" g ~ ~ COUNT I NEGLIGENT DAMAGE TO PROPERTY 5, Paragraphs 1 through 4 of this complaint are herein incorporated by reference. 6, Upon information and belief, the Wisslers own the real property located at 73 Second Street, West Fairview, Cumberland County, Pennsylvania. 7, The Wisslers' property at 73 Second Street borders Plaintiffs' property at 75 Second Street. 8, Plaintiffs' residence abuts and extends along the bo~ndary line between 73 Second Street and 75 Second Street, 9. Upon information and belief. sometime in 1995 the wisslers retained Taylor to construct a building which would adjoin Plaintiffs' residence. 10. Due to the negligence of the Wisslers, Taylor and Taylor's employees and agents in the construction of the adjoining building, Plaintiffs' real property, improvements and personal property were subjected to damage from leaking water on a recurring basis beginning in December 1995 and continuing through March 1996, 11, Plaintiffs have determined that the cost of repairing the damages and restoring their property to its former condition will be $7,133.55. 12, Plaintiffs suffered inconvenience and discomfort due to the foregoing damages, 2 WHEREFORE, Plaintiffs demand jUdgment against ~aylor and the Wisslers f.or damages, costs and attorney fees in an amount not exceeding the threshold for compulsory arbitration under local rules, together wi th such other rel ief as the Court deems appropriate, COUNT II TRESPASS 13. paragraphs 1 through 12 of this complaint are herein incorporated by reference, 14, At all times relevant hereto, Plaintiffs were in possession of their I'eal property and were entitled to peaceful and exclusive enjoyment of the same. 15, At or about the time that the construction work was begun on the Wisslers' property, Plaintiffs instructed Taylor and the Wisslers that they were not permitted to enter onto Plaintiffs' property. 16, In the course of the construction work, Taylor's employees and agents intentionally entered onto Plaintiffs' property on several occasions without Plaintiffs I permission or other privilege, 17. In the course of the construction work, Taylor's employees and agents intentionally used water faucets and electrical outlets located on Plaintiffs' property without Plaintiffs' permission or other privilege. 18. The Wisslers knew or should have known that Taylor's 3 employees and agents would enter onto Plaintiffs' property and use Plaintiffs t water faucets and electrical outlets without Plaintiffs' permission or other privilege. 19, By reason of the foregoing trespasses.
