CaG'LAINT - CIVIL ACTION
1. Plaintiff is a corporation organized and existing under the
banking laws of the United States as a natJ.onal association (N .A.)
with a principal place of business as set forth above.
2. Defendant is an individual and resides in the County of
Cumberland.
3. Plaintiff issued defendant a credit card, which was
accepted by defendant, to be utilized in accordance with the terms
and conditions of a eredi t Account Agreement sent to defenaant
along with the credit card.
4. The Credit Account Agreement was periodically updated, and
copies of the updated Agreement were sent to defendant, each
updated Agreement stating that use of the credit card constituted
acceptance of the new Agreement. A true and correct copy of the

Credit Account Agreement governing the account at the time of
charge-off is attached hereto, made a part hereof and marked
Exhibit "A".
5. Through the use of said cr.edit card, defendant purchased,
received and accepted goods and services, and/or cash advances.
6. Defe!'ldant was mailed a statement of the account each
month, detailing inter alia each transaction by date, ven':ior, and
a;nount; the previous balance due; any payments and credits; the
annual percentage rate; minimum payment due; payment due date; and
current balance.
7. All credits to which Defendant is entitled to have been
applied, and there remained a balance due in the amount of
$7,762.86.
8. As a result of defendant's failure to make payments when
due, necessitating this legal action by an attorney not an employee
of plaintiff, under the terms of Exhibit A, plaintiff is entitled
to assess a reasonable attorney's fee against the defendant
currently calculated at twenty per cent (20%) of the balance due at
the time of termination in the amount of $1,552.57.
9. Defendant has remitted to the plaintiff, through
plaintiff's counsel, the sum of $4,600.00 on the account.
10. There remains a balance due and owing in the amount of
$4,715.43 plus any legal costs incurred.
