At the time the Agreement was entered the Petitioner was a full-time dock worker at Roadway Express with gross weekly earnings, including regular and over-time pay, in excess of Six HundI'ed ($600.00) Dollars per week. 6. Although your Petitioner does not know how the sum of One Thousand ($1,000.00) Dollars per month was arrived at by his prior attorney and the attorney for the Respondent, he assumes the amount was based upon the factors set forth in Section 3707 of the Divorce Code. 7. Your petitioner has experienced a substantial and continuing change of circumstances which entitles him to have the Alimony Order terminated and/or modified in accordance with Section 3701(e) of the Divorce Code. S, Specifically, on June 16, 1998, Petitioner was determined by his orthopedic surgeon, Robert J. Maurer, M.D. to be totally disabled due to a shoulder injury which occurred at work. A true and correct copy of the Disability Certificate is attached hereto, made a part hereof and marked Exhibit "B". 9. Dr. Maurer will be operating on Petitioner's shoulder on Thursday, June 25 at the Polyclinic Hospital. 10. petitioner will receive his last paycheck from Roadway on Thursday, June 25. 11. Petitioner may not be able to return to work depending upon the success of the surgery. Assuming the surgery is VERIFICATION Donald L. TERM EQUITABLE DISTRIBUTION AGREEMENT The parties hereto agree as follows: I. PENSION. The share of Wife in the pension benefits as a result of employment with Volkswagon and with Roadway Express shall be 60% for the Wife and 40% for the Husband, I . whether defined benefit, defined contribution, or 40 I k program. One or both of the pensions is administered by the Central Pennsylvania Teamsters Pension Fund, P.O. Box 15223, Reading. PA 19612-5223. 2. Husband shall insure that the beneficiary and survivor annuitant of any pension benefit shall be the Wife. Copy of this agreement and order of court shall be sent to the pension fund administrators. 3. The marital ponion of the pension shall be that which was acquired prior to the date of fins! separation, April ) 4, ) 996. 4. The coverture fraction of the pension interests will be based upon 34 years of marriage. 5. ALIMONY. Upon the effective date of entry of the divorce decree, support under the Domestic Relations Order of lune 4, 1996 shall terminate, except for any amounts in arrears on said date. ^nears may be enforced by Wife throuah the Domestic Relations Section of II A-I II "l .' the Coun of Common Pleas. Upon the effective date of the divorce decree, alimony is awarded to Wife in the amount of S 1,000 per montb payable through the Domesdc Relations Section, payable $230.77 per week. This award of alimony may be modified in accordance with law and shall be terminated upon remarriage of Wife. 6. PERSO~AL PROPERTY. Personal and household property has been divided by and received by the panics and each releases any claim in property in the possession of the other party . 7. LEGAL FEES. Each party shall bear their own legal fees. 8. VEHICLE. HUliband agrees to convey all of his right, title and interest in 1993 Dodge Sundance, presently in the name of both panies to Wife by execution of tbe certificate of title by Husband at tbe time of execution of agreement, to be deposited witb his attorney in escrow, to be delivered to Wife upon entry of divorce dc-::ree. Wife shall assume the underlying obligation on the vehicle. 9. DEBTS. Husband agrees to pay debts contracted by either or botb parties as follows: A. Securily Pacific B. Master Card C. MAINS, Defendant IN DIVORCE RE: Pre-Hearing Conference Memorandum DATE: Friday, February 13, 1998 Present for the Plaintiff, Donald L. Mains, Sr., is attorney Arthur T. McDermott, and present for the Defendant, Beverly A. Mains, is attorney John H. Broujos. A divorce complaint was filed on April 29, 1996, raising grounds for divorce of irretrievable breakdown of the marriage, Counsel advised that the parties will sign and file affidavits of consent and waivers of notice of intention to request entry of divorce decree prior to the hearing to be scheduled. No economic claims were raised in the divorce complaint. On May 14, 1996, the Defendant wife filed an answer and new matter raising economic claims of equitable distribution, alimony, alimony pendente lite, and counsel fees and costs. with respect to the factor of marital misconduct as that factor may affect wife's alimony claim, wife alleges that husband had an extra marital relationship while the parties were living together. Mr. McDermott is going to inquire of his client as to whether a sexual relationship existed prior to the separation and if so, he may be able to stipulate to that ongoing relationship. If, however, Mr. McDermott's client states that the relationship with the female friend occurred subsequent to the separation, then we may have to have a hearing on that issue. The parties were married on March 9, 1962, and separated April 14, 1996. They are the natural parents of four children, all of whom are emancipated. Husband is 56 years of age and resides at 450 Walnut Bottom Road, Shippensburg, Pennsylvania, with a female friend. He is a high school graduate and currently is employed as a dock worker. He is a member of the Teamsters Union and his 1996 gross income as reported on his tax return was $38,221.40. Mr. McDermott indicated that husband may retire in May 1990. . Husband is currently under a support order dated June 4, 1996, to pay wife the sum of $200.00 per week. Although husband had suffered a heart attack, he is not currently experiencing any health problems. There is a question about husuand's potential retirement in May and the reasons for that retirement. Mr. Broujos is concerned that Mr. Mains is giving up his earnings to go on retirement when in fact he has an earning potential and capacity to continue earning an income based on the earnings that he showed in 1996 and will show in 1997. If we find that Mr. Mains does have an earning potential and has the ability to have an income in addition to his retirement, we will probably assess an earning capacity against Mr. Mains in determining wife's claim for alimony. Wife is 58 years of age and resides at 6 Lewisberry Road, Lot 6, New Cumberland, Pennsylvania, where she lives with a daughter and a granddaughter. wife has an 8th grade education and has been essentially unemployed during the marriage except for baby-sitting occasionally. She has complained of health issues including a bad back, depression, and stomach problems. Wife is currently covered under husband's medical insurance plan with the Teamsters; how2ver, in the event of husband's retirement we need to know what provisions are being made for wife's continuation of medical insurance benefits. A statement was attached to Mr. McDermott's pre-trial statement showing that the account balance in husband's pension plan as of December 31, 1996, was $84,971.61. Wife would like to have a cash settlement with husband with respect to the pension; however, this may not be possible unless the plan is a defined contribution plan and a portion of the amount in the plan can be rolled over into wife's name. If the pension plan is a defined benefit plan, then husband will be receiving a monthly payment and that monthly payment will be distributed most likely in accordance with a coverture fraction. Mr. McDermott is also going to determine what the monthly benefit will be as we need to know what income would be available to both parties upon retirement of husband in May, and, what, if any, survivor benefits would be available to wife in the event of husband's ultimate death while he is in retireme~t status. Mr. McDermott has noted that wife has a 1990 Sundance (probably Plymouth) in her possession although no value has been noted for that vehicle. Likewise, wife has retained the household tangible personal property and we do not have a value for that property. If we need to get into a computation for equitable distribution aside from the pe~sion issue, then we should have values for the other property thdt was noted. Absent from any inventory here, is any mel~tion of bank statements. Mr. McDermott is going to inquire of his client as to whether there were any other aSGets at time of separation including bank statements, stocks, bonds, or other intangible assets. Mr. McDermott has listed some marital debts on his statement (Exhibit No.4). Husband probably has been paying the debts since separation and we need to know what husband has been paying and what the balances were at sepat"ation so he can be given appropriate credit for payment of marital debt. There is also noted on tha list of debts a loan from Uncle Ken in the amount of $2,400.00 which is joint and a loan from Betty Gsell, which apparently is wife's loan. Counsel should inquire as to the purpose for those loans and who is liable and who is paying back the amount that has been borrowed. If we determine that we need to have a hearing on the issue of whether or not husband was having an extra marital relationship while the parties were living together, the Master should be notified immediately and counsel should be given the opportunity to have a separate hearing scheduled on that issue. witnesses should be exchanged between counsel so we can determine that matter prior to getting into the other factors and issues regarding equitable distribution and alimony. It is also noted as previously stated, that wife has filed a claim for counsel fees and expenses against husband. Defendant a~ks the Ma.~ter for an order directing Plaintiff to provide the IRA and Teamster's Benetit Statement, Pension Booklet, and other documents required for the Data Submission Form for an appraisal, as of the date of separation, since thel'e were post- separation ~ontributions. Demand has been made as set fonh in leller of March 19, 1997 to the Central Pennsylvania Teamsters Pension Fund and to counsel for Plaintiff verbally and as indicated in leller of March 21, 1997. Defendant ha.~ no authority to force the Fund from providing this infOlmation. Defendant claims a distribution of pension benefits in a ratio of 60% for wife and 40% for husband, based upon the Jack of earning capability, Jimitations in income requirements for maintaining a separate household, medical problems (evidenced by Doctor Yucha's statement enclosed), and other mailers set forth herein and relevant factors set fonh in 23 PaCSA 3502. B. Oefend.Ult Beverly A. Mains.. Mrs. Mains has no income and is not employed at the present time. She was capable only of pcrfonning babysilling functions, which she has not done since the lirst of this year, and had prcviousJy workcd as a waitress in a delicatcssen. She is not a graduate of high school. She has no othcr visible means of support. Mrs. Mains is 5R years of age. IIcr health is rclmively poor, being under doctor's care for a numbcr of ycars for a bad back, depression, and stomach problems. (See Doctor Vucha's statement enclosed) Mrs. Mains ha~ her daughter Linda living with her, who has one child, whom Mrs. Mains helps to take care of. 4. MERETRICIOUS RELATIONSHIP OF Pl.AINTIFF. The Plaintiff ha~ had a meretricious relationship with another woman for over a ycar and six months.
