COMPLAINT
I, Simon J. Rogers, am the plaintiff and landlord of 218 East Main Street, Apartment A,
Mechanicsburg, PA 17055, a residential property.
Selina A. Cooper and Luz Z. Martir are the defendants and former tenants at 218 East Main Street,
Apartment A, Mechanicsburg, PA 17055, a residential property.
The defendants signed a one year lease for the above referenced property on 9/03/2001 and
subsequently occupied the premises.
The defendants failed to pay the agreed upon rent of $650.00 per month for the last two months of
their lease and occupation of said property, July and August, 2002.
The Plaintiff posted late notices for past due rent on the front door of the apartment in addition to
posting a Notice To Quit in accordance with the law.
The plaintiff filed a Landlord And Tenant Complaint on 8/19/2002 for past due rent, late fees,
court costs and possession of said property with Cumberland County District Court 09-3-05
located at 507 North York Street, Mechanicsburg, PA 17055, District Justice Honorable Gayle A.
Elder, Docket No: LT-0000244-02.
A hearing was set for 8/27/2002 at 10:30 AM.
Simon J. Rogers, Plaintiff, and Selina A. Cooper, Defendant, set forth their positions to District
Justice Elder at the hearing.
Dated:
District Justice Elder ruled in favor of the Plaintiff for the two months of unpaid rent, $1,300.00, a
$25.00 late fee per month as set forth in the lease for non payment of rent by the 5th of the month,
$50.00, late penalties of 10% of the rent past due per guidelines used by the Supreme Court,
$130.00 and court costs, $88.50, for a total of $1,568.50 in addition to granting the Plaintiff
possession of his property.
