Pleadings in the matter were closed with the filing of Plaintiffs' Reply to New Matter under cover of letter dated March lB, 1997. 3, Since that date, Plaintiffs have sought discovery from the defense, both informally, and with formal filing of Interrogatories and Requests for Production of Documents, 4. Defendant has failed to produce any of the discovery information requested by Plaintiff, eithsr informally or formally, 5. On the contrary, Defendant did not agree to install the necessary foundation for the home. By way of further answer, Defendant believes lInd therefore avers that the contract does not require Defendant to install the foundation and that Plaintiff at all times was responsible for installing the foundation. 7. It is denied that Defendant agreed to set up the home within that period of time without condition. On the contrary, Plaintiff was required to have the foundation installed in order to set up the home, and Plaintiff failed to have that foundation installed. 8. Admitted in part, denied in part. It is denied that the total contract price was $57,891.00, if Plaintiffs are alleging that the foundation work was included in that price. On the contrary and for the reasons set forth above, the foundation work was not included as part of the contract. At no time did anyone from Defendant indicate that Defendant would not perform its contract, On the contrary, Defendant at all times was prepared to set the home on Plaintiffs' property. By way of further answer, Defendant avers that installation of the whirlpool tub was not possible in the 2 home and that Defendant, through hiD counsel, advised Plaintiffs' counsel of that fact. 10. Denied. On the contrary, Defendant believes and therefore avers that Plaintiffs did not mitigate any alleged damages since they could have completed the transaction with Defendant, without damage. By way of further answer, Defendant denies the remaining allegations in Paragraph 10, because, after reasonable investigation, Defendant is without knowledge sufficient to form a belief as to the truth of these averments, and strict proof thereof, if relevant, is demanded at the trial of this case. 11. On the contrary, the statutory provision to which Plaintiffs make reference deals with written guarantees or warranties given to a purchaser. However, Plaintiffs have not alleged any written guarantees or warranties relating to thio transaction, and there are no such guarantees or warranties. <I 19. WHEREFORE, Defendant requests this Court to enter judgment in his favor and dismiss Plaintiffs' Complaint against him. COUNT III - NEW MATTER 20. Paragraphs 1 through 19 of Defendant's Answer are incorporated by reference herein. 21. By written correspondence from Defendant's counsel to Plaintiffs' counsel dated July 13, 1994, and faxed to Plaintiffs' counsel on the same date, Defendant identified that the whirlpool tub could not be installed without damage to the home and offered to install the lot model home on Plaintiffs' property and provide appropriate credit for the whirlpool tub. A true and correct copy of the correspondence identified herein is attached hereto, incorporated by reference herein and marked as Exhibit "A". 22. In the correspondence identified as Exhibit "A" in this pleading, Defendant, as an alternative offer to Plaintiffs, offered to order a new home having all of the features of the lot model home, including the color of siding which was to be changed and the color shingles which Plaintiffs originally desired, for the same price as identified on the contract. 22. Plaintiffs specifically rejected both of the items identified by Defendant in the correspondence. 23. Plaintiffs failed to mitigate any damages which they have alleged by not accepting the lot model with appropriate 5 credit for the whirlpool tub, or, alternatively, taking a new home at the same price as the lot model home was offered under the terms of the contract. 24. Plaintiffs requested from Defendant and Defendant returned to Plaintiffs the deposit of $10,000.00 as a result of the dispute over the whirlpool tup. 25. Plaintiffs' claims are barred by the doctrine of accord and satisfaction. 26. There were no written warranties or guarantees which Plaintiffs alleged in their Complaint. 27. Count II of Plaintiffs' Complaint is based on a provision of the Pennsylvania Unfair Trade Practices and Consumer Protection Law specifically dealing with written warranties and guarantees. 28. As to Count II of Plaintiffs' Complaint, Plaintiffs failed to state a cause of action upon which relief may be granted. 29. Plaintiffs failed to take steps necessary to accept delivery of the home by failing to have the foundation installed on the property. 30. At all times Plaintiffs were responsible for the installation of the foundation necessary to accept the manufactured home. 6 31. Plaintiffs failure to install a foundation rendered Defendant's delivery of the home impossible within any time period set forth in the contract. Quite frankly, Mr. Jones was very rude to representatives of Superior Homes and indicated that he was coming for his $10,000.00 deposit. When he did not come to the office, Superior Homes mailed the deposit to him. It is possible that he will have the deposit by the time that you receive this letter. I would welcome the opportunity to speak with you concerning this matter in the hope that we could promptly resolve it. Given the respective interests of the parties, I cannot see how litigation would further the interests of either side. Hopefully, we can speak and iron out any details that need to be discussed. If Mr. Jones wishes to take the existing lot model without the whirlpool, my client can accommodate him. If he would like a new home with a whirlpool installed at an identical price, that step can also be achieved.
