MAURIAGE SE1"1'LEMENT AGUEEMENT
TIllS AGUEEMENT is made and entered into between Mlchuellh
BufflnAton and Linda M. BuffinAton, hereinafter referred to as Husband and
Wife. The parties were married in Februury 1992,
As a consequence of disputes and unhappy differences. the parties have
separated, The parties desire to confinn their separation and make arrangements in
connection therewith. including the setUement of their property rights, and all other
rights and obligations arising out of the marriage relationship.
It is therefore agreed:
I. CONSIDER A TION
The consideration for this Agreement is the mutual promises and agreements
herein contained.
~. SEPARATION AND NONINTEUI'ERENCE
A. It will be lawful for each party at all times hereafter to live separate and
apart from the other party at such place or places as he or she may from time to time
choose or deem fi t.
B, Each party shall be free from intetference, authority and control, direct
or indirect. by the other, as fully as if he or she were single and unmarried. NeiUler
shall bother the other or compel or endeavor to compel the other to cohabit or dwell
with him or her.
3. MUTUAL REI.EASE
Subject to the provisions of this Agreement. each PaJ1Yo~ ~e and

discharged and by this Agreement does for himself or herselr. and his or her heirs,
legal representatives. executors, administrators and assigns release and discharge the
other from all causes of action. claims, rights or demands whatsoever, in law or
equity. which either of the parties ever had or now has against the other, except any
or all cause or causes of action for divorce.
4, FULL mSCLOSUlm
The provisions of this Agreement and their legal effect are fully understood
by each party of this agreement. and each party acknowledges that the Agreement is
fair and equitable, that it is being entered into voluntarily, and that it is not the result
of any duress or undue influence, Husband and wife each represent and warrnntto
the other that he or she has made a full and complete disclosure to the other of all
assets of any nature whatsoever and of all other facts relating to the subject matter of
this Agreement Both parties represent that the terms of this Agreement have been
fully explained to them by their respective counselor that both parties have had the
opportunity to have legal counsel review and fully explain the tenns of this
Agreement. Husband is represented by Darrell C. Dethlefs, Esquire. Wife is
represented by Samuel L. Andes, Esquire.
5. EOUlTABLE DIVISION
By this Agreement,the parties have intended to effect an equitable division
of their marital property. This division is not intended by the parties to constitute in
any way a sale or exchange of assets.
6. SUnSEOUENT DIVORCE
A. AGREEMENT NOT PREDICATED ON mVORCE - It is
specifically understood and agreed by and between the parties hereto and each of the
said parties does hereby warrant and represent to the other that the execution and
delivery of this Agreement is not predicated upon nor made subject to any agreement
for institution, prosecution, defense, or for the non - prosecution or non - defense of
any action for divorce; provided, however. that nothing contained in this Agreement
shall prevent or preclude either of the parties hereto from commencing, instituting or
prosecuting any action or actions for divorce upon just, legal and proper grounds; nor
to pr41vent either party from defending any such action which has been. may, or shall
be instituted by the other party, or from making any just or p~r defense thereto. It
is warranted, covenanted and represented by Husband and Wife, each to the other,
that this Agreement is lawful and enforceable and this warranty, covenant and
representation is made for the specific purpose of inducing Husband and Wife to

execute this Agreement. Husband and Wife each knowingly and understandingly
hereby waive any and all possible claims that this A~reement is, for any reason,
illegal or for any reason whatsoever, unenforceable 10 whole or in part. Husband and
Wife each do hereby warrant. covenant and agree that, in any possible event, he and
she arc and shall forever be stopped ftum asserting any illegality or unenforceability
as to all or any part of this Agreement.
8, f'.NTRY AS PART OF nECREE . It is the intention of the parties that the
Agreement shall survive any action for divorce which may be institutedor prosecuted
by either party and no order, judgment or decree of divorce, temporary, final or
permanent, shall affect or modify the fUlancial tenns of this Agreement. TIlis
Agreement shall be incorporated in but shall not merge into any such judgment or
decree of final divorce, but shall be incorporated for the purpose of enforcement only.
C. MUTUAL CONSENT mVORCE . The parties a~ree and acknowledge that
their marriage is irrenicvnbly broken. that they do not deSire marital counseling, and
that they both consent to the entry of a decree in divorce pursuant to 23 Pn. C.S.A.
Section 3301(c). Accordingly, both parties agree to forthwith execute such consents,
affidavits, or other documents as may be necessary to promptly proceed to obtain a
divorce pursuant to said 23 Po. C,S.A. Section 3301(c), Upon request, the extent
permitted by law and the applicable Rules of Civil Procedure, the named Defendant in
such divorce action shall execute any waivers of notice or other waivers necessary to
expedite such divorce.
7. mVISION OF PERSONAL PROPERTY
Wife agrees that all of the property in the possession of Husband as of
October I, 1998. shall be the sole property and separate property of Husband and
Husband agrees that all property in the possession of Wife as of October I, 1998
shall be the sole and separate property of Wife. The parties do hereby specifically
waive, release, renounce and forever abandon whatever claims, if any, he or she may
have with respect to the above items which shall become the sole and separate
property of the other.
II. MARITAL RESIDENCE
Husband and Wife agree that the Marital Residence located at 3424 Walnut
Street, Camp Hill, Pennsylvania shall be refinanced by Husband. Title is to be
placed solely in the name of Husband. In return. wife shall execute the deed to said
property deeding the same solely to Husband.

C. SEVERABILITY - If any term, condition, clause or provi5ion of this
Agreement shall be determined or declared to be void or invalid in law or otherwise,
then only that term, condition, clause or provision shall be stricken from this
Agreement and in all other resp'ccts this Agreement shall be valid and continue in ful1
force, effect and operation. Likewise, the failure of any party to meet his or her
obligations under anyone or more of the paragraphs herein, with the exception of the
satisfaction of the conditions precedent, shall in no way void or alter the remaining
obligations of the parties,

D. OTIIER DOCUMENT A TION - Wife and Husband covenant and
agree that they will forthwith execute any and all written assignments, releases,
satisfactions, deeds, notes or such other writings as may be necessary or desirable for
the proper effectuation of this agreement, and as their respective counsel shall
mutually agree should be so executed in order to carry out ful1y and effectively the
terms of Jtis Agreement.
E. ENTIRE AGREEMENT. This Agreement contains the entire
understanding of the parties, and there are no representations, warranties, covenants
or undertakings other than those expressly set forth herein,
F. WAIVER OR MODIFICATION TO BE IN WRITING - No
modification or waiver any of the terms hereof shall be valid unless in writing and
signed by both parties and no waiver of any breach hereof or default hereunder shall
be deemed a waiver of any subsequent default of the same or similar nature.
G. MUTUAL COOPERATION - Each party shall at any time and from
time to time hereafter take any and all steps and execute, acknowledge and deliver to
the other party any and all further instruments and/or documents that the other party
may reasonably require for the purpose of giving full force and effect 10 the
provisions of this Agreement.
H. LAW GOVERNING - This Agreement shall be construed and
governed in accordance with the laws of the Commonwealth of Pennsylvania.
I. DlNDING EI'FECT - Except as otherwise stated herein, this
Agreement shall be binding and shall inure to the benefit of the parties hereto and their
respective heirs, executors, administrators, successors and assigns.
J. NO WAIVER OR DEFAULT - This Agreement shall remain in ful1
force and effect unless and untillerminated under and pursuant to the terms of this
Agreement. The failure of either party to insist upon strict performance of any of the

1. A Complaint in Divorce under Section 3301 (cl of the DivNce Code was filed on
7 :-lay 1996 and was served upon the Defendant on or about 10Jun,) 1996
2. The marriage of Plaintiff and Defendant is irretrievably broken and ninety (90)
days have elapsed from the date of filing of the complaint and the date of service of the
complaint on the Defendant.
3, I consent to the entry of a final decree in divorce either after service of a Notice of
Intention to Request Entry of the Decree or upon filing of my Waiver of the Notice of
Intention to Request Entry of the Decree,
4, I have been advised of the availability of marriage counseling and ullderstand that
the Court maintains a list of marriage counselors and that I may request the Court to require
my spouse and I to partlcipete In counseling and, being so advised, do not request that the
Court require that my spouse and I particlpato in counseling prior to the divorce becomlllg
final,
I verify that the statements made in this Affidavit are true and correct and I
understand that false statements herein are made subject to the penalties of 18 Pa. C.S,

dated August 5, 1997, the full-time Master has been appointed in
the above referenced divorce proceedings,
A divorce complaint was filed on May 7, 1996, raising
grounds for divorce of irretrievable breakdown of the marriage,
indignities, and the economic claim of equitable distribution,
Although attorney Dethlefs filed the motion for
appointment of Master, Maria Cognetti is still counsel of record
and has not withdrawn her appearance nor has Mr, Dethlefs
entered his appearance,
Linda M, BUffington, as far as I can determine from the
file, is now representing herself,
I am going to proceed on the basis that the parties will
agree to a divorce by the signing of affidavits of consent or,
in the alternative, have been separated for a period in excess
of two years, Based on that assumption, I am directing Ms,
Cognetti and Ms. Buffington to each file a pre-trial statement
in accordance with P,R,C,P. 1920,33(b) on or before Monday,
September 8, 1997. Upon receipt of the pre-trial statements I

Dear Mr. Dethlefs and Mr. Andes:
I am writing in response to Mr, Dethlefs' letter of
January 19, 1998, The only attorney of record in this action is
Maria P. cognetti and I cannot assume that either counsel above
named are representing either of the parties because no one has
entered an appearance nor has Maria p, Cognetti withdrawn her
appearance,
I did issue a directive for the filing of pre-trial
statements by letter of August 11, 1997, and received nothing
from any counsel,
It is not my usual practice to proceed with a case until
I know who is representing the parties. In this case neither
counsel to whom this letter is addressed have entered an
appearance nor has Maria P. cognetti withdrawn her appearance.
Mr, Dethlefs did file the motion for appointment of
Master but Ms, cognetti is still counsel of record.
I am going to issue a directive for the filing of
pre-trial statements in accordance with P,R,C,P. 1920,33(b).
Each counsel of record is directed to file a pre-trial statement
on or before Friday, February 20, 1998, Upon receipt of the
pre-trial statements, and assuming that the parties are
represented by counsel of record, I will schedule a pre-hearing

Present for the Plaintiff, Michael L, Buffington,
is attorney Darrell C, Dethlefs, and present for the Defendant,
Linda M, BUffington, is attorney Samuel L, Andes,
A divorce complaint was filed on May 7, 1996,
raising grounds for divorce of irretrievable breakdown of the
marriage and the economic claim of equitable distribution.
Counsel have advised that the parties will sign and file
affidavits of consent and waivers of notice of intention to
request entry of divorce decree prior to the hearing, The only
economic claim before the Master is the claim of equitable
distribution,
The parties were married on February 1, 1992, and
separated March 8, 1996, They are the natural parents of a son,
Mitchell, born May 20, 1993.
Husband is 35 years of age and resides at 3424
Walnut Street, Camp Hill, Pennsylvania, where he lives with the
son during his periods of custody, He is currently a Loan
originator with Corestates Mortgage Services Corporation, His
1996 income tax return showed gross earnings of $29,400,00.
During the support proceedings recently held, Judge Hess
computed his net monthly income to be $1,805,00, Husband has
not raised any health issues with the exception of a sexually
transmitted disease which he claims wife has given him,
Wife is 32 years of age and resides at 120 Linden
Drive, Apartment 3-A, Camp Hill, Pennsylvania, She lives with
the son during her periods of custody and Mr, Dethlefs indicated
also that she is living with a boyfriend, Mr, Andes has not
confirmed that that information is accruate, wife is a
waitress/bartender at Kokomos and at the support hearing, Judge
Hess computed her net monthly income to be $1,387,00, Wife has
not raised any health issues, wife currently is receiving her
medical insurance coverage through husband's employment.
Husband is currently paying his employer $91,00 per month for
the family plan for medical insurance coverage, lie is also
paying $60,00 per week as child support,
The parties own real estate at 3424 Walnut street,
Camp Hill, Pennsylvania, which husband would like to have
awarded to him in these proceedings, lie is currently in
possession of the property and is paying the mortgage to
Pennsylvania state Employees' Credit Union in the amount of
$908,56 per month. The payment is high because as counsel have
stated the payout is over 10 years as a result of the use of a
home equity loan, The balance due on the mortgage is around
$70,000,00, On May 5, 1997, husband had the house appraised for
$86,500,00. Both counsel indicated they may wish to have
another appraisal done to establish market value,
At the time of separation, the parties owned a 1989
Cadillac automobile and a 1987 Buick Park Avenue. On June 12,
1996, the Buick was traded in by wife and she received
$2,997,00. Recently the Cadillac was traded in by husband and
he received $500,00, However, the Master has indicated that he
will use the value of the Cadillac as of June 12, 1996, the date
that the trade in was accomplished on the Buick Park Avenue,
Husband has suggested the value of the Cadillac, prior to trade
in, at separation, was $2,000,00, Wife has not suggested a
value for the Cadillac,
At the time of separation wife took some items of
household tangible personal property leaving the rest in the
home where husband resides, Wife is going to provide a list of
items which she took and also a list of items which she would
like to have turned over to her possession, After discussion it
was determined that the property in the possession of both
parties should be appraised,
Husband is a participant in a 401(k) plan and the
value at separation was $8,932.79. Prior to the marriage
husband was involved in the 401(k) plan and counsel are going to
provide the date of marriage balance in the plan and the date of
separation balance and then counsel can update the present value
by using an interest factor from the date of separation to the
date of hearing,
lIusband states that at separation wife took $500,00
from the checking account. Mr, Andes says that he is not aware
that w:fe recoived the funds or what happened to the funds.
The parties sold the 1975 Brady White boat which
they had during the marriage and husband is currently holding
the sale price of $500.00. Counsel have diocussed the
