AMENDED PETITION FOR SUPPLEMENTARY PROCEEDINGS SEEKING
SATISFACTION OF JUDGMENT AND LIQUIDATED DAMAGES
PURSUANT TO 42 Pa.C.S.A. 8104
AND NOW comes the Defendant/Petitioner ,JAMES L. HOOVER, by and
through hi.fl attorney, Richard I.. Webber, Jr., and files these
supplementary proceedings pursuant to 42 Pa.C.S.A. 8104, averring
the following:
1. Defendant/Petitioner is James L. Hoover, of 633 Brandy Run
Road, Newville, PA 17241.
2. Plaintiff/Respondent is Henry W. 'l'hissen, of 2174 Ritner
lIighway, Shippensburg, PA 17257.
3. On December 23, 1996, the Honorable George E. Hoffer
entered an Order of Court finding in favor of Plaintiff/Respondent
and against Defendant/Petitioner in the amount of $ 758.88
concernIng a contractual disput.e between the parties.
4. Neither party appealed the said Order of Court.
5. '['he Order of Court therefore became final, and judgment
was entered, on January 23, 199".

postal card and receipt are attaclled I~reto and incorporated by
reference herein, and labeled as Exhibit "D".
13. Plaintiff/Respondent refused and continues to refuse to
satisfy the judgment, in spite of Defendant/Petitioner's tender of
full payment of the judgment balance.
14. On June 10, 1997, Plaintiff/Respondent forwarded a letter
to Defendant/Petitioner's attorney. 1\ copy of said letter is
attached hereto, labeled an Exhibit "E", and incorporated b}'
reference herein.
15. As the letter indicates, Plaintiff/Respondent refused to
satisfy the judgment, claiming that the total amount owed is
$ 1,081.23.
16. To date, Plaintiff/Respondent has failed to satisfy the
judgment, and continues to refuse \:0 do so.
17. 1\ period of time greater than 30 days has elapsed since
payment was tendered to Plaintiff/Respcndent by Defendant/
PetiUoner.
18. Defendant/Petitioner has incurred attorney fees as a
result of Plaintiff/Respondents failure to satisfy the judgment,
and will continue tolncUl' said costs in the proceeding.

amount of payment needed to satisfy the judgment.
B. On September 15,1997, Defendant/Petitioner filed an
Amended Petition for Supplementary Proceedings Seeking
Satisfaction of Judgment and Liquidated Damages.
9. The Amended Petition seeks liquidated damages
pursuant to 42 Pa.C.S.A. B104 and alleges that Plaintiff/
Respondent improperly failed to satisfy the judgment.
10. Plaintiff/Respondent filed an Answer to the Amended
Petition on September 28, 1997.
11. Plaintiff/Respondent in his Answer (1) denies
liability for any liquidated damages; and (2) seeks
clarification of the amount owed in the judgment.
12. Pursuant to 42 Pa.C.S.A. B104, this Court has
authority, via supplementary proceedings, to award
liquidated damages to a judgment debtor where the
judgment creditor has improperly failed to satisfy
judgment.
13. Defendant/Petitioner requests that your Honorable
Court: schedule a hearing f.or purposes of resolving the
outstanding issues between the parties.
WHEREFORE, the Defendant/Petitioner respectfully requests that

IN REI APPEAL FROM ARBITRATION
ORDER OF COURT
AND NOW, this 23rd day of December, 1996, after
hearing and consideration of the claim of Plaintiff for repairs
to his furnace system, in which he claims the Defendant
improperly installed certain items, and after consideration of
the testimony of Dennis Hamilton, who performed certain repairs
exclusive to the installation work originally done by the
Defendant, we do find in favor of the Plaintiff in the amount of
$758.88.

And nO~1 comes the Plaintiff Henry Thissen, and states as
follows:
1, Plaintiff Henry Thissen is an adult individual
currently residing at 2174 Ritner Highway, Shippensburg,
Cumberland County, Pennsylvania 17257.
2. Defendant James L, Hoover is an adult individual
residing at 633 Brandy Run Road, Newville, Cumberland County,
Pennsylvania 17241.
3. The Plaintiff contracted with the defendant on April
4, 1994 to install a new furnace with central air and humidifier
at his residence for an agreed to price of $3694.01.
4, After the completion of the work performed by Mr.
Hoover the Plaintiff called the Defendant several times to
indicate that the furnace and air conditioning were not
working properly.
5. The defendant never returned the Plaintiffs calls
nor corrected the needed repairs to the heating/air conditioning
system,
