there was a legally parked school bus (PA-SB45284) south of the intersection on the east side of the street. From the front bumper of the bus to the southeast stop sign, a measurement of 31.2' was taken, From the front bumper of the bus to the southern most crosswalk line, a measurement of 39.0 feel was taken. The right front wheel of the bus was 7,25" Irom the cast curb, The back right wheel of the bus was 6.0 inches from the cast curb, 7, The measurements Inken by the Carlisle Police Department as reflected in the aforesaid police accident report arc in complete conformance with the statutory regulations regarding parking a vehicle in proximity of nn intersectional crosswalk or stop sign as set forth at 75 Pa, C,S,A, *3353(a)(2). 8.
