The parties own a property at 1142 Petersburg Road, Boiling Springs, PA, which has been appraised for $117,000.00. B. The parties own real estate located at 215-217 Pine Grove Road, Gardners, PA, which has been appraised for $79,500.00. C. There is a mortgage on the Petersburg Road property which had a balance of approximately $9,800.00 in March and a home equity loan that had a balance of approximately $5,300.00 at the same time. D. Mr. Snyder is employed with PPG and has worked there for 25 years. Ho has an accrued straight-life pension benefit as of March 1, 1996 in the amount of $667.33 per month. The pension benefit is payable May 1, 2015. E. Mr. Snyder has a PPG stock fund which had a value of approximately $51,000.00 as of March 31, 1996. F. Mr. Snyder believes his wife has a pension through her employment but is unsure of the value at this particular time. G. rhere are approximately 10 insurance policies, some owned by Mr. Snyder and some owned by Mrs. Snyder. Mr. Snyder was born on April 10, 1949 and Mrs. Snyder was born on April 9, 1950. Mr. Snyder's health is fine. 4 rhe parties possess some miscellaneous items of personal property which the parties may be able to work out a distribution of other than reliance upon the Master. This issue will need to be addressed prior to the Master's hearing. 5 Mr. Snyder does not plan on calling any expert witnesses at the hearing unless there is a dispute with respect to valuo of the real estate or a dispute with respect to value of the pension. 6 The 215-217 Pine Grove Road property is a rental property and the parties have listed that property for sale. SNYDER, plaintiff vs. IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NO. 96 - 2481 CIVIL MARK C. SNYDER, Defendant IN DIVORCE RE: Pre-Hearing Conference Memorandum DATE: Monday, January 27, 1997 Present for the Plaintiff, Linda K. Snyder, is attorney Marcus A. McKnight, III, and present for the Defendant, Mark C. snyder, is attorney Hubert X. Gilroy. A divorce complaint was filed on May 6, 1996, raising grounds for divorce of irretrievable breakdown of the marriage and indigniies. Counsel have advised that the parties will sign and file affidavits of consent prior to the hearing to be scheduled in these proceedings so that the divorce can be concluded under section 3301(C) of the Domestic Relations Code. The divorce complaint also raised the economic issue of equitable distribution. The motion for appointment of Master indicated that counsel fees and expenses were to be considered by the Master; however, no claims have been raised for counsel fees and expenses and counsel today have indicated they will probably not file any pleadings raising those issues. The parties were married on November 30, 1969, and separated February 24 or March 1, 1996. The date of separation is not terribly significant here in terms of whether it was February 24 or March 1, since the alleged dates of separation are so close in time. The parties are the natural parents of three children, Amy 23, Angela 20, and Kathleen 17. Husband is currently paying support for Kathleen pursuant to an agreement that the parties have worked out privately. Neither counsel was aware of the amount being paid and apparently the amount is not being paid through the Cumberland County Domestic Relations Office or pursuant to any court orders. Wife is 46 years of age and resides at 928 Forest Court, carlisle, Pennsylvania, with the minor child of the parties. Wife has a high school diploma and nurses training. She is an RN Assistant Director of Nursing at the Thornwald Home in Carlisle and has reported a net biweekly income of $1,108.40. Wife has not raised any health issues. Husband is 47 years of age and lives at 1142 . Petersburg Road, Boiling Springs, Pennsylvania, where he lives alone. Husband is a high school graduate and works for PPG as a leadman in shipping. His monthly net as reported on his pre-trial statement and income and expense statement is $2,024.00. Husband is also receiving rents from the property that the parties own at 215-217 Pine Grove Road, Gardners, Pennsylvania. He reports receiving rent in the amount of $612.00 per month; the Master has requested that he prepare an aocounting of the rental income and expenses that he has incurred pursuant to that property so we know whether or not there is a net rental income that he has been retaining or whether or not he is putting in other funds to keep the property going. Husband has not raised any health issues. The property at 215-217 Pine Grove Road is listed for sale and there may be an agreement for the sale of the property at $78,000.00. Counsel have noted a value of $79,500.00 for the property but we will, of course, use the sale price to represent the market value. If the property is sold before the hearing in these proceedings or the final resolution, COunsel can determine whether they want to make distribution of the proceeds between the parties or put the money in escrow. That property is free of any liens. Husband is living in the marital residence at 1142 Petersburg Road, Boiling Springs, Pennsylvania, and there have been three appraisals done of that property. The most recent appraisal is $120,000.00 by steve Barrett and counsel may be able to stipulate that that is the market value. That home is subject to a first mortgage and a home equity loan. Both payments total $700.00, each payment being around $350.00 per month. Husband has been making the payments on the mortgage and the home equity loan. Husband's counsel has indicated that hUsband would like to have the home awarded to him as part of the equitable distribution in this case. Although husband has indicated that at this time he would like to remain in the home he may have tu revaluate his position after he has all the financial data in this case leading toward a final resolution. Husband is a participant in a pension plan at PPG designated as a retirement portion and a PPG stock fund. The retirement portion is being valued by Harry Leister and that will be shared with Mr. Gilroy as soon as it has been received and reviewed by Mr. McKnight. The PPG ~tock fund as of March 31, 1996, had a value of $51,182.24. Wife is a participant in a pension program through . her employment and as reported on Mr. Mc~night's settlement memorandum statement, the tax sheltered annuity has a value of $2,369.81 and the 401(k) annuity a value of $18,566.32. Also listed on the pre-trial statements and on Mr. Mc~night's settlemont memorandum are various insurance policies owned by the parties and the cash values for each of the policies. Mr. Mc~night and Mr. Gilroy may be able to enter a stipulation at the time of the hearing as to the cash value of those policies so we can use those numbers in the equitable distribution computation. Hr. MCKnight has had the household tangible personal property appraised by Charles Spahr showing the value of the property in wife's possession at $768,00 and the value of the property in husband's possession at $8,452.00. The appraisal included a car in wife's possession which was valued at $200.00 (a 1978 Chrysler New Yorker) and a truck in husband's possession valued at $3,500.00 (a 1987 pickup truck). Mr. Gilroy has indicated that he is going to review the appraisal with his client and he may have another appraisal done on his client's behalf. There is some question as to whether or not husband sold off an item or more than one item of personalty and Mr. Mc~night is going to get that information for Mr. Gilroy. Mr. Mc~night mentioned a log spliter for example and we simply need to have those facts verified and if any property was sold by husband what the sale proceeds were for the property. There is also noted on the pre-trial settlement memorandum a stock account of PPG which Mr. Mc~night estimates at $10,000.00. The question is whether or not this stock is separate from the stock in the retirement stock fund. Mr. Mc~night has indicated that Mrs. snyder thinks the fund exists so perhaps Mr. Gilroy can assist in providing any documentation about this fund if it exists. If there is none then he can so advise Mr. McKnight. Counsel have indicated that aside from the mortgage on the marital home and the home equity equity loan, there is no marital debt. It appears as if after the factors are evaluated and the final numbers have been produced as to the value of the assets, that the issue will be the percentage of distribution for each of the parties. Mr. McKnight has advanced a suggestion that the distribution should be 60/40 in favor of wife and Mr. Gilroy has indicated that he believes the distribution should be (2) il fully and completely informed of the facts relating to the lubject matter of this Agreement and of the rights and liabilities of the parties; (3) enters into this Agreement voluntarily after receiving the advice of counsel; (4) has given careful and mature thought to the making of this Agreement; (5) has carllfully rend euch provision of this Agreement; and (6) fully and completely understands each provision of this Agreement, both as to the lubject matter and legal effect. This Agreement shall becolTle effective immediately as of the date of execution. 5. It is the purpose and intent of this Agreement to settle forever and completely the interest and obligations of the parties in all property that they own separately, and all property that would quality as marital property under the Pennsylvania Divorce Code, Title 23, Section 401(e), and that is referred to in this Agreement as "Marital Property", as between themselves, their heirs and assigns. The parties have attempted to divide their Marital Property in a manner that conforms to a just and fair standard, with due regard to the rights of each Party. The division of existing Marital Property is not intended by the parties to constitute in any way a sale or exchange of assets, and the division is being effected without the introduction of outside funds or other property not constituting a part of the marital estate, except for the loan secured by Husband to complete his obligations established by this Agreement. It is the further purpose of this Agreement to settle forever and completely any obligation under the Pennsylvania Divorce Code relating to spousal support or alimony. 3 6. Each party represenu and warrants that he or she has made a full and fair disclosure to the other of all of his or her property interests of any nature, including any mortgage, pledge, lien, charge, security interest, encumbrance, or restriction to which any property is subject. Each party further represents that he or she has made a full and fair disclosure of all debts and obligations of any nature for which he or she is currently liable or may become liable. Each further represents and warrants that he or she has not made any gifts or transfers for inadequate consideration of Marital Property without the prior consent of the other. Each Party acknowledges that, to the extent desired, he or she has had access to all joint and separate State and Federal Tax Reiums filed by or on behalf of either or both Parties during marriage. 7. REAL ESTATE: HUSBAND agrees to transfer to WIFE all right, title and interest which he may have in the real estate known as the Toland property situate in Dickinson Township, Cumberland County, Pennsylvania. All rents due on the Toland property on March 1, 1997, plus any security deposits will be paid to WIFE by HUSBAND. WIFE agrees to convey all right, title and interest which she may have in the real estate known as 1142 Petersburg Road, South Middleton Township, Cumberland County, Pennsylvania. In addition, HUSBAND agrees to refinance the joint mortgages into his own name and pay to WIFE the sum of Seventy Six Thousand and no/100 ($76,000.00) Dollars 8. ~PPORT: It is tre mutual desire of the parties that HUSBAND will not be required to pay support to the WIFE. WIFE will not provide any financial support to the HUSBAND. The 4 10. AUTOMOBILES: a.) WIFE agrees to waive any and all interest which she may have in the 1987 Dodge Pickup Truck to HUSBAND. b.) HUSBAND agrees to waive any and all interest which he may have in the 1982 Chrysler New Yorker to WIFE. They each waive any claim which they hav~ in any automobiles owned by the other party. 11. MARITAL DEBTS: Each party will be responsible for their own debts incurred after the date of separation. HUSBAND has assumed responsibility for the Mortgage and the Home Equity Loan with PNC Bank. HUSBAND agrees to hold harmless WIFE from all responsibility for said loans. 12. INSURANCE AND EMPLOYEE BENEFITS The parties agree that any life insurance policies on the life of HUSBAND or WIFE or any other employee benefits, including but not limited to retirement, profit sharing or medical benefits of either party, shall be their own. WIFE waives all right, title and claim to HUSBA..ND's employee benefits, and HUSBAND waives all right, title, and claim to any of WIFE'S employee benefits. Il BENEFITS AND BANK ACCOUNTS: WIFE agrees to waive all right, title and interest which she may have in the savings or checking or any other bank accounts of the HUSBAND. The HUSBAND agrees to waive all interest which he has in the bank accounts of the WIFE. 6 14. DIVORCE: The parties both agree to cooperate with each other in obtaining a final divorce of the marriage. It is as reed that the parties will execute and file the consents necessary to obtain the divorce. Any party who fails to cooperate with obtaining the Divorce shall pay all the costs and lesal fees of the party who is seeking the divorce. 15. BREACH: If either party breaches any provisions of this Asreement, the other party shall have the right, at his or her election, to sue lor damages for such breach or seek such other remedies or relief as may be available to him or her, and the party breaching this contract should be responsible for payment of legal fees and costs incurred by the other in enforcing their rights under this Agreement. 16. ADDITIONAL INSTRUMENTS: Each of the parties shall from time to time, at the request of the other, execute, acknowledge and deliver to the other party any and all further instruments that may be reasonably required to give full force and effect to the provisions of this Agreement. 17.
