8. The pBrties ecknowledge that they are aware of the income, education,
income potentlBl, and assets and holdings of the other or have had full and ample
opportunity to become familiar with such items. Both parties acknowledge that
they are able to support and maintain themselves comfortably, without contribution
from the other. upon the income and assets owned by each of them except as
provided for herein. The parties hereby accept the mutual covenants and terms of
this Agreement and the benefits and properties passed to them hereunder in lieu of
any and all rights to support or alimony for themself, counsel fees, and alimony
pendente lite at this time and during any and all further or future actions of divorce
brought by either of the parties hereto and the parties do hereby remise, release,
quit claim, and relinquish forever any and all of their said rights to support for
themself, counsel fees, alimony, and alimony pendente lite during the pendency of
or as a result of any such actions, as provided by the Divorce Code of Pennsylvania
or any other applicable statute, at this time and at any time in the future.
9. The parties hereby represent that they have agreed to the foregoing
division or distribution of property in an effort to resolve all disputes relating to their

marital property and obligations and to make an equitable distribution of their
marital property as contemplated by the Divorce Code of Pennsylvanle. The partleB
acknowledge thBt they have the right to ask a court of appropriate juriBdlction to
make equitable distribution of their marital property and to engage in formal
litigation to have the court do so. Because of the division or distribution of marital
property to which they have agreed, as provided for in this Property Settlement
Agreement, and knowing their rights to have the court equitably distribute or divide
their marital property following litigation by the parties, the parties hereto do hereby
waive and releBse any right to have the court make such equitable distribution or
for them to litigate any claims relating to equitable distribution in the divorce action
contemplated by the parties.
10. Husband releases his inchoa~e intestate rights in the estate of Wife and.
Wife releases her inchoate intestate rights in the estate of Husband, and each of
the parties hereto by these presents for himself or herself, his or her heirs,
executors, administrators, or assigns, does remise, releasf1, quit claim, and forever
discharge the other party hereto, his or her heirs, executors, administrators, or
assigns, or any of them, 01 any and BII clalmB, demands, damages, actions, causes
of action or sultB of law or in equity, of whatsoever kind or nature, for or bacause
of any matter or thing done, omitted, or suffered to be done by such other party
prior to the date hereof; except that this release shall in no exonerate or discharge
either party hereto Irom the obligations and promises made and Imposed by any
reason 01 this agreement and shall In no way affect any cause 01 action in absolute
divorce which either PBrty may have Bgainst the other.
11. Both parties hereto mutually agree end promise that neither will contract
or otherwise incur debts in the other's or joint nemes without the prior permission
and consBnt of the other party hereto. Both parties hereto represent and warrant to
the other party that they have not so contracted any debts unbeknownst to the
other up to the time and date 01 this Agreement.
12. The parties acknowledge that this Agreement Is made in contemplation
01 the conclusion by both 01 them 01 an action In divorce which has been filed by
Wife. Both parties hereto agree that they shall, contemporaneously with the
signing of this Agreement. eXElcute end deliver to Wile's attorney an Affidavit of

Present for the Plaintiff, Wendy A. Zeigler, is
attorney John J. Connelly, Jr., and present for the Defendant,
Randy L. Zeigler, is attorney Michael L. Bangs.
A divorce complaint was filed on April 18, 1996,
raising grounds for divorce of irretrievable breakdown of the
marriage and indignities and the economic claim of equitable
distribution. Counsel have advised that the parties will sign
and file affidavits of consent so that the divorce can be
concluded under section 3301(C) of the Domestic Relations Code.

The parties were married on December 19, 1987, and

Avenue, Apartment 4, Daytona Beach, Florida 32118 where she
lives with a male friend. She is a high school graduate and
attended Central Pennsylvania Business School but did not
graduate. Wife is a server at the Ocean Deck Restaurant,
Daytona Beach, Florida, and is a part-time model. She reports
income at around $300.00 per week gross. She has not raised any
heal th issues.
Husband is 39 years of age and lives in the marital
residence at 212 Fairview Road, New Cumberland, Pennsylvania,
with a daughter from another relationship. Husband is a high
school graduate and works as a mechanic in his own business
known as Randy's Small Engine Service in Fairview Township, York
County. Husband reports that his income gross per week is
$270.00. He has not raised any health issues.
The real estate at 212 Fairview Road, New
Cumberland, Pennsylvania, was appraised by the lender's
appraiser in 1994 and showed a market value of $87,800.00.
Husband has had a more recent appraisal and has reported a

market valuft of $80,500.00. Mr. Connelly indicated that he will
probably have the property appraised by a third party so that we
can ... how accurate the prior appraisals were and perhaps use
the third appraisal as a basis to work toward a resolution.
There are two mortgages against the property. The first
mor.tgage is in favor of National Mortgage Company with a payoff
as of December 1995 of $68,585.00 and the second mortgage is in
favor of Member's First with a payoff of $5,677.56 as of January
23, 1997. One of the major concerns of wife is that she be
released from the mor.tgages which would require husband to
refinance the mortgages. There is a concern raised by Mr.
Connelly that Mr. Zeigler will not be able to do so; the Master
has indicated that in order to advance their respective
positions as to whether or not refinancing should be required as
part of the Master's recommendation, the parties should present
testimony on how a lender would look at an agreement that was
signed with an indemnification in favor of wife. In other
words, the Master will look at any testimony offered by either
party regarding whether a refinancing should either be required
as part of the resolution in this case or whether there is
sufficient reason to accept the indemnification as part of the
agreement leaving wife as an obligor on the loans.
The parties have some disagreement about what
happened with wife's retirement account. wife says she took
$2,000.00 out of the account and gave $1,000.00 to husband
retaining $1,000.00 for herself leaving approximately 53 shares
of Caliber Systems Stock in the account which is worth around
$1,000.00. Husband is not willing to accept that version of the
distribution of the retirement fund without proper documentation
and Mr. Connelly is going to attempt to provide that information
to Mr. Bangs as soon as it is available so we know the status of
that account.
Counsel agree that the Bayliner boat in husband's
possession has a value of $1,500.00.

those vehicles are as follows:
Suzuki motorcycle 1100 -- Wife places a value on
the vehicle at $1,000.00. Husband's value is $750.00.
1984 Thunderbird -- Wife's value is $700.00. Husband'.

1979 Ford truck -- Wife's value is $1,500.00. Husband'.
