DEFINITIONS AND INSTRUCTIONS
1. The term "Defendant", unless otherwise indicated by the
context of an Interrogatory, means DONALD R. BRODERICK, t/d/b/a
SUPERIOR HOMES, or any predecessor thereof, and servants, agents,
employees, and authorized representatives of said Defendant.
2. The terms "document" unless otherwise indicated by the
context of an Interrogatory, means, without limitation, the
following items, whether printed or recorded or reproduced by
mechanical, electromechanical, electronic, or similar processes or
written or produced by hand: agreements, communications,
correspondence, telegrams, memoranda, summaries of records of
telephone conversat ions, summaries or records of personal
conversations, summaries or records of interviews, diarys, graphs,
reports, notebooks, notecharts, summaries or records of meetings or
conferences, accountings or books of account, statistical
compilations, any and all applications, reports, or other
submissions made to any governmental or regulatory body, any
technical reports prepared or compiled by Defendant, any marginal
comments appearing upon any document, and any and all other
writings.

3. When asked to identify an individual person, state for
that person the full name, present or last known address, present
or last known employer or business affiliation, office or position
held with that last known employer or business affiliation, and the
address or locat ion of the present or last known employer or
business affiliation. and any telephone numbers known by Defendant
at which said individual person can be contacted.
4. These Interrogatories are addressed to Defendant as a
party to this action, and its answers shall be based upon the
information known to it, or to its attorneys, insurers, servants,
agents, employees, or representatives,
5. These Interrogatories shall be deemed to be continuing
Interrogatories. Defendant shall be required to supplement its
answers to these Interrogatories in the event that Defendant or
anyone acting on behalf of Defendant acquires additional or
supplemental information not previously provided in the original
answers to these Interrogatories.

5. State whether Defendant carries, maintains, or is insured
under any insuring agreement under which any person carrying on an
insurance business may be liable to satisfy part or all of a
judgment which may be entered in this action or to indemnify or
reimburse Defendant for payments made to satisfy such judgment. If
so, identify the insurer; state the limits of the insurance
coverage; and state whether the insurer has asserted any denial of
coverage, exclusionary clause, or has issued any reservation of
rights letter with regard to the claims presented by Plaintiffs
herein. This Interrogatory shall extend to both primary and excess
coverage.

Defendant or its insurers, concerning the investigation of this
action or its subject matter, with the exception of matters
specifically excluded from discovery pursuant to the Pennsylvania
Rules of Civil Procedure.
3. If not previously supplied, the entire investigative file
and all incident reports concerning this action or its
subject matter of the Defendant and their representatives or
insurers.
4. Any and all written reports of experts whom Defendant

PLAINTIFFS' MOTION TO COMPEL DISCOVERY
1. This action was commenced by Complaint filed on May 14,
1996,
2. Pleadings in the matter were closed with the filing of
Plaintiffs' Reply to New Matter under cover of letter dated March
lB, 1997.
3, Since that date, Plaintiffs have sought discovery from
the defense, both informally, and with formal filing of
Interrogatories and Requests for Production of Documents,
4. Defendant has failed to produce any of the discovery
information requested by Plaintiff, eithsr informally or formally,
5. On or about Novembsr 11, 1997, counsel for Plaintiffs
served upon counsel for Defendant, Plaintiffs' Interrogatories to
Defendant First Set, a true copy of which Interrogatories are
attached hereto as Exhibit A.

Defendant.

The documents included in this request are as follows:

party or a witness to this action.

files, or other documents prepared by, for, or on behalf of
Defendant or its insurers, concerning the investigation of this
action or its subject matter, with the exception of matters
specifically excluded from discovery pursuant to the Pennsylvania
Rules of Civil Procedure.
3. If not previously supplied, the entire investigative file
and all incident reports concerning this action or its
subject matter of the Defendant and their representatives or
insurers.
4. Any and all written reports of experts whom Defendant
intend to call as witness at the trial of this action.

carrying on an insurance business may be liable to satisfy part or
all of a judgment which may be entered in this action or to

6. Denied. On the contrary, Defendant did not agree to
install the necessary foundation for the home. By way of further
answer, Defendant believes lInd therefore avers that the contract
does not require Defendant to install the foundation and that
Plaintiff at all times was responsible for installing the
foundation.
7. Admitted in part, denied in part. It is admitted that
the contract identifies setup in four (4) weeks. It is denied
that Defendant agreed to set up the home within that period of
time without condition. On the contrary, Plaintiff was required
to have the foundation installed in order to set up the home, and
Plaintiff failed to have that foundation installed.
8. Admitted in part, denied in part. It is denied that
the total contract price was $57,891.00, if Plaintiffs are
alleging that the foundation work was included in that price. On
the contrary and for the reasons set forth above, the foundation
work was not included as part of the contract. It is admitted
that Plaintiffs gave to Defendant a check in the amount of
$10,000.00 as a down payment on the home.
9. Denied. At no time did anyone from Defendant indicate
that Defendant would not perform its contract, On the contrary,
Defendant at all times was prepared to set the home on
Plaintiffs' property. By way of further answer, Defendant avers
that installation of the whirlpool tub was not possible in the

home and that Defendant, through hiD counsel, advised Plaintiffs'
counsel of that fact.
10. Denied. On the contrary, Defendant believes and
therefore avers that Plaintiffs did not mitigate any alleged
damages since they could have completed the transaction with
Defendant, without damage. By way of further answer, Defendant
denies the remaining allegations in Paragraph 10, because, after
reasonable investigation, Defendant is without knowledge
sufficient to form a belief as to the truth of these averments,
and strict proof thereof, if relevant, is demanded at the trial
of this case.
11. Denied. After reasonable investigation, Defendant is
without knowledge sufficient to form a belief as to the truth of
the averments set forth in Paragraph 11, and strict proof
thereof, if relevant, is demanded at the trial of this case.
12. Denied. After reasonable investigation, Defendant is
without knowledge sufficient to from a belief as to the truth of
the averments set forth in Paragraph 12, and strict proof
thereof, if relevant, is demanded at the trial of this case.

the written contract entered into by the parties is attached to

COUNT I
15. Paragraphs 1 through 14 of Defendant's Answer are

16. Paragraph 16 stateo a legal conclusion to which no
responsive pleading is required. To the extent that any factual
allegations are set forth in Paragraph 16, said allegations are
denied. On the: contrary, Defendant did not breach any
contractual obligations with Plaintiffs.
WHEREFORE, Defendant requests this Court to enter judgment
in his favor and dismiss Plaintiffs' Complaint against him.
COUNT II - UNFAIR TRADE PRACTICES
AND CONSUMER PROTECTION LAW
17. Paragraphs 1 through 16 of Defendant's Answer are
incorporated by reference herein.
lB. Paragraph 1B states a legal conclusion to which no
responsive pleading is required. To the extent that Paragraph 1B
sets forth any factual allegations, said allegations are denied.
On the contrary, the statutory provision to which Plaintiffs make
reference deals with written guarantees or warranties given to a
purchaser. However, Plaintiffs have not alleged any written
guarantees or warranties relating to thio transaction, and there
are no such guarantees or warranties.

19. Paragraph 19 states a legal conclusion to which no
responsive pleading is required.
WHEREFORE, Defendant requests this Court to enter judgment
in his favor and dismiss Plaintiffs' Complaint against him.
COUNT III - NEW MATTER
20. Paragraphs 1 through 19 of Defendant's Answer are
incorporated by reference herein.
21. By written correspondence from Defendant's counsel to
Plaintiffs' counsel dated July 13, 1994, and faxed to Plaintiffs'
counsel on the same date, Defendant identified that the whirlpool
tub could not be installed without damage to the home and offered
to install the lot model home on Plaintiffs' property and provide
appropriate credit for the whirlpool tub. A true and correct
copy of the correspondence identified herein is attached hereto,
incorporated by reference herein and marked as Exhibit "A".
22. In the correspondence identified as Exhibit "A" in this
pleading, Defendant, as an alternative offer to Plaintiffs,
offered to order a new home having all of the features of the lot
model home, including the color of siding which was to be changed
and the color shingles which Plaintiffs originally desired, for
the same price as identified on the contract.
22. Plaintiffs specifically rejected both of the items
identified by Defendant in the correspondence.
23. Plaintiffs failed to mitigate any damages which they
have alleged by not accepting the lot model with appropriate

credit for the whirlpool tub, or, alternatively, taking a new
home at the same price as the lot model home was offered under
the terms of the contract.
24. Plaintiffs requested from Defendant and Defendant
returned to Plaintiffs the deposit of $10,000.00 as a result of
the dispute over the whirlpool tup.
25. Plaintiffs' claims are barred by the doctrine of accord
and satisfaction.
26. There were no written warranties or guarantees which
Plaintiffs alleged in their Complaint.
27. Count II of Plaintiffs' Complaint is based on a
provision of the Pennsylvania Unfair Trade Practices and Consumer
Protection Law specifically dealing with written warranties and
guarantees.
28. As to Count II of Plaintiffs' Complaint, Plaintiffs
failed to state a cause of action upon which relief may be
granted.
29. Plaintiffs failed to take steps necessary to accept
delivery of the home by failing to have the foundation installed
on the property.
30. At all times Plaintiffs were responsible for the
installation of the foundation necessary to accept the
manufactured home.

31. Plaintiffs failure to install a foundation rendered
Defendant's delivery of the home impossible within any time
period set forth in the contract.
WHEREFORE, Defendant requests this Court to enter judgment
in his favor and dismiss Plaintiffs' Complaint against him.

addition, it is my client's ~nderstanding that Mr. Jones
originally contemplated changing the color of the shingles but
decided against it on the theory that he could do that step
later. With a new home, Mr. Jones could have a choice as to the
shingle color, thus saving him money.
My clients inform me that it would take approximately six to
eight weeks to order and have a new home delivered to your
client's homesite. All that would be needed is Mr. Jones'
consent to order the home.
I would also point out that Mr. Jones has requested the
return of his deposit. Quite frankly, Mr. Jones was very rude to
representatives of Superior Homes and indicated that he was
coming for his $10,000.00 deposit. When he did not come to the
office, Superior Homes mailed the deposit to him. It is possible
that he will have the deposit by the time that you receive this
letter.
I would welcome the opportunity to speak with you concerning
this matter in the hope that we could promptly resolve it. Given
the respective interests of the parties, I cannot see how
litigation would further the interests of either side.
Hopefully, we can speak and iron out any details that need to be
discussed. If Mr. Jones wishes to take the existing lot model
without the whirlpool, my client can accommodate him. If he
would like a new home with a whirlpool installed at an identical
price, that step can also be achieved. Finally, if he wishes to
have the deposit back as previously requested, my client is
satisfied with that result.
I would appreciate your giVing me a call upon receipt of
this letter so that we might discuss the matter. I look forward
to hearing from you in that regard.

COMPLAINT
1. Plaintiffs are RODNEY E. JONES and VICKI D, LAWYER, adult
individuals who reside at 363 Sherwood Drive, Carlisle, Cumberland
County, Pennsylvania, 17013.
2. Defendant is DONALD R, BRODERICK, trading and doing
business under the registered fictitious name SUPERIOR HOMES, with
offices or principal place of business located at 2187 Lincoln
Highway East, Lancaster, Lancaster County, Pennsylvania 17062.
3. On or about June 20, 1994, Plaintiffs entered into a
contract with Defendant to purchase from Defendant a certain
modular home known as a Liberty, Oakbrook model 3 bedroom home.
4. In purchaeing the home, Plaintiffs dealt with a salesman
employed by Defendant by the name of Robert Barnett,
5. The home which Mr. Barnett sold to Plaintiffs was a lot
model home, dnd the price of the unit was $52,5DO,OO,
6. Under the Sales Contract, Defendant agreed to install the
neceeeary foundation for the home at the quoted price of $5,391.00,

and to perform all electrical, water, and sewer hook ups for the
home.
7, Pursuant to the agreement, Defendant further agreed to set
the home up within four (4) weeks of the date of the Sales
Contract.
8, The total contract price was $57,891,00, and Plaintiff
gave to Defendants a check in the amount of $10,000.00 for a down
payment on the home.
9. On or about July 12, 1994, the salesman Barnett advised
Plaintiffs that Defendant would not perform on its contract, and
would not deliver the home to Plaintiffs in accordance with its
contract.
10, In an effort to mitigate their damages, Plaintiffs
purchased an identical home from a different source, Ilowever, the
total cost to purchase and install the replacement home as promised
under the agreement with Defendant was $64,593.14, Accordingly,
Plaintiffs incurred damages for the loss of the benefit of their
bargain with Defendant in the amount of $6,702.14,
11. Prior to purchasing the home from Defendant, Plaintiffs
had lived in a mobile home located on the same lot, In
anticipation of the delivery of the home purchased from Defendants,
Plaintiffs had cleared their lot, and sold their mobile home, prior
to July 17, 1994,
12. Defendant's failure to deliver the home on July 17, 1994
resulted in Plaintiffs having no place to live until their new home
was ultimately delivered from another source on October 14, 1994,
