COUNT OKI - HlaLIalKCI THONAI RAYHART V. IRIDalT HILLIISH 1. Plaintiff Thomas Rayhart is an aault individual who resides at RR2/ Lot 211, Creekview Farm, Shermansdale, Pennsylvania. 2. Plaintiff Lisa Rayhart is an adult individual who resides at RR2, Lot 211, Creekview Farm, Shermansdale, Pennsylvania. 3. Defendant Bridget Hillbish is an adult individual who resides at 208 Second street, P.O. Box 443, Surnmerdale, Pennsylvania. 4. On or about January 23, 1995, at or about 8:19 A.M., Plaintiff Thomas Rayhart, who was operating a 1990 Ford Mustang, was traveling south on Rich Valley Road in silver Spring Township, Cumberland county, Pennsylvania. 5. At said thle, Defendant Bridget Hillbish was the operator of a 1993 Chevrolet Cavalier at the intersection of Sherwood Drive and Rich Valley Road in silver Spring Township, Cumberland County, Pennsylvania. Defendant Bridget Hillbish pulled her vehicle out from the stop sign and turned left onto Rich Valley Road into the path of Plaintiff Thomas Rayhart's vehicle. 6. Defendant Bridget Hillbish was negligent and careless in the operation of said motor vehicle for the following reasons which include, but are not limited to: a. making a left hand turn when it was unsafe to do so; b. failure to keep said motor vehicle under proper control; c. failure to operate said motor vehicle with due care for the rights and safety of Plaintiff Thomas Rayhart; d. failure to yield the right of way to an approaching vehicle; 2 ., , . e. disregarding the rights, safety and position of other vehicles on the road, including Plaintiff Thomas Rayhart, and/or f. failure to stop in time to avoid a collision with the motor vehicle operated by Plaintiff Thomas Rayhart. 7. As a direct and proximate result of Defendant Bridget Hillbish's negligence and carelessness, and not due to any act or failure to act on the part of Plaintiff Thomas Rayhart, said Plaintiff suffered great pain and suffering, traumatic anxiety, depression, shock to his nervous system, and other injuries, some or all of which may be permanent, including, but not limited to: severe neck and back pain resulting from acute lumbar and cervical strain and sprain. 8. As a direct and proximate result of Defendant Bridget Hillbish's negligence and carelessness, Plaintiff Thomas Rayhart has been, and may continue to he in the future, unable to attend to his usual habits, customs, vocation, and enjoyment of life. 9. As a direct and proximate result of Defendant Bridget Hillbish's negligence and carelessness, Plaintiff Thomas Rayhart has been in the past, and may continue to be in the future, required to undergo medical treatments and procedures. 10. As a direct and proximate result of Defendant Bridget Hillhish's negligence and carelessness, Plaintiff Thomas Rayhart has been in the past, and may continue to be in the future, required to spend great sums of money for medical treatments and proced'Jres as a result of his injuries. 11. As a direct and proximate result of Defendant Bridget Hillbish's negUgence and carelessness, Plaintiff Thomas Rayhart has 3 .- . been unable to engage in his occupation and therefore has in the past and may in the future continue to suffer a loss of income and/or loss of earning capacity. 12. Plaintiff Thomas Rayhart is entitled to recover damages under the full tort option provided by the Motor Vehicle Financial Responsibility Law, Title 75 Pa, C.S.A. S 1705 et. seq. WHIRlrORI, Plaintiff Thomas Rayhart hereby demands judgment in his favor and against Defendant Bridget Hillbish in an amount not in excess of $25,000.00, plus costs and interest. Due to the negligence of the defendant Bridget Hillbish, plaintiff Lisa Rayhart has been deprived of the companionship, care, service, earnings and consortium of her husband, Plaintiff Thomas Rayhart. WHEREFORE, Defendant Bridgette Hilbish respectfully requests judgment in her favor and against the Plaintiffs, together with costs. NEW MATTER 15. The answers in paragraphs one (1) through fourteen (14) are incorporated herein by reference. 16. The Plaintiffs' actions are barred or limited pursuant to the terms of the Pennsylvania Motor Vehicle Responsibility Act, 75 Pa.e.s. S1701 ~ ~., the provisions of which are incorporated herein by reference. 17. Plaintiff Thomas Rayhart was comparatively negligent to a degree greater than the causal negligence on the part of the Defendant, the existence of such negligence being specifically denied. If it is determined that the Defendant is liable to the Plaintiffs, the plaintiffs' recovery, if any, should be eliminated or reduced in accordance with the Pennsylvania Comparative Negligence Act, 42 Pa.e.S.A. S7102 ~ ~. 18. The negligence of Plaintiff Thomas Rayhart consisted of, but is not 1 imi ted to: A. Failing to keep alert and maintain a proper lookout for thE! presence of other automobiles on the roadway; B. Failing to have the vehicle he was operating under proper and adequate control; e. Failing to take the proper evasive acti.on in a timely fashion; D. Fail ing to be properly attentive; F. Operating his vehicle at a speed in excess of that which the conditions permitted; and G. Violating the provisions of the Vehicle Code, specifically 75 Pa.C.S.A. S3361. 19. Plaintiffs fail to state a valid claim against Defendant upon which relief can be granted. WHEREFORE, Defendant Bridgette Hilbish respectfully requests judgment in her favor and against the Plaintiffs, together with costs.
