The Plaintiff above named, hereinafter referred to as
"Plaintitt", claims ot the Defendant abOVll named, hereinafter reterred
to a. "Detendant", the sum of $3,504,56 with interest thereon, upon the
tollowing cause of action:
1. Plaintiff is Matthews International Corporation.
Oetendant(s) is F. Mason Biggs individually and dOing business as Biggs
Building Specialists,
2. At the special instance and request ot Oefendant(s),
Plaintiff Sold and delivered to Oefendant(s) goods and merChandise, at
the time., of the kinds, in the quantities, and for the price. .et
forth in Plaintiff's bOOks of original entry, a true and correct copy
of which is attached hereto, made part hereOf, and marked Exhibit "A".
J. Defendant(s) received and accepted the goods described in
Exhibit "A".
4. The prices, inClUding service and/or other charge., it any,
which are set forth in Exhibit "A", are the tail', reasonable and aarket
prices and the prices which Defendant(s) agreed to pay.
5. All credits, if any, to which Detendant(.) i. entitle4 are
eat forth in Exhibit "A".
6. Althouih demand ha. been made, Defendant C.) h.. f.iled to
aake payment of the amount due a. above.
WHEREFORE, plaintiff claim. there is now justly clue ancl owini by

The following agreement is established for the purpose of guaranty,
that the manufacturer of the product indicated receive. prompt and
complete payment,
Thi. in no way relieves Biggs Building Specialties from any
obligations under their contract with COUNCEL CONSTRUCTION CO. for
POSTER CAS! AND DISPLAY CAS! on the PHILADBLPHIA CLZF CLUB project,
Invoice. will be submitted by Biggs Building Specialties to COUNCIL
CONSTRUCTION CO, upon shipment of material by the manufacturer, The
contractor accepts the terms of the manufacturer to be Net 30 from date
of invoice,
A. General Contractor on the PHILADELPHIA CLEP CLUB project,
COUNCIL CONSTRUCTION CO. agrees to issue a Joint Check for payment of
EIGHT THOUSAND NINE HUNDRED NINETY POUR AND 10/100...$8,994.10
(INCLUDING TAX). The check will be made payable to 8i99. Buildin9
