HomeMy WebLinkAbout02-4625STIPULATION AGAINST LIENS THIS AGREEMENT, made the ~/{-/~ ' day of September, 2002, by and between JARLIN HOMES, 1NC. 535 W. High Street, Hummelstown, PA hereinafter referred to as Contractor, AND JOHN E. COHICK, JR., 2433 Lamb's Gap Road, Enola, PA 17025 hereinafter referred to as Owner, Whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in Hampden Township, Cumberland County, Pennsylvania as more fully described in Cumberland County Deed Book 1-31, Page 35 and containing 11 acres, more or less. Being further identified as Tax Parcel NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ONE DOLLAR ($1.00) to him in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above-described, and the said Contractor, for themselves, their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. B. Leiby, thence North 19 degrees West, 1,133.55 feet to a hickory; thence by North Mountain, 82 degrees East, 504.9 feet to a black oak; thence by the lands formerly of Nicholas Redsecker, deceased, South 12 degrees 45 minutes East, 1,192.95 feet to a white walnut; thence by the lands now or formerly of E. B. Leiby, North 87 degrees 30 minutes West, 396 feet to the place of BEGINNING. CONTAINING 11 acres, more or less, and the usual allowances for roads. Tax Parcel No. 10-11-3016-023A
