During all times relevant to this Complaint, Ow~ar resided at 333
Regent Street, Camp Hill, Cumberland County, Pennsylvania 17011.
4. Defendant Abdallah 0w~ar iG the father and natural
guardian of Kamran Owzar, with an address of 333 Regent Str~et,
Camp Hill, Cumberland County, Pennsylvania 17011.
5. Defendant Amjud Owzar is the mother and natural
guardian of Kamran Owzar, with an address of 333 Regent Street,
camp Hill, Cumberland County, Pennsylvania 17011.
6. Defendant Sel~na CoopAr (hereinafter "Cooper"~ is
an adult individual, currently incarcerated at the State
Correctional Institute at canbridge springs, 451 Fullerton
Avenue, Canbr.idge Springs, Pennsylvania 16403. During all times

Street, Camp Hill, Cumberland County, Pennsylvania 17011.
7. Defendant Thomas Rodi (hereinafter "Rodi") is an
adult individual residing at 563 Meggan Lane, Mechanicsburg,
Cumberland County, Pennsylvania 17055.
8. Defendant Robert Webber is an adult individual
residing at 2717 Market Street, Camp Hill, Cumberland County,
Pennsylvania 17011.
9. On November 2, 1995, Kamran Owzar, Cooper and a
~hlrd party drove to the area of North 30th Street and Beverly
Road in Camp Hill Borough.

10. The purpose of such action was to confront a group
of teenagers from East Pannsboro High School,
11. At this time, Kamran Owzar. was armed with an
unlicensed, loaded .22 caliher semi-automatic handgun.
12. Kamran Owzar had purchased the gun at some time
prior' to this incident. OWlar purchased this gun from another
teenager, whose identity is not known at this time.
13. The handglln was owned by, and/or registered to,
Defendant Webber. Upo~ information and belief, the individual
who sold the handgun to OW7.ar resided with Webber, and is the
step-son of Webber.
14. Cooper, Kamran Owzar and the other third party
werp. driving a vehicle owned by Defendant Rodi.
15. Upon information and belief, Rodi gave express
permission for Cooper and/or Kamran Owzar to utilize his vehicle
on the date of November 2, 1995.
16. Prior to such date, Rodi possessed knowledge that
Kamran Owzar was in possession of an unlicensed, loade,d semi-
automatic handgun, and was known to carr.y such handgun.
17. At. or about 'i:30 p.m. November 2, 1995, cooper,
Kamran Owzar and a third party arrived at the area ot Nor~b 30~b'
Street and Beverly Road.

19. Defendants Cooper and Kamran OW7.ar passed by ~
group of teenagers from East pennsboro High School whQ \~ere in
the area.
20. Defendants Cooper and Kamran Owzar drove past the
teenagers again, and at this time Kamran Owzar fired
approKimately ten (10) bullets from the handgun directly towards
the teenagers, including Plaintiff.
21. Kamran Owzar struck Christopher Case with one such
bullet.

22. Paragraphs 1 through 21 are incorporated as if set
forth fully herein.
23. Owzar intended to instill in Case a fear of
offensive physical contact.
24. Owzar attempted to create such offensi~e physical
contact by aiming a loaded semi-automatic handgun at Case, and by
firing such handgun towards Case.
25. Due to such actions, Case has suffered severe
physical harm, and continues to incur damages due to Owzar's
actions.
WHEREFORE, Plaintiff respectfully requests this
HDnorab1e Court enter Judgment for plaintiff and against
Defonctant, for all damages incurred by Plaintiff, plua costs,

35. By falUng to control Kamran owzar, Abdollah Owzar
breached such duty.
36. Abdallah Owzar knew, or reasonably should have
known, that: Kamran Owzar had threatened and/or committed physical
harm to certain teenagers affiliated with East pennsboro High
School in the pagt.
37. Abdollah Owzar knew, or reasonably should have
known, that Kamran Owzar possessed an unlicensed, loaded 88mi-

automatic handgun, and that Kamran Owzar had a propensity to
commit violence.

that Kamran Owzar had threatened and/or committed physical harm
to certain teenagers affiliated with EastPennsboro High School
in the past.

handgun, and that Kamran Owzar had a propensity to commit
violence.

suffered severe physical har.m, and continues to incur damages due
to Amjud Owzar's actions.

unreasonably operating and providing the transportation with
knowledge, or reasonably should have known, that Kamran Owzar
intended to commit bodily harm, or attempted bodily harm, against

certain individuals. Such individuals included Plaintiff.
49. DUA to such breach, Plaintiff has Buffered sever
physical harm, and continues to incur damages due to cooper's
actions.

Dufendant, for all damages incurred by plaintiff, plus costs,

and Kamran Owzar to operato and control his vehicle.
59. Rodl permitted such action with knowledge, or
reasonably should halle known, that Kamran Owzar was armed with a
loaded semi-automatic handgun, and that Cooper and/or Kamran
Owzar were known to have a propensity for violence.
60. Due to such breach, Plaintiff has suffered sever
physical harm and continues to incur damages due to Rodi's
act ions.
WHEREFORE, Plaintiff respectfully requests this
Honorable Court enter Judgment for Plaintiff and against
Defendant, for all damages incurred by Plaintiff, plus costs,

secure his firearms, thereby allowing a loaded semi-automatic
handgun to be taken from his possession and control. Said

observed Defendant Kamran Owzar on one prior occasion to be in
possession of what appeared to be a firearm, it is specifically
denied that Defendant Rodi had any reason to believe that Kamran
Owzar was in possession of a gun on the date in question. By way
of further answer, Defendant is not aware of any information which
would tend to indicate that Defendant Kamran Owzar was known to
carry a handgun.

permitted any such action, nor did he provide any permission to
Kamran Owzar to drive or control his vehicle.

FACTS COMMON TO A~~COUNTS
1. Christopher Case (hereinafter "Case") is d minor
child, with an address of 1611 Matthew Road, Camp Hill,
Cumberland County, Pennsylvania 170~1.
2. Herbert Mark Ciilse and Floronce M. Case, husband and
~ifB, are the parents and natural guardians of Christopher Case,
~ith an addres~ of 1611 Matthel/ Road, Camp Hill, Cumberland
County, Pennsylvania 17011.
3, Defendant Kamnll Owzar (hereinaftp.r "Owzar") is a
minor, currently incarcerated at the North Central Secure

Treatment Unit, 210 clinic Road, Danville, Pennsylvania 17821.
During all times relevant to this Complaint, Owzar resided at 333
Regent St~eet, Camp Hill, Cumberland County, Pennsylvania 17011.
4. Defendant Abdollah Owzar is the father and natural
guardian of Kamran OWZiilr, with an addruss of 333 Regent StrQet,
Camp Hill, Cumberland County, Pennsylvania 17011,
5. Defendant Amjud Owzar is the mother and natural
guardian of Kamran Owzar, with an address of 333 Regent Street,
CaMp Hill, Cumberland County, Pennsylvania 17011,
6. DQfendant Selena CoopAr (hereinafter "coop~r") is
an adult individual, currently incarcerated at the State
Correctional Institute at Canbridge Springs, 451 Fullerton
Avenue, Canbridge Springs, Pennsylvania 16403. During all times
relevant to thls Complaint, cooper resided at 26 South 34th
Stroet, Camp Hill, Cumberland County, Pennsylvania 17011.
7, Defendant Thomas Rodi (hereinafter "Rodi") is an
adult individual residing at 563 Meggan Lane, Mechanicsburg,
Cumberland County, Pennsylvania 17055,
8. Defendan~ Robert Webber is an adult individual
residing at 2717 Market Str.eet, Camp Hill, Cumberland County,
Pennsylvania 17011.
9. On November 2, 1995, Kamran Owzar, Cooper and a
~hird party drove to the area of North 30tn Street and Beverly
Road in Camp Hill Borough.

10. The purpose of such action was to confront a group
of teenagers from East pennsboro High School,
11. At this time, Kamran Owzar was armed with an
unlicensed, loaded .22 calib~r semi-automatic handgun.
12. Kamran Owzar had purchased the gun at some time
prior to this incident. Owzar purchased this gun from another
teenager, whose identity is not known at this time.
13. The handgun was owned by, and/or registered to,
Defendant Webber. upon information and belief, the individual
who sold the handgun to Owzar resided with Webber, and is the
step-son of webber.
14. Cooper, Kamran Owzar and the other third party
wer~ driving a vehicle owned by Defendant Rodi.
15. Upon information and belief, Rodi gave express
pernission for: Cooper" and/or Karnran owziilr to utilize his vehicle
on tho date of November 2, 1995.
16. Prior to such data, Rodi possessed knowledge that
Kamran owzar was in possession of an unlicensed, loaded semi-
automatic handgun, and was known to carry such handgun.
17. At or: about 5:30 p.m. November 2, 1995, Cooper,
Xanriiln Owziilr and a third piilrty arrived at the areiil of North 30th
Street and Beverly Road.
10. At that time, Coopor ~Ias operating Defendant
Rocti's vehicle, with Kamran Owzar in the front passenger seat,
and the third party in the hack seat.

19. Defendants Cooper and Kamran Owzar passed by a
grou? of teenagers from East pennsboro High School who were in
the area.
20. Defendants Cooper and Kamran Owzar drove past the
teenagers again, and at this time Kamran Owzar fired
apvroxirnately ten (10j bullets from the handgun directly towards
che teenagers, including Plaintiff.
21. Kamran Owzar struck Christopher Case with one such
bullet.

58. Rodi breached this duty by allowing Selena Cooper
and Kemran owzar to operate and control his vehicle.
59. Rodi permitted sllch action with knowledge, or
reasonably should have known, that Kamrall owzar was armed with a
loaded semi-automatic handgun, and that Cooper and/or Kamran
owzar wore known to have a propensity for violence.
60, Due to such breach, Plaintiff has suffered sever
physical harm and continues to incur damages due to Rodi's
act ions.
WHEREFORE, plaintiff respectfully requests tris
Honcrable court en~er Judgment for Plaintiff and against
Defendant, for all damages incurred by Plaintiff, plus costs,
attorneys fees and puni ti VEl damages, Such amount is greater than
the amount requiring compulsory arbitration.

NEGLIGENCE
61. paragraphs 1 through 32 are incorporated as if set
forth fully herein.
62. Webber owed a duty to Plaintiff to insure that all
firearms in his possession were secured and accounted for.
63. Webber breached this duty by failing to properly
secure his firearms, thereby allowing a loaded semi-automatic
handgun to be taken from his possession and control. Said
handgun eventually coming to be possessed by Kamran owzar.

64. Due to such breach, Plaintiff has suffered severe
physical harm, and continues to incur damages due to Weber's
actions.
WHEREFORE, Plaintiff respectfully requests this
Honorable Court enter Judgment for Plaintiff and against
Defendant, for all damages incurred by Plaintiff, plus costs,
attorneys fees and punitive damages. Such amount is greater than
the amount requiring compulsory arbitration.

attorneys the Offices of Fenstermacher and Associates, and files
this petition to Make Rule Absalu~", as follows:
1. Plaintiffs' Motion to Compel Answers to Plaintiffs'
First Set of Interrogatories Addressed to Defendant Selena Cooper
was filed and served on February 13, 1997.
2. On February 19, 1997, the Court, by the Honorable
J. Wesley aler, Jr., issued a Rul~ to Show Cause upon Defendant
Selena Cooper (See Exhibit "A" attaChed hereto).
3. Upon information and belief said Rule was
distributed to Selena Cooper pursuant to Pa. R.C.P. 23~ and Loca!
Rule 206-6,

4. Said Rule'was also served upon Defendant Cooper by
correspondence dated February 20, 1997 from the undersigned
attorney (See Exhibit "B" attached hereto).
5. As of this date no response to the Rule, or Answers
to Interrogatories, have been filed or served.
WHEREFORE, Plaintiffs respectfully request this
Honorable Court enter an Order making the Rule Absolute and Order
Selena cooper to serve Answers to Plaintiffs' First Set of
Interrogatories within twenty (20) days or suffer the appropriate
sanctions.

3. Pursuant to suoh Motion the Honorable J. Wesley
'Oler, Jr" issued a Rule to Show Cause on February 19, 1997 (See
Plaintiffs' Exhibit "B" attached hereto).
4. As Defendant Cooper did not respond to the Rule to
Show Cause, Plaintiff filed a Petition to Make Rule Absolute on
March 19, 1997.
5. Pursuant to Plaintiffs' Petition to Make Rule
Absolute on March 20, 1997 the Honorable J. Wesley Oler, Jr,
issued an Order requiring Defendant Cooper to provide Answers to
Plaintiffs' First Set of Written Interrogatories within twenty
(20) days of service or suffer the appropriate sanctions (See
Plaintiffs' Exhibit "C" attached hereto).
6. upon information and believe said Order was
distributed to Defendant Cooper pursuant to Pa. R.C.P. 236 and
Local Rule 206-6. Plaintiffs took the additional step of also
serving the Order upon Defendant Cooper (See Plaintiffs' Exhibit
"0" attached hereto).
7. As of this date, Defendant Cooper has failed a\~
refused to respond to said Order or serve her Answecs to
Plaintiffs' First Set of Interrogatories.
8. Pursuant to Pa. R.C.P. 4019, as well as the order
of Court, this Court may impose the appropriate sanctions upon
Defendant Cooper.

9. Defendant is cu~rently incarcerated at the State
corraction Institute at Cambridge Springs in Cambridge Springs,
Pennsylvania. Defendant is incarcerated due to charges arising
from her acts, as set forth in Plaintiffs' Complaint, giving rise
to civil actions of negligence and conspiracy to commit assault
and battery.
10. Plaintiff cannot adequately obtain the info~mation
required in the Interrogatories as a substantial hardship and
expense would be required to depose Defendant Cooper while she is
incarcerated in the northwestern part of Pennsylvania, or take
steps to have her transported to Cumberland County.
11. The information requested in Plaintiffs'
Interrogatories address the necessary (actual issues needed to
prove the claim against not only Defendant cooper but other
Defendants as well, particularly Defendants Kamran Owzar and
Thomas Rodi.
12. Plaintiff believes and asserts that the most
appropriate and available sanction for Defendant Cooper's willful
disobedience of an Order of Court is the entry of a default
judgment against her, plus costs and attorneys' fees.

PETITION FOR WITHDRAWAL AS COUNSEL
AND NOW, comes William A. Addams, of Addams & Rundle, and
respectfully represents:
1. The Petitioner is William A. Addams, attorney of record
for Robert Weber, a defendant in the above captioned matter.
2. This action is a result of a "drive by shoot.ing" in
which the minor plaintiff was injured. The handgun involved was
stolen fr.om Mr. Weber's residence. It is alleged he failed to
properly secure the flrearm.
3. Your petitioner is representing Mr. Weber pro bono on a
referral from Legal Services, Inc. on April 16, 1997.
4. Your petitioner met with Mr. Weber on April 22, 1997 and
followed to send him status reports on April 23, July 1 and
October 2, 1997, February 5, June 3, September 2 and December 2,
1998, and on March 2, 1999 to his residence at 2717 Market
Street, Camp Hill, during which time this lawsuit remained
inactive.
5. The March 2, 1999 letter was returned marked,
"undeliverable as addressed - forwarding order expired."
6. The petitioner attended the depositions of Herbert and
Florence Case on June 30, 1999. Additional depositions are
scheduled for September 22 and 23, 1999.
7. Although liability is questionable and Mr. Weber
apparently has no assets, counsel for the plaintiffs has refused
the petitioner's request to dismiss Mr. Weber from this action.
a. Mr. Weber has never contacted your petitioner following
the initial meeting on April 22, 1997.
9. The petitioner is unable to contact Mr. Weber. The
house at 2717 Market Street appears vacant. A clerk at the Camp
Hill post office told your petitioner it has no new address for
him. Legal Services has no additional information regarding his
whereabouts and has no resources to locate him. The telephone
number he provided is registered to another person at a different
address.
10. The representation of Mr. Weber has been rendered
unreasonably difficult by the client.
11. The petitioner is unable to give notice of the filing of
this petition to Mr. Weber.
12. The withdrawal of the petitioner as counsel is within
the requirements of Rule 1.16 of the Rules of Professional
Conduct regarding terminating representation.
