Rollings and Defendant Richard W. Rollings. WITNESSETH: WHEREAS, the plaintiff in thc above-captioned matter is Regina L. Rollings (hereinafter referred to as "Mother"), an adult individual who currently resides at 4129 Mountain View Road, Mechanicsburg, cumberland county, Pennsylvania, 17055. WHEREAS, the defendant in the above-captioned matter is Richard W. Rollings (hereinafter referred to as "father"), an adult individual who currently resides at 5009 Muirfield Place, Mechanicsburg, cumberland county, Pennsylvania, 17055. WHEREAS, the parties hereto are husband and wife but have lived separate and apart since April 18, 1996. WHEREAS, the parties believe it is in the best interests of their children to resolve the custody action now pending at the above term and number without the need for litigation. NOW, THEREfORE, in consideration of these premises and the mutual promises, covenants and undertakings set forth herein and for other good and valuable consideration, the sufficiency of which is hereby acknowledged by each of the parties hereto, and each of the parties intending to be legally bound hereby, Mother and Father stipulate and agree as follows: 1. Leqal Custodv. It is the intention of the parties, and the parties agree, that they will share legal custody of their three minor children. The parties agree that major decisions concerning their children, including, but not necessarily limited to, the children's health, welfare, education, religious training and upbringing shall be made by them jointly, after discussion and consultation with each other, with a view toward obtaining and following a harmonious policy in the children's best interests. Each party agrees not to impair the other party's right to share legal custody of the children. Each party &grees not to attempt to alienate the affections of the children from the other party nor to permit any third party to attempt to so alienate the affections of the children from the other party. Each party shall notify the other of any activity or circumstance concerning their children which could reasonably be expected to be of concern to the other. Day-to-day decisions shall be the responsibility of the parent then having physical 2 custody. with regard to any emergency decisions which must be made, the parent then having physical custody of the child or children at the time of the emergency shall be permitted to maKe any immediate decisions necessitated thereby. However, that parent shall inform the other of the emergency and consult with him or her as soon as possible. If either party goes out-of- town, that party will leave a number where he or she can be reached in an emergency. Each party shall be entitled to complete and full information from any doctor, dentist, teacher, therapist, professional or authority and to have copies of any reports given to either party as a parent. 2. phvsical Gustodv. It is the intention of the parties, and the parties agree, that they will share physical custody of their children with Mother being the primary physical custodian of Reannon and Rochelle, subject to father's rights of partial physical custody as set forth herein, and Father being the primary physical custodian of Richard, subject to Mother's rights of partial physical custody as oet forth herein. (a) Livinq Arranqements. Mother and father do not wish to establish a fixed schedule regarding the physical custody of their children at this time. Instead, the parties believe that it is in the children's best interests to maintain the flexible schedule that they now have. It is understood by the parties that the exact period of physical custody must necessarily be the subject of periodic negotiation between them. The parties agree to consult as necessary and to cooperate in ) scheduling custodial periods, taking into account the respective schedules of the parties and the children. (b) Holidavs. Notwithstanding the foregoing, it is the intention of the parties, and the parties agree, that custody of the children will alternate between them on holidays such that in any two (2) year period the children will spend each such holiday with each of their parents. (c) Summer. During the children's summer vacation from school, father shall be entitled to up to two (2) full weeks, consecutive or non-consecutive at father's choice, of partial physical custody of his minor daughters for the purpose of a summer vacation. Mother shall be entitled to up to two (2) full weeks, consecutive or non-consecutive at Mother's choice, of partial physical custody of Richard for the purpose of a summer vacation. 3. General provisions. (a) Telenhone contact. Each parent shall be entitled to reasonable telephone contact with any child when he or she is in the custody of the other parent. (b) Mutual Cooperation. The parties agree to be flexible in schedUling to accommodate the needs of the other parent and the children and shall grant each other make-up time for deviation in schedUling. 4. Aareed-Upon Order. The parties agree that this stipulation shall be submitted to the Court with a request that its terms be entered as an enforceable order. 4 ......
