It is specifically agreed by and between the parties to this Agreement that the Contractor
shall not file, nor will it permit or suffer any subcontractors, materialmen or other
persons under it to file, nor shall any such contractor, subcontractor. materialmen or
other person file any mechanics' or other lien or claim for work dc'ne or materials
furnished in or about the performance of this Agreement or changes therein, against the
ground upon which the structure or work herein prOVided for i. erected. or against any
structure covered by this Agreement.
The Contractor shall save and hold the Owner harmless from and against any and all liens
or claims of any kind or character whatsoever that may be filed against the aforesaid
property or property interests by a subcontractor, materialman, or any other person
arising out of or in any manner connected with the performance of this Agreement, any
agreement supplemental thereto, or any subcontract made pursuant to or in connection
with the performance of this Agreement or any agreement supplemental thereto; and the
Contractor shall. at its own expense, defend any and all action. based upon such liens
or claims and shall pay all charges of attorneys and all costs and other expenses
arising therefrom.
It is the full intent of the Contractor, for itself and for any subcontractors or material-
men claiming for themselves. or by, through or under the Agreement. that the right to file
a mechanics' lien. under the provisions of Acts of Assembly in such CQse~ made and
provided. for work done or materials furnished in and about the erection or construction
of the buildin~ and improvements above described, is hereby waived.

ALL THAT CERTAIN lot or piece of ground situate in the Township of
Upper Allen, County of Cumberland, state of Pennsylvania, boundBd and
described according to a final BUbdivision plan of Tract 0, Lot 0-3,
made by J, Michael Brill & Associates, Inc., dated September 12, 1988,
and recorded in Cumberland County in Plan Book 56, Page 125, as
follows, to wit:
BEGINNING at a p0int on the northern right-of-way line of Ritter
Road (a 60 foot right-of-way), said point being located and referenced
in a southwest direction from the centerline intersection of Ritter
Road and Scott street, the following two (2) courses and distances:
(1) from Baid intersection along the centerline of Ritter Road, South
51 degrees 50 minutes 23 seconds West, a distance of 1041.64 feet to a
point; (2) thence North 38 degrees 09 mintues 37 seconds West, a
distance of 30,00 feet to a point on the northern right-of-way line of
Ritter Road, the point of beginning; thence from said point of
beginning, along the northern right-of-way line of Ritter Road, South
51 degrees 50 minutes 23 seconds West, a distance of 314.31 feet to a
point; thence along the same on an arc of a curve, curving to the
left, having a radius of 520.00 feet and an arc length of 578.60 feet
to a point; thence along other lands owned by Smith Land and
Improvement Corporation, South 78 degrees 05 minutes 16 seconds West,
a distance of 84.80 feet to a point on the southern right-of-way line
of U.S. Route #15 (LR 123); thence along ramp "J" of the southern
right-of-way line of U.S. Route #15 (LR 123) North 01 degree 42
minutes 36 seconds West, a distance of 401.14 feet to a point; thence
