entered:
1. The defGndant, MORRIS H. METZGER, JR., is enjoined from
physically abusing the plaintiff, KIMBERLY A. METZGER, or from
placing her in fear of abuse.
2. The defendant is enjoined from having any direct or
indirect contact with the plaintiff including, but not limited
to, telephone and written communicationD.
3. The defendant is ordered to refrain from harassing and
stalking the plaintiff and from harassing the plaintiff'.

5. The defendant is prohibited from removing, damaging,

County, Pennsylvania, except for the limited purpose of repairing
and replacing the plaintiff's items listed on the losses exhibit.

7. The defendant is ordered to stay away from any
residence the plaintiff may in the future establish for herself.
8. The defendant is ordered to reimburse and repair the
plaintiff's out-of-pocket losB~s including but not limited to the

repair the back Bcreen door and purchase any neCeBsary materials;
he will purchase and replace the armiture/pump on the front storm
door and will purchase and replace the front door with a door of
similar coloring and material, and he will reimburBe the

amount of $63.59. The total amount of lOBses ~hall be reimbursed
and repaired within 60 days of the entry of this Order. An award
under this chapter Bhall not constitute a bar to litigation for
civil damages for inJuries Bustained from the acts of abuse
giving rise to the award or a finding of contempt under thiB
chapter .
9. The Court COStB and feeB are waived.
10. ThiB Order shall remain in effect for a period of one
(1) year and can be extended beyond itB original expiration date
if the Court finds that the defendant haB committed an act of
abuse or has en;aged in a pattern or practice that indicateD risk
of harm to the plaintiff on a continued basis. ThiB Order shall
be enforceable in the same manner aB the Court'a prior Temporary
Protection Order entered in thiB case.

11. This Order may subject the defendant to: i) arrest
under 23 Pa, C.S. 86113; ii) a private criminal complaint under
23 Pa, C.S. 86113.1; iii) a charge of indirect criminal contempt
under 23 Pa, C.S. 86114, punishable by imprisonment up to six
months and a fine of '100.00-$1,000.00; and iv) civil contempt
under 23 Pa. C.S. 86114.1. Res~mption of co-residence on the
part of the plaintiff and defendant shall not nullify the
provisions of the court order.
12. The Pennsylvania State and Middlesex Township police
Department shall be provided with certified copies of this Order
by the plaintiff's attorney and may enforce this Order by arrest
for indirect criminal contempt without warrant upon probable
cause that this Order has been violated, whether or not the
violation is committed in the presence of the police officer. In
the event that an arrest is made under this section, the
defendant shall be taken without unnecessary delay before the
court that issued the order. When that court is unavailabl.e, the
defendant shall be taken before the appropriate district justice.

This Agreement i8 entered dn this ~ day of May, 1996,
by the plaintiff, KIMBBRLY A. MBTZGBR, and the defendant, MORRIS
H. MBTZGBR, JR. The plaintiff is represented by Joan Carey of
LBGAL SERVICES, INC.; the defendant is represented by John
Broujos of BROUJOS, GILROY & HOUSTON. The parties agree that the
following may be entered as an Order of Court.
1. The defendant, MORRIS H. METZGER, JR., agrees to
refrain from abutiing the plaintiff, KIMBBRLY A. METZGER, or
placing her in fear of abuse.
2. The defendant agrees not to have any direct or indirect
contact with the plaintiff including, but not limited to,
telephone and written communications.

harm to the plaintiff on a continued basis. The defendant
understands that this Order will be enforceable in the same

11. Violation of the Protection Order may subject the
defendant to: i) arrest under 23 Pa. C.S. 66113; ii) a private

Carlisle, Cumberland County, Pennsylvania, is hereby enjoined
from physically abusing the plaintiff, KIMBERLY A. METZGER, or
placing her in fear of abuse.
The defendant is ordered to stay away from the plaintiff's
residence located at 1328 pine Road, Lot 6, Carlisle, Cumberland
County, Pennsylvania, a residence which is owned by the
plaintiff.
The defendant is ordered to refrain from having any direct
or indirect contact with the plaintiff including, but not limited
to, telephone and written communications.
The defendant is enjoined from harassing and stalking the
plaintiff and from harassing the plaintiff's relatives.
The defendant i.s enjoined from entering the plaintiff's
place of employment.
The defendant is enjoined from removIng, damaging,
destroying or selling any property owned by the plaintiff.

A. ABUSI
1. The plaintiff, KIMBERLY A. METZGER, is an adult
individual residing at 1328 pine Road, Lot 6, Carlisle,
Cumberland County, Pennsylvania 17013.
2. The defendant, MORRIS H. METZGER, JR., SSN:175-48-3159
and DOB:9/7/56, is an adult individual residing at 65 West Church
Avenue, Apt. 102, Carlisle, Cumberland County, Pennsylvania,
17013.
3. The defendant is the husband of the plaintiff.
4. Since approximately November 1995, the defendant has
attempted to cause and has intentionally, knowingly, or
recklessly caused bodily injury to the plaintiff, has placed the
plaintiff in reasonable fear of imminent serious bodily injury,
and has knowingly engaged in a course of conduct or repeatedly
committed acts toward the plaintiff under circumstances which
have placed the plaintiff in reasonable fear of bodily injury.
This has included, but is not limited to, the following specific
instances of abuse:
a. On or about April 30, 1996, while the plaintiff
and her son were at her friend's home, the defendant
came into that residence, threatened the plaintiff
saying, "I'll fucking kill you, bitch," and punched the
plaintiff repeatedly about the shoulder, neck, and
chest with his fists, causing her to fall backward onto
her son who suffered a bloody nose. The plaintiff's
friends called 911, and the state Police have issued a
warrant for the defendant's arrest.
b. On or about April 23, 1996, the defendant broke
through the plaintiff's locked door, and fearing for
her safety, the plaintiff picked up the phone to call
the police. The defendant grabbed the phone from the
plaintiff and threw it across the kitchen hitting and
breaking a picture and breaking the phone. When the
defendant left the residence, the plaintiff locked her
door. The defendant returned a few minutes later,
kicked the door in, pushed the plaintiff onto the
couch, grabbed her by the throat, and choked her. The
defendant then threw the cordless phone to the floor,
~tomped on it and rendered it unusable. The defendant
cut off other means the plaintiff may have had to call.
for help by pulling the cord from the phone in the
kitchen and the cord from the answering machine in the
bedroom. The defendant then pushed the plaintiff onto
the bed, straddled her, and held her arms down. When
the defendant let the plaintiff up, he grabbed her
banking papers and ran outside. When the plaintiff
tried to retreive her papers, the defendant pushed her
causing her to hit the truck. To escape further abuse,
the plaintiff ran into the house and locked the door,
but the defendant followed her, kicked the locked door
in, and threatened that she would be sorry. The
plaintiff suffered bruising to her arms and side.
c. In or around the beginning of February 1996, the
defendant pushed the plaintiff onto the bed, straddled
her, and choked her.
d. In or around December 1995, the defendant kicked
the plaintiff's screen door breaking it and placed his
hands around her throat threatening to choke her.
e. Since November 1995, approximately twice a month,
the defendant abused the plaintiff in ways including,
but not limited to, the following: pushing, grabbing,
and Choking.
5. The plaintiff believes and therefore avers that she is
in immediate and present danger of abuse from the defendant, and
that she is in need of protection from such abuse.
6. The plaintiff desires that the defendant be prohibited
from having any direct or indirect contact with the plaintiff
including, but not limited to, telephone and written
communications.
7. The plaintiff desires that the defendant be enjoined
from harassing and stalking the plaintiff, and from harassing the
plaintiff's relatives.
8. The plaintiff desires that the defendant be restrained
from entering her place of employment.
9. The plaintiff desires that the defendant be enjoined
from removing, damaging, destroying or selling any property owned
by the plaintiff.
B. eXCLUSIve posseSSION
10. The mobile home from which the plaintiff is asking the
Court to exclude the defendant is owned in the name of the
plaintiff and the defendant moved from the home approximately six
weeks ago.
C. LOSSIIS
11. The plaintiff has suffered losses as a result of the
abuse by the defendant. The losses ar.e listed on Exhibit A
attached.
WHEREFORE, pursuant to the provisions of the "Protection
from Abuse Act" of October 7, 1976, 23 P.S. S 6101 n ug., as
amended, the plaintiff prays this Honorable Court to grant the
following relief:
A. Grant a Temporary Order pursuant to the
"Protection t,t:om Abuse Act:"
1. ordering the defendant to refrain from
abusing the plaintiff or placing her in fear of
abuse;
2. Order\ng the defendant to refrain from having
any direct or indirect contact with the plaintiff
including, but not limited to, telephone and
written communications;
3. ordering the defendant to refrain from
harassing and stalking the plaintiff and from
harassing the plaintiff's relatives;
4. Prohibiting the defendant from entering the
plaintiff's place of employment;
5. Prohibiting the defendant from removing,
damaging, destroying or selling property owned by
the plaintiff;
6. Ordering the defendant to stay away from the
plaintiff's residence located at 1328 pine Road,
Lot 6, Carlisle, Cumberland County, Pennsylvania;
7. Ordering the defendant to stay away from any
residence the plaintiff may in the future
establish for herself;
B. Schedule a hearing in accordance with the
provisions of the "Protection from Abuse Act," and, after
euch hearing, enter an order to be in effect for a period of
one year:
1. ordering the defendant to refrain from
abusing the plaintiff or placing her in fear of
abuse.
2. Ordering the defendant to refrain from having
any direct or indirect contact with the plaintiff
including, but not limited to, telephone and
written communications.
3. ordering the defendant to refrain from
harassing and stalking the plaintiff and from
harassing the plaintiff's relatives.
4. Prohibiting the defendant from entering the
plaintiff'S place of employment.
S. Prohibiting the defendant from removing,
damaging, destroying or selling property owned by
the plaintiff.
6. Ordering the defendant to stay away from the
plaintiff'S residence located at 1328 Pine Road,
Lot 6, Carlisle, Cumberland County, Pennsylvania.
7. Ordering the defendant to stay away from any
residence the plaintiff may in the future
establish for herself.
8. Ordering the defendant to reimburse the
plaintiff'S out-of-pocket losses suffered as a
result of the abuse including but not limited to
the losses listed on the attached sheet marked
Exhibit A.
