file this Petition and in support thereof state the following:
I . BACKGROl'ND.
1. Petitioners herein are Andrew D. Kepner and Erika S.
Kepner, his wife, adult individuals residing at 9 Independence
Drive, Mount Holly Springs, Cumberland county, Pennsylvania.
2. Respondent Oakwood Homes, Inc. is a purported
Pennsylvania business corporation with a mailing address of P. O.
Box 187, Paradise, Pennsylvania 17562.
3. On or about June 2, 1995 Defendants and Plaintiff
entered into an "Agreement For The Sale of Real Estate" (the
"Agreement"), which Agreement was prepared by Plaintiff and
respected, inter AliA, Defendants' purchase of a lot in the

accordance with the specifications contained in said Agreement.
A true and correct copy of the aforementioned Agreement is
attached hereto and incorporated by reference herein as "Exhibit
AU.
4. On or about September 13, 1995 Plaintiff and Defendants
entered into a stipulation Against Liens which Stipulation
provided, inter AliA, that Plaintiff as Contractor promises and
agrees that no Mechanic's Lien or liens shall be filed against
Defendants' property by anyone for materials furnished, work done
or services rendered for or on account of the erection and
construction of Defendants' residential dwelling. A true and
correct copy of the aforementioned stipulation Against l.iens is
attached hereto and incorporated by reference herein as "Exhibit
BU.
5. On or about September 18, 1995 Plaintiff and Defendants
entered into a "Change Order Contract" respecting the addition of
a basement under the living room and kitchen area of the dwelling
being constructed by Plaintiff. A true and correct copy of the
aforementioned contract is attached hereto and incorporated by
reference herein as "Exhibit C".

6. On or about April 29, 1996 Plaintiff filed a Judgment
Note (the "Note") purportedl~' signed by Defendants, in the Office
of the Prothonotary of Cumberland County, which Note wae docketed

to the above number and civil Term. A true and correct copy of
the Note entered in this action by Plaintiff is attached hereto
and incorported by reference herein as "Exhibi t 0".
7. On or about August 27, 1997 Plaintiff filed with the
prothonotary of Cumberland County a Praecipe for writ of
Execution directing the Prothonotary to issue a Writ of Execution
to the Sheriff of Cumberland County and to levy upon certain
personal property of the Defendants. A true and correct copy of
the aforementioned Praecipe for Writ of Execution is attached
hereto and incorpor;tted herein as "Exhibit E".
9. Pennsylv~nia Rule of civil Procedure 2951(a) provide.
inter AliA, that the prothonotary shall enter judgment by
confession on a note against the person who executed it and in
favor of the original holder upon the filing of the inetrument
and a certificate of residence of the Plaintiff and of the
Defendant. (See Pa.R.C.P. 2951(a), prior to the April 1, 1996
amendment effective July 1, 1996.)

required by Pa.R.C.P. 2951(a). A true and correct copy of the
document filed by Plaintiff purporting to set forth the
certification of Defendants' residence and Plaintiff's residence
is attached hereto and incorporated by reference herein as
"Exhibit F".
11. Plaintiff on April 29, 1996 entered judgment against
Defendants.
12. The Note upon which Plaintiff entered its judgment
against Defendants authorizes and empowers any "Attorney of any
Court of record of Pennsylvania" to appear for Defendante and
enter judgment against them in accordance with the terms of the
Note.
(See Exhibit D.)
13. Plaintiff is not an attorney of ~ny court of record of
Pennsylvania.
14. No attorney of any court of record of Pennsylvania
entered judgment against Defendants in accordance with the t.ra.
of the Note.
15. Plaintiff is not authorized by the term. of the
enter judgment against Defendants.

and invalid for the reason that same does and did not comply with
Fa.R.c.P. 2957(b).
35. Plaintiff has failed and/or refused to issue the
requisite notice to Defendants pursuant to Pa.R.C.P. 2958.1.
36. Plaintiff has failed and refused to provide the
requisite notice as required by Pa.R.C.P. 2958.3(a) and Pa.R.C.P.
2966 with the Writ of Execution served upon Defendants.
37. Plaintiff has egregiously ignored numerous rules of
civil procedure and Defendants' rights to due process in entering
jUdgment against Defendants and executing on same.
38. For all the reasons set forth in this Petition, the
efforts by Plaintiff to execute on Defendants' personal property
should be stayed pending a resolution of the matters raised in
this Petition.
WHEREFORE, Defendants/Petitioners request this Court to atay
the execution proceeding initiated by Plaintiff pending a
resolution of the matters raised in this Petition, strike the
judgment of confession against Defendants entered on April 29,
1996, open the judgment by confession of April 29, 1996, grant

Defendants, by their attorneys snelbaker, Brenneman & Spare,
P. C. submits this Motion as follows:
1. On September 15, 1997 Defendants filed a Petition to
strike Off or Open Confessed JUdgment and stay Execution
Proceedings with respect to a judgment confessed against them by
Plaintiff Oakwood Homes, Inc.
2. On september 17, 1997 this Court issued an Order in this
action indicating, inter ~, that depositions are to be
completed within 120 days of September 17, 1997. A true and
correct copy of the Order dated September 17, 1997 is attached
hereto and incorporated by reference herein as "Exhibi t A".
3. On October 23, 1997, Defendants' counsel noticed the
deposition of Douglas Zook, President of Plaintiff Oakwood Home.,
Inc. for 1:00 P.M. on November 21, 1997, by serving a copy of a
Notice of Deposition upon Plaintiff's counsel of record on
October 23, 1997. A true and correct copy of the Notice ot
Deposition served October 23, 1997 is attached hereto and

incorporated by reference herein as "Exhibit 8".
4. On November 21, 1997 approximately one-half hour prior
to the scheduled deposition of Douglas Zook, Defendants' counsel
received a telefax from Plaintiff's counsel dated November 20,
1997, indicating that Mr. Zook was unable to attend the
deposition scheduled for November 21, 1997. A true and correct
copy of the aforementioned telefax is attached hereto and
incorporated by reference herein as "Exhibit e".
5. The telefax received from Plaintiff's counsel was not
preceded by any communication whatsoever indicating that Douglas
Zook was unable to attend his deposition.
6. Defendants' counsel was unable to reach the court
reporter scheduled for the deposition in time to cancel her
appearance and was subsequently billed an attendance fee of
$50.00.
7. On November 21, 1997, Defendants' counsel, after
conversation with Plaintiff'S counsel, scheduled the deposition
f Douglas Zook for December 11, 1997 at 10:00 A.M. A true and
orrect copy of the Notice of Deposition scheduling the
eposition of Douglas Zook for December 11, 1997 which wa. ..rvBd
pon Plaintiff's counsel December 1, 1997 i. attached hereto and
ncorporated by reference herein as "Exhibit 0".

8. On December 11, 1997, less than one hour prior to the
scheduled deposition, Defendants' counsel received a telefax
indicating, inter Al1A, that Mr. zook was unable to attend his
scheduled deposition. A true and correct copy of the
aforementioned telefax is attached hereto and incorporated by

reference herein as "Exhibit E".
9. The telefax received from Plaintiff's counsel on
December 11, 1997 was not preceded by any communication
whatsoever indicating that Douglas Zook may not be able to attend
or was unable to attend the deposition scheduled for December 11,
1997.
10. Douglas Zook's failure to appear for and attend his
deposition is causing unwarranted delay in having this proceeding
ultimately heard by the Court for purposes of, inter AliA, having
Plaintiff's judgment lien stricken as a lien from Defendant's
home and personal property. In addition, Defendants are
incurring additional legal fees and expenses due to Mr. Zook's
failure to attend.
WHEREFORE, Defendants roquest this Court to issue an Order
compelling Douglas Zook's attendance for a deposition at the law
offices of Defendants' counselor suffer sanctions upon further

10:00 A.M. on January 21, 1998, Mr. Zook did not appear.
13. On January 21, 2998 at 11:04 A.M., one hour after Mr.
Zook's Court ordered deposition was to commence, Defendants'
counsel received a telefax from Michael D. Hess, attorney for
Plaintiff, advising that his client was unable to attend the
scheduled for January 21, 1998, and that his client
as willing to withdraw the judgment against the Defendants. A
true and correct copy of the aforementioned telefax is attached
ereto and incorporated by reference herein as "Exhibit H".
14. Consistent with prior actions by Plaintiff's counsel,
r. Hess did not call or otherwise attempt to communicate with
Defendants' counsel prior to the date scheduled for his client's
eposition to advise hia client would be unavailable.
15. Because Plaintiff's counsel failed to timely notify
Defendants' counsel of Mr. Zook's inability to attend the
eposition scheduled on January 21, 1998, Defendants' counsel Was
illed for and paid the attendance fee for a stenographer to
ppear in the amount of $50.00.
16. On January 21, 1998 Defendants' counsel sent to
laintiff's counsel a praecipe to, inter AliA, strike the
judgment Plaintiff had entered against the Defendants. A true

copy of the letter transmitting same to Plaintiff's counsel is
attached hereto and incorporated by reference herein as "Exhibit
I" and "Exhibit JII, respectively.
17. Having received no response from Plaintiff's counsel to
the submission of the praecipe for his signature, on February 10,
1998 Defendants' counsel wrote to Plaintiff's counsel requesting
the return of the praecipe at his earliest convenience. A true
and correct copy of Defendants' counsel's letter of February 10,
1998 to Plaintiff's couns~l is attached hereto and incorporated
by reference herein as "Exhibit K".
18. Plaintiff's counsel has provided no response whatsoever
to the correspondence and praecipe mailed him on January 21, 1998
and February 10, 1998.
19. Mr. Zook's failure to ~ttend his scheduled and ordered
deposition has cost Defendants additional legal fees and cost.,
including the costs of paying the court reporter.' attendance
fees.
20. Mr. Zook's failure to appear for and to attend his
deposition and his counsel's failure to sign the praecipe
presented for his signature has caused unwarranted delay, cost.
and expenses in having this matter resolved, ae a re.ult of
which, the judgment improperly entered by Plaintiff and the levy
of attachment issued in execution thereof have remained liens on

Defendants' personal and real property.
21. Defendants have incurred additional legal fees and
costs due to their counsel's need to file a Motion to Compel,
this instant Motion for Sanctions and to prepare for and review
documentation on two additional occasion~ in preparation for Mr.
Zook's deposition.
22. Plaintiff's counsel's last minute and late notices of
his client's purported inability to attend his scheduled
deposition, his obdurate and habitual failure to timely
this case by praecipe or to communicate with Defendants' counsel
communicate with Defendants' counsel and his failure to resolve
about same while knowing his client maintains a public record of
jUdgment against Defendant is vexatious.
WHEREFORE, Defendants request this Court to:
A. Issue an Order sanctioning Douglas Zook, President of
Oakwood Homes, Inc., Oakwood Homes, Inc., Michael D.
Hess, Esquire and the law firm of Burke & Hess by
requiring the payment, jointly and severally, of
Defendants' legal fees for the filing of the Motion to
Compel, the preparation for two scheduled depositions
of Mr. Zook which he did not attend, the preparation,
filing and any hearing on this Motion and the costs ot
