The Plaintiff is DAUPHIN DEPOSIT BANK AND TRUST COMPANV, a Pennsylvania Banking Corporation with its principal place of business at 213 Market Street, Harrisburg, Pennsylvania 17105. 2. The Defendant, TYRONE BELL, is an adult individual whose last known address is 611-8 Geneva Drive, Apartment 13, Mechanicsburg, Pennsylvania 17055. 3. The Defendant, DAVID W. FRY, is an adult individual whose last known address is 217 Seneca Street, Harrisburg, Pennsylvania 17110. 4. The Defendant, VIRGINIA M. FRY, is an adult individual whose last known address is 217 Seneca Street, Harrisburg, Pennsylvania, 17110. 5, On or about March 4, 1994, the Plaintiff advanced the sum of Ten Thousand Three Hundred Fifty-seven Dollars and Twenty-one Cents ($10,357.21) to the Defendants at an interest rate of Eleven and Fifty-five Hundredths percent (11.55') per annum resulting in a financ~ charge of Two Thousand Six Hundred Eighty-two Dollars and Forty-seven Cents ($2,682.47) for a total repayment amount of Thirteen Thousand Thirty-nine Dollars and Sixty-eight Cents ($13,039.68), hereinafter called the "Loan". 6. As evidence of the Loan, Defendants, as co-makers, executed and delivered to Plaintiff a Pennsylvania Motor Vehicle Installment Sale Contract dated March 4, 1994, by which Defendants promised to pay to Plaintiff the sum of Thirteen Thousand Thirty- nine Dollars and Sixty-eight Cents ($13,039.68), hereinafter called the "Contract". A copy of the Contract is attached hereto as Exhibit "A" and made part hereof. 7. As security for the Loan, the De fendants TYRONE BELL, WILLIAM W. FRY and VIRGINIA M. FRY, granted to Plaintiff a security interest in a 1990 Volkswagen Passat, hereinafter called the "Vehicle" . 8. By the terms of the Contract, Defendants agreed to pay to Plaintiff the sum of Two Hundred Seventy-one Dollars and Sixty-six Cents ($271.66) per month, beginning April 18, 1994, and monthly thereafter for a period of Forty-eight (48) months. 9. Pursuant to the terms of the Contract, failure to make any payment on or before,the date it is due constitutes a default. 10. The Defendants defaulted under the Contract by failing to make the payments due and owing on September 18, 1995, and all monthly payments thereafter. 11. On or about December 5, 1996, Plaintiff sent a Notice of Repossession of the Vehicle to the Defendants, advising Defendants of the repossession of the Vehic le, the dates and amount of default, their right to redeem and the amount required, and that the Vehicle would be sold at public auction if not redeemed. -2- 12. Defendants failed to take any timely action in accordance with said Notice of Repossession. 13. The Vehicle was sold at public sale on February 17,1996, in Dauphin County, Pennsylvania 17018. 14. After sale of the Vehicle and application by plaintiff of the proceeds of the sale of the Vehicle to the Loan, a deficiency balance in the amount of Seven Thousand Five Hundred Forty Dollars and Ninety-three Cents ($7,540.93), plus interest as stated in the Contract, remained due and owing on the Loan. 15. On or about February 26, 1996, plaintiff notified the Defendants of the deficiency balance on the Loan and requested payment of same. 16. Thp. Defendants have failed to make any payment to Plaintiff on account of the deficiency balance of the Loan. 17. Pursuant to the terms of the Contract, the Defendant is obligated to pay Plaintiff the deficiency balance on the Loan plus Fifteen (15\) percent of the balance due as reasonable attorney's fees. 18. FRY, granted to Plaintiff a security interest I n a 1990 Vol kswagen Passat, hereinafter called the "Vehicle". 8, By thu turmu of the Contract, Defendants agreed to pay to Plaintiff the !.Ium of Two Hundred Seventy-one Dollars and Sixty-six Cents ($271.66) per month, beginning April 18, 1994, and monthly thereafter for a period of Forty-eight (48) months. 9. purauant to the terms of the Contract, failure to make any payment on or before the date it is due constitutes a default. 10. 'rhe Dofendants defaulted under the Contract by failing to make the paymonta due and owing on September 18, 1995, and all monthly paymenta thereafter. II. On or about December 5, 1996, Plaintiff sent a Notice of Repoaaession of the Vehicle to the Defendants, advising Defendants of thu repossession of the Veh ic le, the dates and amount of default, their right to redeem and the amount required, and that the Vehicle would be sold at public auction if not redeemed. -2- , . 12. Defendants failed to take any timely action in accordance with said Notice of Repossession. 13. The Vehic Ie was sold at public sale on February 17, 1996, in Dauphin County, Pennsylvania 17018. 14. After sale of the Vehicle and application by Plaintiff of the proceeds of the sale of the Vehicle to the Loan, a deficiency balance in the amount of Seven Thousand Five Hundred Forty Dollars and Ninety-three Cents ($7,540.93), plus interest as stated in the Contract, remained due and owing on the Loan. IS. On or about February 26, 1996, Plaintiff notified the Defendants of the deficiency balance on the Loan and requested payment of same. 16. The Defendants have failed to make any payment to Plaintiff on account of the deficiency balance of the Loan. 17. Pursuant to the terms of the Contract, the Defendant is obligated to pay Plaintiff the deficiency balance on the Loan plus Fifteen (15\1 percent of the balance due as ~easonable attorney's fees. 18. The Plaintiff is DAUPHIN DEPOSIT BANK AND TRUST COMPANY, a Pennsylvania Banking Corporation with its principal place of business at 213 Market Street, Harrisburg, Pennsylvania 17105. 2. The Defendant, TYRONE BELL, is an adult individual whose last known address is 611-B Geneva Drive, Apartment 13, Mechanicsburg, Pennsylvania 17055. 3. The Defendant, DAVID W. FRY, is an adult individual whose last known address is 217 Seneca Street, Harrisburg, Pennsylvania 17110. 4. The Defendant, VIRGINIA M. FRY, is an adult individual whose last known address is 217 Seneca Street, Harrisburg, Pennsylvania, 17110. 5. On or about March 4, 1994, the Plaintiff advanced the sum of Ten Thousand Three Hundred Fifty-seven Dollars and Twenty-one Cents ($10,357.21) to the Defendants at an interest rate of Eleven and Fifty-five Hundredths percent (11.55%) per annum resulting in a ! inance charge of Two Thousand Six Hundred Eighty-two Dollars and Forty-seven Cents ($2,682.47) for a total repayment amount of Thirteen Thousand Thirty-nine Dollars and Sixty-eight Cents ($13,039.68), hereinafter called the "Loan". 6. As evidence of the Loan, Defendants, as co-makers, executed and delivered to plaintiff a Pennsylvania Motor Vehicle Installment Sale Contract dated March 4, 1994, by which Defendants promised to pay to Plaintiff the sum of Thirteen Thousand Thirty- nine Dollars and Sixty-eight Cents ($13,039.68), hereinafter called the "Contract". A copy of the Contract is attached hereto as Exhibit "A" and made part hereof. 7. As security for the Loan, the Defendants TYRONE BELL, WILLIAM W. FRY and VIRGINIA M. FRY, granted to Pldintiff a security interest in a 1990 Volkswagen Passat, hereinafter called the "Vehic Ie". 8. By the terms of the Contract, Defendants agreed to pay to Plaintiff the sum of Two Hundred Seventy-one Dollars and Sixty-six Cents ($271.66) per month, beginning April 18, 1994, and monthly thereafter for a period of Forty-eight (48) months. 9. Pursuant to the terms of the Contract, failure to make any payment on or before the date it is due constitutes a default. 10. The Defendants defaulted under the Contract by failing to make the payments due and owing on September 18, 1995, and all monthly payments thereafter. 11. On or about December 5, 1996, Plaintiff sent a Notice of Repossession of the Vehicle to the Defendants, advising Defendants of the repossession of the Vehicle, the dates and amount of default, their right to redeem and the amount required, and that the Vehicle would be sold at public auction if not redeemed. -2- 12. Defendants failed to take any timely action in accordance with said Notice of Repossession. 13. The Vehicle was sold at public sale on February 17, 1996, in Dauphin County, Pennsylvania 17018. 14. After sale of the Vehicle and application by Plaintiff of the proceeds of the sale of the Vehicle to the Loan, a deficiency balance in the amount of Seven Thousand Five Hundred Forty Dollars and Ninety-three Cents ($7,540.93), plus interest as stated in the Contract, remained due and owing on the Loan. 15. On or about February 26, 1996, plaintiff notified the Defendants of the deficiency balance on the Loan and requested payment of same. 16. The Defendants have failed to make any payment to Plaintiff on account of the deficiency balance of the Loan. 17. Pursuant to the terms of the Contract, the Defendant is obligated to pay Plaintiff the deficiency balance on the Loan plus Fifteen (15%) percent of the balance due as reasonable attorney's fees. 18.
