"This award of alimony may be modified at in accordance

5. At the time the Agreement was entered the Petitioner was
a full-time dock worker at Roadway Express with gross weekly
earnings, including regular and over-time pay, in excess of Six
HundI'ed ($600.00) Dollars per week.
6. Although your Petitioner does not know how the sum of
One Thousand ($1,000.00) Dollars per month was arrived at by his
prior attorney and the attorney for the Respondent, he assumes
the amount was based upon the factors set forth in Section 3707
of the Divorce Code.
7. Your petitioner has experienced a substantial and
continuing change of circumstances which entitles him to have the
Alimony Order terminated and/or modified in accordance with
Section 3701(e) of the Divorce Code.
S, Specifically, on June 16, 1998, Petitioner was
determined by his orthopedic surgeon, Robert J. Maurer, M.D. to
be totally disabled due to a shoulder injury which occurred at
work. A true and correct copy of the Disability Certificate is
attached hereto, made a part hereof and marked Exhibit "B".
9. Dr. Maurer will be operating on Petitioner's shoulder on
Thursday, June 25 at the Polyclinic Hospital.
10. petitioner will receive his last paycheck from Roadway
on Thursday, June 25.
11. Petitioner may not be able to return to work depending
upon the success of the surgery. Assuming the surgery is

EQUITABLE DISTRIBUTION AGREEMENT
The parties hereto agree as follows:
I. PENSION. The share of Wife in the pension benefits as a result of employment with
Volkswagon and with Roadway Express shall be 60% for the Wife and 40% for the Husband, I .
whether defined benefit, defined contribution, or 40 I k program. One or both of the pensions
is administered by the Central Pennsylvania Teamsters Pension Fund, P.O. Box 15223,
Reading. PA 19612-5223.
2. Husband shall insure that the beneficiary and survivor annuitant of any pension benefit
shall be the Wife. Copy of this agreement and order of court shall be sent to the pension
fund administrators.
3. The marital ponion of the pension shall be that which was acquired prior to the date
of fins! separation, April ) 4, ) 996.
4. The coverture fraction of the pension interests will be based upon 34 years of
marriage.
5. ALIMONY. Upon the effective date of entry of the divorce decree, support under the
Domestic Relations Order of lune 4, 1996 shall terminate, except for any amounts in arrears
on said date. ^nears may be enforced by Wife throuah the Domestic Relations Section of

the Coun of Common Pleas. Upon the effective date of the divorce decree, alimony is
awarded to Wife in the amount of S 1,000 per montb payable through the Domesdc Relations
Section, payable $230.77 per week. This award of alimony may be modified in accordance
with law and shall be terminated upon remarriage of Wife.
6. PERSO~AL PROPERTY. Personal and household property has been divided by and
received by the panics and each releases any claim in property in the possession of the other
party .
7. LEGAL FEES. Each party shall bear their own legal fees.
8. VEHICLE. HUliband agrees to convey all of his right, title and interest in 1993 Dodge
Sundance, presently in the name of both panies to Wife by execution of tbe certificate of title
by Husband at tbe time of execution of agreement, to be deposited witb his attorney in
escrow, to be delivered to Wife upon entry of divorce dc-::ree. Wife shall assume the
underlying obligation on the vehicle.
9. DEBTS. Husband agrees to pay debts contracted by either or botb parties as follows:
A. Securily Pacific
B. Master Card
C. Medical bills to date of this agreement
D. Uncle Ken Troup
Wife agrees to pay debts contracted by either or both panics as follows:
A. Betty Gsell
Each party agrees to save, indemnify, and hold harmless the other party from ID)'
claims arising as a result of the failure of either party to pay the debts set forth above.
10. Except as herein otherwise provided, each party may dispose of his or ber ~ ill

any way and each pari)' hereby waives and relinquishes any and all rights he or she may now
have or hereafter acquire under the present or future laws of any Junsdlclion to share in the
propeny or the estate of the other as a result of the manlal relalionship, Including without
limitation, statutory allowance, widow's allowance, right of intestacy, right to take against the
will of the other, and right to act as administrator or executor in the other's estate. Each will
at the request of the other execute, acknowledge, and deliver any and all instruments which
may be necessary or advisabJe to carry Into effect this mutual waiver and relinquishment of
all such interests, rights, and claims.
II. Each parly hereto ackowledges that he or she has read this entire agreement; that he or
she understands the meaning of the agreement; and that he or she agrees to the terms thereof.
The parties acknowledge that by signing below they ratify and affirm the agreement and
intend to bind themselves to the settlement as a contract obligating them~clves to the terms
thereof and subjecting themselves to the methods and procedures of enforcement which may

By order of Court of President Judge Harold E. Sheely
dated October 22, 1997, the full-time Master has been appointed
in the above referenced divorce proceedings,
The Master is not certain whether Mr, McDermott is still
in full-time practice; however, no other attorney has entered an
appearance on behalf of the plaintiff, so this letter is being
sent to Mr, McDermott with a copy to Mr. Mains,
A divorce complaint was filed on April 29, 1996, raising
grounds for divorce of irretrievable breakdown of the marriage.
No economic claims were raised in the complaint, The Master is
going to proceed on the basis that the parties will sign and
file affidavits of consent to conclude the divorce under section
3301(C) of the Domestic Relations Code.
On May 14, 1996, an answer and new matter were filed in
response to the complaint. The new matter (appropriately titled
counterclaim) raised the economic issues of equitable

DATE: Friday, February 13, 1998
Present for the Plaintiff, Donald L. Mains, Sr.,
is attorney Arthur T. McDermott, and present for the Defendant,
Beverly A. Mains, is attorney John H. Broujos.
A divorce complaint was filed on April 29, 1996,
raising grounds for divorce of irretrievable breakdown of the
marriage, Counsel advised that the parties will sign and file
affidavits of consent and waivers of notice of intention to
request entry of divorce decree prior to the hearing to be
scheduled. No economic claims were raised in the divorce
complaint.
On May 14, 1996, the Defendant wife filed an answer
and new matter raising economic claims of equitable
distribution, alimony, alimony pendente lite, and counsel fees
and costs. with respect to the factor of marital misconduct as
that factor may affect wife's alimony claim, wife alleges that
husband had an extra marital relationship while the parties were
living together. Mr. McDermott is going to inquire of his
client as to whether a sexual relationship existed prior to the
separation and if so, he may be able to stipulate to that
ongoing relationship. If, however, Mr. McDermott's client
states that the relationship with the female friend occurred
subsequent to the separation, then we may have to have a hearing
on that issue.
The parties were married on March 9, 1962, and
separated April 14, 1996. They are the natural parents of four
children, all of whom are emancipated.
Husband is 56 years of age and resides at 450
Walnut Bottom Road, Shippensburg, Pennsylvania, with a female
friend. He is a high school graduate and currently is employed
as a dock worker. He is a member of the Teamsters Union and his
1996 gross income as reported on his tax return was $38,221.40.
Mr. McDermott indicated that husband may retire in May 1990.
.
Husband is currently under a support order dated June 4, 1996,
to pay wife the sum of $200.00 per week. Although husband had
suffered a heart attack, he is not currently experiencing any
health problems.
There is a question about husuand's potential
retirement in May and the reasons for that retirement. Mr.
Broujos is concerned that Mr. Mains is giving up his earnings to
go on retirement when in fact he has an earning potential and
capacity to continue earning an income based on the earnings
that he showed in 1996 and will show in 1997. If we find that
Mr. Mains does have an earning potential and has the ability to
have an income in addition to his retirement, we will probably
assess an earning capacity against Mr. Mains in determining
wife's claim for alimony.
Wife is 58 years of age and resides at 6 Lewisberry
Road, Lot 6, New Cumberland, Pennsylvania, where she lives with
a daughter and a granddaughter. wife has an 8th grade education
and has been essentially unemployed during the marriage except
for baby-sitting occasionally. She has complained of health
issues including a bad back, depression, and stomach problems.
Wife is currently covered under husband's medical insurance plan
with the Teamsters; how2ver, in the event of husband's
retirement we need to know what provisions are being made for
wife's continuation of medical insurance benefits.
A statement was attached to Mr. McDermott's
pre-trial statement showing that the account balance in
husband's pension plan as of December 31, 1996, was $84,971.61.
Wife would like to have a cash settlement with husband with
respect to the pension; however, this may not be possible unless
the plan is a defined contribution plan and a portion of the
amount in the plan can be rolled over into wife's name. If the
pension plan is a defined benefit plan, then husband will be
receiving a monthly payment and that monthly payment will be
distributed most likely in accordance with a coverture fraction.
Mr. McDermott is also going to determine what the monthly
benefit will be as we need to know what income would be
available to both parties upon retirement of husband in May,
and, what, if any, survivor benefits would be available to wife
in the event of husband's ultimate death while he is in
retireme~t status.
Mr. McDermott has noted that wife has a 1990
Sundance (probably Plymouth) in her possession although no value
has been noted for that vehicle. Likewise, wife has retained
the household tangible personal property and we do not have a
value for that property. If we need to get into a computation
for equitable distribution aside from the pe~sion issue, then we
should have values for the other property thdt was noted.
Absent from any inventory here, is any mel~tion of
bank statements. Mr. McDermott is going to inquire of his
client as to whether there were any other aSGets at time of
separation including bank statements, stocks, bonds, or other
intangible assets.
Mr. McDermott has listed some marital debts on his
statement (Exhibit No.4). Husband probably has been paying the
debts since separation and we need to know what husband has been
paying and what the balances were at sepat"ation so he can be
given appropriate credit for payment of marital debt. There is
also noted on tha list of debts a loan from Uncle Ken in the
amount of $2,400.00 which is joint and a loan from Betty Gsell,
which apparently is wife's loan. Counsel should inquire as to
the purpose for those loans and who is liable and who is paying
back the amount that has been borrowed.
If we determine that we need to have a hearing on
the issue of whether or not husband was having an extra marital
relationship while the parties were living together, the Master
should be notified immediately and counsel should be given the
opportunity to have a separate hearing scheduled on that issue.
witnesses should be exchanged between counsel so we can
determine that matter prior to getting into the other factors
and issues regarding equitable distribution and alimony.
It is also noted as previously stated, that wife
has filed a claim for counsel fees and expenses against husband.
A hearing is scheduled for Monday, May 18, 1998,
at 9:00 a.m. Notices will be sent to counsel and parties,

Defcndant asks the Master for an order directing Plaintiff to provide the IRA and
Teamster's Dendit Statement, Pensiun Bo\)klet, and other documents required for the Data
Submission FOIm for .U1 appraisal, as of the date of sepamtion, since therc were post-
separation contributions. Demand ha.s hcen made as set fo"h in letter of March 19, 1997 to
the Central Pennsylvania Teamsters Pension rund and to counsel for Plaintiff verbally and as
indicated in lener of MardI 21. 1997. Defendant has no authurity tll force the Fund from
pruviding this information.
Dcfendant claims a distribution of pension bcnctits in a ratio of 60%, for wiflZ and 40%
for husband, botsed upon the lack of earning capability, limitations in income requirements for
maintaining a separate household, medical problems (evidenced by Doctor Yucha's statement
enclosed). and olher matters set forth herein lUld relevant factors set forth in 23 PaCSA 3502.
Defendant asks the Court for an order that her name remain as the primary beneliciary
under the pension progranls with Roadway Express. Inc. and the Central Pennsylvania
Teamsters Pension Fund.
3. ECONOMIC SITUATlOl\l OF THE PARTIES.
A. Plaintiff Donald L. Mains, Sr. -- He is employed as a dock worker Imder the
Teamsters National Master Freight Agreement and is a panicipant in the Central Pennsylvania
Teamsters Pension Fund He ha., been so employed for 30 years and has a good working
record \vith his company. He is 55 ye.u's of age and is relatively good health, considering
that he had a he,m attack in 19RO and has worked regularly since, with some limited perio\',
when he was not employed for medical rea.,ons.
B. Defendant Beverly A. Mains -. Mrs. Mains is not employed at the present time.
She was capable only of pc;f"nninll: babysitting functions, which she has not done since the

til'St of this year, IUHI had previously worked as a waitress in a delicatessen. She is not a
graduate of high school. She has no othel' visible means of SUpp0l1. Mrs. Mains is 5R years
of age. Her health is relatively poor, being undcr doctor's care for a number of yew'll for a
bad back, depression, and stomach problems. (See Doctor Yucha's statement enclosed) Mrs.
Mains has her daughter Linda living with her, who has one child, whom Mrs. Mains helps to
take care of.
4. MERETRICIOUS RELATIONSHIP OF PLAINTIFF. The Plaintiff has had a
meretricious relationship with another woman for over a year and six months. Although this
has no impact on the property distribution. it nevenheless is relevant to the claim for alimony,
expenses, and counsel fees.
5. ALIMONY. Defendant is entitled to alimony. She left school in the eighth grade.
She has no secondary education or any vocati,mal training. She hus the limited income
capability as set fonh above. She has serious health problems and will submit documentation
from doctors indicating her poor health condition, in addition to the au ached.
She has nomla! living expenses of a residence, food. clothing, and utilities and other
expem,es. She is receiving medical coverage under the Plaintift's health coverage.
Presently there is an Order of Court dated June 4, 1996, whereby Plaintiff is required
to pay $200/week with arrears of $200+-.
She has given the Plaintiff no grounds for dIvorce and no grounds for denying support
payment currcntly and no grounds exist for denial of alimony.
Defendant asks the Court to grant her alimony and to have that amount set by the

entcred. In addition, she desires an Order directing that she continue to be covered after

1 ECONOMIC SITUATIO~ OF THE PARTIES.
A. Plaintiff Donald L. Mains, Sr. .- He is employed as a dock worker under the
Teamsters National Master Freight Agreement and is a participant in the Central Pennsylvania
Teamsters Pension Fund. He has been so employed for 30 years and has a good working
record with his company He is 55 years of age and is relatively good health, considering
that he had a heart attack in 1980 and has worked regularly since. with some limited periods
when he was not employed for medical reasons.
B Defendant Beverly A Mains.. Mrs. Mains has no income and is not employed
at the present time. She was capable only of performing babysitting functions, which she has

not done since the first of this year, and had previously worked as a waitress in a
delicatessen. She is not a I!raduate of high school. She has no other visible means of
support. Mrs. Mains is 58 years of age. Her health IS relatively poor, being under doctor's
care for a number of years for a bad back, depression, and stomach problems. (See Doctor
Yucha's statement enclosed) Mrs. Mains has her daughter Linda living with her, who has one
child, whom Mrs. Mains helps to take care of.
4. MERETRICIOUS RELATIONSHIP OF PLAINTIFF. The Plaintiff has had a
meretricious relationship with another woman for over a year and six months. Although this
has no impact on the properly distribution, it nevertheless is reJevantto the claim for alimony,
expenses, and counsel fees.
5. ALIMONY. Defendant is entitled to alimony. She left school in the eighth grade,
She has no secondary education or any vocational training. She has the limited income
capability as set forth above. She has serious health problems and will submit documentation
from doctors indicating her poor health condition, in addition to the attached.
She has norma) living expenses of a residence, food, clothing, and utilities and other
expenses. She is receiving medical coverage under the Plaintifrs health coverage.
Presently there is an Order of Court dated June 4, 1996, whereby Plaintiff is required
to pay $200/week with arrears of $200+.
She has giver. the Plaintiff no grounds for divorce and no grounds for denying support
payment currently and no grounds exist for denial of alimony.
Defendant asks the Court to grant her alimony and to have that amount set by the
Domestic ReJations Office, since there have been raises of Plaintiffs pay since the Order was
entered. In addition, she desires an Order directing that she continue to be covered after
divorce under a health insurance policy simIlar to the one that he currently has in effect Cor

Teamster's Benetit Statement, Pension Booklet, and other documents required for the Data

S. MARRIAGE. The panies were mWTied on March 9, 1962; the parties became
separated April 14, 1996, at which time Plaintiff removed himself from the marital habitation
without cause.
9. NEGOTIATIONS. The parties have entered into negotiations during the course of
divorce proceedings to no avail. Defendant had submitted a proposed settlement agreement
which Plaintiff rejected.
10. EVIDENCE
A. No experts will be called.
B. A pension evaluation will be submitted prepared by a Florida finn, which will
be submiued to the Master and counsel upon receipt.
C. Defendant will be called to present her case for equitable distribution of the
pension, bWled on information submitted herein.

attached hereto, it is ordered and directed as follows:
1. This Order creates and recognizes the existence of an
Alternate Payee's right to receive a portion of the E'articipant's
accrued benefits under a multi-employer Cefined Benefit Plan
which is qualified under Section 501 of the Internal Revenue Code
(the "Code") and the Employee Retirement Income Security Act of
1974 (the "ERISA"). It is intended to constitute a Qualified
Domestic Relations Order ("QDRO") unde:r.' Section 414 (p) of the
Code and Section 206(d) (3) of ERISA.

4. The name of the Plan to which this Order applies is the
Central Pennsylvania Teamsters Pension Fund (" Fund") Def ined
Benefit Plan ("DB Plan"), P. O. Box 15223, Reading, PA 19612-
5223. Further, any successor Plan to the DB Plan shall also be
subject to the terms of this Order,
5. This Order is entered pursuant to the authority granted
in Section 3502 of the Domestic Relations Code, 23 Pa. C.S. 3502.
6, This Order relates to the provision of marital property
rights to the Alternate Payee as a result of the Order of
Dissolution of Marriage between the Participant and Alternate
Payee issued on August 5, 1998.
7. The Alternate Payee shall be entitled to benefits
calculated as a separate interest annuity to continue for her
life on the basis of a straight life annuity in the monthly
amount equal to 60'lr of the Participant's accrued benefits under
the DB Plan on April 14, 1996.
8. Commencement date and form of payment to Alternate
Payee: The Participant having passed his normal retirement date,
both Participant and Alternate Payee may elect to receive
benefits immediately.

9. The Order is not intended and shall not be considered in
such a manner as to require the DB Plan:
(a) To provide any type or form of benefit option not
otherwise provided under the terms of the DB Plan;
(bl To require the DB plan to provide increased
benefits determined on the basis of actuarial value; or
(c) To require the payment of any benefits to the
Alternate Payee that are required to be paid to another Alternate
Payee under another Order previously deemed to be a QDRO.
10. Certification of necessary information: All payments
made pursuant to this Order shall be conditioned on the
certification by the Alternate Payee and the Participant to the
DB plan Administrator of such information as the Plan
Administrator may reasonably require from such parties to make
the necessary calculation of the benefit amounts contained
herein.
11. Continued qualified status of Order: It is the
intention of the parties that this QDRO continue to qualify as a
QDRO under Section 414(p) of the Code, as it may be amended from
time to time, and that the DB Plan Administrator shall reserve
the right to reconfirm the qualified statll.'3 of the Order at the
time the benefits become payable hereunder.
12. Tax treatment of distributions made under this Order:
For purposes of Sections 402(1) (1) and 72 of the Code, any
Alternate Payee who is the spouse or former spouse of the
Participant shall be treated as the distributee of any

terms of this Order, and as such, will be required to pay the
appropriate federal income taxes on such distribution,

Participant's benefits, or any portion thereof, become payable to
the Participant as a result of a Plan terminatioi. or partial
termination pursuant to Title IV of ERISA, then the Alternate
Payee shall be entitled to commence her benefits immediately in
accordance with the terms of this QDRO and in accordance with the
termination procedures of the Plan and the benefits be reduced as
a result of such termination or partial termination, then the
