Defendants, Marvin Windows and Doors and Frank R.
Marvin, Individually and as President of Marvin Windows and

Doors, through their counsel hereby remove the above-captioned
matter to this Honorable Court and provide notice of same to
counsel represent Plaintiff and the Cumberland County
Prothonotary; in support of removal, Defendants aver as follows:
1. On or about April 18, 1996, Plaintiff initiated
this matter by filing a Praecipe for a Writ of Summons in the
Court of Common Pleas of Cumberland County. (A true and correct
copy of the Praecipe for a Writ of Summons is attached hereto and
marked as Exhibit "A").
2. Defendants were served with the Summons in this
matter on or about April 25, 1996, via certified mail.
3. Counsel for Defendants entered an appearance in
this matter and sent the same to the Court of Common Pleas of
Cumberland County on May 15, 1996. (A true and correct copy of
counsel's Entry of Appearance on behalf of Defendants is attached
hereto and marked as Exhibit "B").
4. Upon information and belief, Plaintiff is a
Pennsylvania Corporation, having an address of 1924 A. Market
Street, "'~mo hiLi., ~"llllSyl vania 17011.
5. Defendants were served with this Writ of Summons at
its address at P.O. Box 100, Highway 11, Warroad, Minnesota
56763.
G. Upon information and belief, Plaintiff is alleging
damages in excess of $50,000.00, which is the requisite damages
