CIVIL ACTION - LAW
IN CUSTODY
DEFENDANT'S ANSWER TO COMPLAINT FOR CUSTODY
1. The truth of this averment is strictly within the knowledge
of the Plaintiff and, therefore, no answer is required.
2. Admitted.
3. This averment is more properly a prayer for relief and
therefore 110 answer is required.
4. Admitted.
5. Admitted.
6. Denied. For the past five years, the child has lived with
the following persons at the following addresses:
~....
7. Admi tted.
8. Admitted.
9. Admitted.
10. Admitted.
11. The truth of this averment is strictly within the knowledge
of the Plaintiff and, therefore, no answer is required.
12. (a). Admitted in part. Denied in part. It is
specifically denied that the child maintains a relationship with
Plaintiff. Plaintiff has not had overnight visitation with the child
for over two (2) yeArs and Plaintiff rarely telephones the child.
(b). Denied. While it is conceded that the child has had
problems in the past, she regularly attends school and has not missed
any days of school during the fourth marking period as of the filing
of this Answer. While the child did miss sixteen days of classes
during the third marking period, this was in part due to the fact
that she was injured in an automobile accident which caused her to
miss a week of school. As evidenced by the child's quarterly report,
the first and second marking periods show that the child is attending
school and receiving passing grades in all subjects except algebra.
See Exhibit "A" attached hereto and incorporated herein. It is
further denied that it would be in the best interest of the child t.o
change her environment.
13. Admitted.
WHEREFORE, Defendant respectfully requests this Honorable Court
deny Plaintiff'. request.
Respectfully Submitted,
