1996 comes the
plaintiff, Brian Gross, by and through his attorney, The Law
Offices of SPERO T. LAPPAS, and makes this Complaint against the
above-captioned Defendant, respectfully representing as follows:
1. Brian Gross is an adult individual who at all times
material to this cause of action has resided at 1 Spend-a-Buck
Drive, Dillsburg, Pennsylvania.
2. Care Health systems, Inc. is a business corporation
organized under the laws of the Commonwealth of pennsylvania.
Defendant has its principle place of business at 103 Mulberry
Street, Newport, pennsylvania.
3. On or about December 6, 1995 the Plaintiff and the
Defendant entered into a written contract by which the Plalntiff
agreed to provide professional employment services to the

Defendant, and pursuant to which the Defendant agreed to employ the
Plaintiff as a pharmacist.
4. Pursuant to the terms of this contraot, the Defendant
promised to pay the Plaintiff the total sum of $34,000.00.
5. On or about January 23, 1996, the Defendant breached this
contract by terminating the Plaintiff's employment.
6. The Defendant's actions were taken unilaterally and
without legal cause or excuse.
7. The Defendant has further breached the contract by
failure to pay the Plaintiff the full amount owed under this
contract.
8. The Defendant has, on various dates, made partial payment
to the Plaintiff in the amount of $10,506.69.
9. Accordingly, the Defendant stands indebted to the
Plaintiff in the amount of $23,493.31.
10. The Plaintiff has applied for and received unemployment
compensation benefits as a result of his employment termination.
11. In the course of those unemployment compensation
proceedings, the Defendant contended that the Plaintiff was
terminated for willful misconduct.
12. The parties were afforded a full and fair opportunity to
litigate those issues.
13. The un~mployment compensation referee decided those
issues adverse to the Defendant: finding that the Plaintiff had
committed no willful misconduct.

12. Termination of Agreement. Without cause, Emplo)":1l or the Company may temUnate

agreement, the Company may terminate Employee's cmptoyment upon 0110 day's notice to the

13. Death Benefit. Should Employee die during his employ, the Company shall pay to tbe
Employee's C$late any compensation due him/her up to the end of the month in which Employee
dies. The Employee also has a 550,000 life insurance policy with the Compally it' he/she is
under the Medical Insurance plan.
14. 401 K Plan. After one year of employment with the Company, the Employee is entitled
to participate in the Company's 40 I K plan. There is a potential 0.3% CI1',ployer match at the
end of each year.
1S. Major Medical Health Insurance. The Company utilizes II prefared provider network.
There is a $10.00 Co-pay responsibility by the Employee, then 100% is covered under the
network. Outside the network by the $3lT1e insurance comp3/1Y, there is a $200 deductable
and then an 80.20 co-insurance to $2500. We also have a dental/vision package. The
Company pays 70% of the ill$Ul'allee prosram and the Employee pays 30%.
16. Merchandise. Merchandise may be purchased through II pharmacist manager or
supervisor at cost. The merchandise is to be written on II sales slip, put in tli~ cOmputer,
and a cheek written tQ be credited on the computer by tho blUing manlier at your location. .

19. Effect or Prior Agreements. This asreement supersedes any prior asreement between
the Company and Ihe Employee, except that this asreement shall not m1ucc any benelit or
compensation due Employee of a kind elsewhere provided and not expms1y providecl for

2', Arbitration. All claims or controversy that arise out of or relate to this asreement, or
the breacb of it, shall be settled by arbitration in &l;cordance with the rules ofthe American
Arbitration Association. Judgment upon any award may be Clltered in any court with jllrisdi~on..
21. Effect of Waiver by Company. Should Company wllive a breach of any provision of
this agreement by the Employee, such waiver shall not be construed a W1Iiwr of later breach by
Employee. .
22. Severability. Ifany provision of this aarecmcnt is held invalid, all other provisions of this
aarecment shall remain in effect. If this agreement is held invalid, then to the extent permittod by
law. any prior agreement between the Company (or any predecessor thereof) and Employee
shall be deemed reinstated as if this agreement had not been executed. ~
23. Assumption of Agreement. C.mpany's riaJlta and obligations under this agreement shall
inure 10 the benefit and be binding upon the Company's successors and amsnees,
