5, Said Agreement, a copy of which is attached hereto as
Exhibit "A", was recorded in the office of the Rec:order of Deeds
in and for cumber-land county in Book 445, Page 808, on June 3,
1993.
G, The said I<enneth A. Dietrich has executed a quitclaim
deed to Plaintiffs, a copy of which is attached het-eto as Exhibit
"B", conveying back to Plaintiffs all of his right, title, and
interest in said real estate.
7. By the terms of said Agreement, Defendant and Kenneth A.
Dietrich were to have paid to Plaintiffs the sum of Thirty
Thousand DollarR, ($30,000.00), payable in constant monthly
installments of Two Hundred Dollars ($200,00), over a period of
one hundred fifty (150) months as full consideration for said
real estate.
8. Defendant has not occupied the premises since on or
about July 1, 1995, at which time the principal debt owing was
approximately $2500,00, and unpaid utilities amounted to
$1174.00,
9, Defendant has failed to make any further monthly
payments and is therefore in default under the Agreement.
10. Plaintiffs notified Defendant of default on or about
July 1, 1995,

and intereflt in the Agreement l1ull and void and to proceed to

12, Plaintiffs have the right to retain all monies paid
under the Agreement as liquidated damages.
13, Plaintiffs have the right to recover $200,00 per month,
commencing July 1, 1995, as additional damages, until possession
is obtained by Plaintiffs.
WHEREFORE, Plaintiffs SUSAN A, DIETRICH and LLOYD E.
DIETRICH respectfully request that Your Honorable Court enter an
Order declaring Defendant's rights and interest null and void in
and to the said Installment Sales Agreement and in and to the
said real estate, granting possession of said real estate to the
Plaintiffs, and further ordering Defendant to pay to Plaintiffs
the sum of $3,674.00 in unpaid principal debt and utilities, plus
interest thereon, additional damages amounting to $200.00 per
month commencing July 1, 1995 until possession is obtained by
Plaintiffs, and reasonable legal fees and costs in the amount of
$395.50.

BETWEEN KENNETH A. DIETRICH, Married Man, Party of the First
Part and Grantor herein,

Party of the Second Part and Grantee herein,
WITNESSETH, That in consideration of One Dollar IGl.00), in hand
paid, the receipt whereof is hereby acknowledged, the said
Grantor does hereby grant and convey to the said Grantees, their
heirs and assigns,
ALL THAT CERTAIN piece or parcel of land situate in North
