(See property description attached). Removal of accumulations of unsanitary waste, garbage, rubbish; mowing of high weeds & grass: $591.10 Ten pement penalty (10%): $59.11 Attorney's fees $90.00 TOTAL $740.20 Together with interest sec. leg. from June 17, 2002, the date of completion of the removal and mowing. Prior notice in accordance with law was served on the owner at the above address by certified mail on June 4, 2002, which was returned "unclaimed" by the postal authorities, and by posting the property on June 10, 2002. The said mowing and removal of unsanitary waste were provided by Dickinson Township and the charge levied therefor is in strict accordance with the Second Class Township Code. Edward L. Schorpp, l~squire" Dickinson Township Solicitor Ten East High Street Carlisle, PA 17013-3093 (717) 243-3341 BETWEEN, JEAN SIMS, as Executrix oft_he Estate of CARL SIMS, JR., deceased, late of Dickinson Township, Cumberland County, Pennsylvania, herein designated as the Grantor; AND CARL SIMS, HI, a single man of Carlisle, Cumberland County, Pennsylvania, herein designated as the Grantee; WHEREAS, Carl Sims, Jr., died testate, seized of the hereinafter described premises on December 24, 1999; and WHEREAS, Letters Testamentary were granted to Jean Sims on January 11, 2000 and indexed in the Cumberland County Register of Wills Office to NO. 2100-0030; and WHEREAS, under the Last Will and Testament of Carl Sims, Ir., dated January 30, 1996, in paragraph Sixth, he devised his real estate unto his son, Carl Sims, IH, per stirpes; and NOW THEREFORE, the Executrix conveys the herein described tract of land as follows; ALL THAT CERTAIN tract of land together with the improvement thereon erected situate in Dickinson Township, Cumberland County, Pennsylvania, numbered and described in accordance with Plan of "Pleasant View" recorded in the hereinafter named Recurder's Office in Plan Book 4, Page 60, as follows; BEGINNING at a point on the southern right-of-way in line of S0 feet wide Pennsylvania Route 33, known as Walnut Bottom Road, which point is at the dividing line between Lots Nos. 3 and 4 as shown on said Plan; thence from said point at the Place of Beginning along said dividing line between said Lots Nos. 3 and 4, South 28 degrees 30 minutes East a distance of 200 feet to a point in line of land now or formerly of G.W. Weitzel; thence along line of said land now or formerly of G.W. Weitzel, South 61 degrees 30 minutes West a distance of 200 feet to a poim at the dividing line between Lots Nos. 7 and 8 as shown on said Plan; theace along said dividing line between said Lots Nos. 7 and 8, North 28 degrees 30 minutes West a distance of 200 feet to a point on the southern right-of-way line of said 50 feet wide Pennsylvania Route 33, known as Walnut Bottom Road; thence along the southern right-of-way line of said 50 feet wide Walnut Bottom Road, North 61 degrees 30 minutes East a distance of 200 feet to a point at the dividing line between Lots Nos. 3 and 4 at the Place of BEGINNING. BEING all of Lots Nos. 4, 5, 6 and 7 as shown on said Plan of"Pleasant View" recorded as aforesaid. THE ABOVE described tract of land is subject to the building set-back line shown on said Plan of 75 feet from the southern line of said 50 feet wide Walnut Bottom Road. THE ABOVE described tract of land is subject to a mortgage to USDA Rural Housing Service dated May 30, 1990 and recorded in the Recorder of Deeds Office of Cumberland County in Mortgage Book 978 Page 902. BEING the same property which Robert George Frey and Debra L, Frey, husband and wife, by deed dated May 17, 1990 and Recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 34, Volume "O", Page 1074, granted and conveyed to Carl Sims, Yr., AND the Grantor, in her capacity as aforesaid, covenant that she had not done or committed any act, matter or thing whatsoever whereby the premises hereby granted and conveyed or any part thereot~ is, are or shall be impeached, charged or encumbered in title, charge, estates or otherwise.
