LIMITED RELEASE LIMITED RELEASE made as of the 61h day of November, 1997. by and belween, Lower Allen Township AUlhority, a municipal aUlhorilY, having its principal place of business at 120 Limekiln Road, New Cumberland, Pennsylvania 17070 (" Authori!}'") and James A, Glessner, of 1215 Scenery Drive, Mechanicsburg, Pennsylvania 170S5 ("Glessner"), WITNESSETH: WHEREAS, on March 27, 1996, James A, Glessner and Colene M. Serrano, his wife, entered iOlo an Agreement 10 pay lapping fee and related costs In Installments with Lower Allen Township Authority; and WHEREAS. on May 10, 1996, a municipal claim for a lapping fee in the amount of $6,157.20 was filed In the Court of Common Pleas of Cumberland Coun!}', Pennsylvania, in the case of Lower Allen Township Authority v. James A, Glessner and Colette M, Serrano, hls wife, to No. 96-2601 MLD 1996, with respect to the propeny at 1521 Grandview Avenue, Mechanlcsburg, Pennsylvania; and WHEREAS, James A. Glessner and Colene M, Serrano, his wife, have divorced and under Paragraph 5 of their Senlement Agreement, Colene M. Serrano retained ownership of the property at 1521 Grandview Avenue, Mechanicsburg, Pennsylvania, and agreed to pay the aforesaid munlclp~1 clnlm and r~lIeving James A. A description of the property against which this claim is filed is as follows: All that certain tract of land situate in Lower Allen Township, Cumberland county, Pennsylvania, known as 1521 GrandviewAvenue, Mechanicsburg, Pennsylvania 17055, and more particularly bounded and described in Cumberland county Deed Book 131-745, et seq. 4. The Authority under and by virtue of which the tapping fee was levied and the work done is as follows: The Municipal Authorities Act enacted May 2, 1945, P.L. 382, as amen1ed; Lower Allen Township Authority Resolution No. 95-A-15, adopted August 3, 1995, and Resolution No. 95-A-17, adopted october 5, 1995. 5. The Authority constructed a sewer extension consisting, inter AliA, of collection and transportation facilities including pump station and related and necessary facilities in the Lisburn Sewer service Area and completed the same on or about February 1, 1996. 6. Notice of the Tapping Fee Bill for the same, together with notice of intention to file this lien, if the bill was not paid, was duly given on March 27, 1996, by the said Authority to said Owner or reputed Owners who have failed to pay the same. 7.
