AND NOW, comes petitioner, Angela Kay Magaro, by and through
her attorneys, Mancke, Wagner, Hershey .. Tully, and makes the
following averments in support of this License Suspension Appeal:
1. petitioner, Angela Magaro, is a Pennsylvania licensed
driver with a residence address of 169 willow Mill Park,
Mechanicsburg, Cumberland County, pennsylvania 17055.
2. Respondent, Pennsylvania Department of Transportation,
Bureau of Driver Licensing, has a mailing address at Transportation
and Safety Building, Harrisburg, Dauphin County, Pennsylvania
17120.
3. petitioner received a notice of license suspension by way
of letter dated March 26, 1996 from the Department of
Transportation indicating that her pennsylvania driving privileges
are to be suspended on April 30, 1996, at 12:01 a.m. for a period
of one (1) year for a violation of Section 1547 of the Vehicle
Code. See Exhibit "A" attached hereto and incorporated herein by
reference.

As a result of your violation of Section 1547 of the V.-
hicle Code, CHEMICAL TEST REFUSAL on 03/04/1996, your driving
privilllle is beinll SUSPENDED for a period of 1 VEAR(S).
In order to comply with this sanction yOU are required to
return any current driver's license, learner's permit andlor
temporary driver '5 license (camera card) in your possesSion
no later than the effective date listed. If yoU cannot com-
ply with the requirements stated above, you are rlquir.d to
submit a DL16LC Form or a sworn affidavit stating that yoU
are aware of the sanction against Your driving privUeg..
Failurl to comply with this notice shall result in this Bu-
reau r.ferring this mat.ter to the PennsYlvania State Polic.
for prosecution under SECTION 1571(a)(4) of the Vehicle Cod..
Althoullh the law mandates that your driving priv1llge is un-
der suspension even if YOU do not surrender your lic.nse,
Credit will not. begin until all current driver's license
product(s), the lJLl6LC Form, or a letter ar.knuwledg1ng your
sanction 15 receiVld in this Bureau.
WHEN THE DEPARTMENT RECEIVES YOUR LICENSE OR ACKNOWLEDGEMENT,
WE WILL SEND YOU A RECEIPT, IF YOU DO NOT RECEIVE THIS RECEIPT
WITHIN 15 DAVS CONTACT THE DEPARTMENT IMMEDIATELV. OTHERWISE,
YOU WILL NOT BE GIVEN CREDIT TOWARD SERVING TMIS SANCTION.
Effective Date of Suspension: 04/30/1996, 12:01 a.m.
