CIVIL TERM WILSON SIPE, Defendant CIVIL ACTION - LAW PETITION FOR APPROVAL OF WRONGFUL DEATH SETTLEMENT TO THE HONORABLE, THE JUDGES OF SAID COURT: Petitioner, Judy E. Miller, Administratrix of the estate of Gertrude E. Neff, deceased, through the undersigned counsel, R. Mark Thomas, Esquire, petitions this Court for an Order approving a wrongful death settlement filed on behalf of the estate and all individuals entitled to share in the proceeds for the wrongful death of Gertrude E. Neff, deceased, and in support thereof avers the following: 1. Petitioner is the Administratrix of the estate of Gertrude E. Neff, deceased, letters of administration having been granted to her on January 30, 1995. 2. Gertrude E. Neff was injured as a result of an automobile accident caused by the Respondent Wilson sipe on or about December 2, 1994. 3. FOllowing the automobile accidont Gertrude E. Neff, deceased, was transferred to tho lIoly Spirit Hospital and remained hospitalized until her doath on Docembor 27, 1994. ~ ' 4. On the date of December 27, 1994, Gertrude E. Neff, deceased, died at the age of 86 years. 5. Your Petitioner commenced an action for wrongful death against the Respondent Wilson Sipe through the filing of a Writ of Summons in the Court of Common Pleas of Cumberland county on May 16, 1996. 6. A settlement has been reached between the Petitioner and the Respondent's insurance company whereby the other side agrees to pay and Petitioner agrees to accept the sum of $37,500.00 as damages in the wrongful death action. 7. The $37,500.00 is to be distributed according to the intestate laws of Pennsylvania since Gertrude E. Neff died intestate. 8. Those persons entitlod to share in the proceeds, and the amount to which they are entitled to share is set forth as followsl Shirley J. Albright, daughtor $13,125.00 Karolynne A. Alfera, granddaughter $ 3,281.25 Deborah S. Hall, granddaughter $ 3,281.25 Jeffrey A. Neff, grandson $ 3,281.25 Michael Neff, grandson $ 3,281.25 R. Mark Thomas, Esquire $11,250.00 9. The persons identified above are the only heirs entitled to recover proceeds from this wrongful doath action. 10. Each of the above-named heirs is an adult individual. WHEREFORE, potitioner roquests that this Court enter an Order approving the distribution of the proceeds for the wrongful death of Gertrude E. Neff in accordanco with the sum set forth herein. The sum is to be divided such that $18,750.00 is attributod to the wrongful death action, and $18,750.00 is attributed to the survival action. 7. The lump sum distribution, from the insurance company, minus attorney I s fees, is to be distributed according to the intestate laws of Pennsylvania since Gertrude E. Neff died intestate. 8. Those persons entitled to share in the proceeds, and the amount to which they are entitled to share is set forth as follows I Shirley J. Albright $12,562.50 Karolynne A. Alfera $ 3,140.62 Deborah s.
