6. Defendants named in paragraph 2 above are the present
real owners of the land subject to the Mortgage.
7. On or about April 29, 1987, Defendants borrowed Ninety-
Eight Thousand Four Hundred Dollars ($98,400.00) from Associa-
tion, pursuant to a written Note (a copy which is attached hereto
and incorporated by reference herein as Exhibit "B"). This
borrowing was secured by the subject mortgage.
8. The terms of the borrowing are as shown on Exhibits A
and B, the said Note and an amendment thereto. Defendants were
obligated to pay Plaintiff the sum of $774.12 monthly, plus
$23.88 as mortgage insurance, for a total monthly payment of
$798.00 due on the first day of each month.
9. The Note and the obligation are in default because
payments of principal and interest, beginning Auguet 1, 1995 and
monthly thereafter are now overdue and have not been paid,
whereby the entire balance of principal and all interest due
thereon (together with late charges, and costs of collection,
inclUding reasonable attorneys' fees) have become due and payable
immediately.
10. Defendants were required by the terms of the Note to
make monthly payments and thus are in default.
11. Plaintiff and the Association have satisfied any and
all conditions precedent.
12. Plaintiff has complied fully with Section 403 of Act 6
of the 1974 Session of the General Assembly of the Commonwealth

of Pennsylvania, 41 P.S. S 403 ("Act 6") by a mailing to Defen-
dants, a true and correct copy of which is attached hereto and
incorporated by reference herein as Exhibit C, on the date and to
the address shown on the Exhibit. This was a Notice of Intention
to Commence Mortgage Foreclosure Proceedings against Defendants.
13. Any and all notices required by loan documents have
been sent to Defendants.
14. Plaintiff has complied fully with Act 91 [35 P.S. S
1680.41(c)] of the 1983 Session of the General Assembly ("Act
91") of the Commonwealth of Pennsylvania, by a mailing to Defen-
dants, a true and correct copy of which is attached hereto and
incorporated by reference herein as Exhibit 0, on the date and to
the address shown on the Exhibit. All of the applicable time
periods therein have expired.
15. As of March 12, 1996, Defendants owed:
a. Principal of $91,082.93;
b. Accrued interest of $5578.83;
c. Late charges of $92.88;
d. Docket costs in Lancaster County, Pa. $129.52.
16. Every day the Defendant fails to pay any additional
interest, the interest continues at the daily interest amount of
$22.14.
17. Pursuant to the said Note ("Exhibit A" hereof), on
default of the Notes Defendants are obligated to pay to the
holder "all of its costs and expenses in enforcing this Note to

the extent not prohibited by epplicable law. Those expenses
include, for example, reasonable attorneys I fees."
18. Plaintiff believes and therefore avers that the attor-
ney fees will be at least $4000.00, in addition to the Court
costs taxable to Defendant; and such fees will be substantially
larger in the event of any contest or execution.
WHEREFORE Plaintiff demands judgment against both
Defendants, individually and jointly, in the sum of $101,883.86,
plus interest after March 12, 1996 at the rate shown on the
attached exhibits, late fees, further attorney's fees when
appropriate, and costs; and Plaintiff further demands a judgment
in foreclosure against Defendants.
