5. When Plaintiff appeared on the project, It bacame appersnt that the
projact involved an area In excess of 60 square yards as originally contemplated by
the contract.
6, The agants, employees, or representatives of Defendant requested and
authorized Plaintiff to rapelr an additional portion of the parking lot, sold eddltlonal
portion to be approximately 5' square yards.
7, The agents, employees, or representetlves of Defendant promised to pay
Plaintiff for the axtra work for ths same price per square yard as contained in the
original contract,
B, Plaintiff completed the additional work In accordance with Dsfendant's
rsquest,
9, All work performed by Plaintiff wes dons In a good and workmanlike
manner and Plaintiff hes received no complelnts from Dafendant es to tho quality or
condition of the work porformsd,
, 0, Plaintiff sent Defendant an Invoice for the total of the work performed
on Defendant's parking lot, said Invoice Is attached hereto and marked as Exhibit B,
The total cost for the work performed by Plaintiff was $5,757.00.
, ,. Defendant paid Plaintiff a total of $3,420,00 towards the outstanding
amount owed,

1 2, Despite repeated requests by Plelntiff for payment of the remainder of
the work performed on the project, Defandant hes failed or refused to make such
payment,
13. Defendent has breached the agreement with Plaintiff by Its failure to pay
for the work authorized by Defendant on Its parking lot.
14. Plaintiff has boen dameged In the amount of $2,307,00 which
represents the outstanding balance due for the work performed on the Defendant's
parking lot.
15. Plaintiff Is entitled to a delinquency charge, In eccordance with Its
Invoice submitted to Defendant, in the amount of 1 1/4% per month for all
outstanding balances due over thirty (30) days,
WHEREFORE, Plaintiff demands judgmant against Defendant In the amount
of $2,307,00, plus Interest at the rate of one and ons.quarter (1 1/4%) percsnt psr
month for all outstanding Invoices dus over thirty (30) days, plus costs of suit,
