I
6, At all times relevant to this action, Defendant was a
tenant occupying Apartment 3 on the second floor in the building
owned by Decedent, William Freeman.
7. On or about Friday, November 3, 1995, a waterbed owned
by Defendant and located in Apartment 3 developed a severe leak,
causing water to run into Apartment 3 and the first floor retail
space at 315 Bridge Street, New Cumberland.
8. Defendant did not take immediate steps to stop the
leak, and therefore water leaked continuously for. more than
twenty-four hours.
9. The water which leaked from the waterbed in Defendant's
apartment caused damage to the floor, walls and door in Apartment
3 and to the ceiling alld lights of the first floor retail space,
for which the Freeman Estate incurred reasonable repair costs of
$5,726.60, as set forth on an itemized repair proposal of Floor
Coverings International, a true and correct copy of which is
attached hereto as Exhibit "A" and made a part hereof.
10. The water which leaked from the waterbed in Defendant's
apartment caused damage to the floor walls, pegboards, and
cour.ters in the first floor retail space, for which the Jantoses
incurred reasonable repair costs of $5,597,50, as set forth on an
itemized repair proposal of Floor Coverings International, dated
November 27, 1995, a true and correct copy of which is attached
hereto as Exhibit "B" and made a part hereof.

11. The water which leaked from the waterbed in Defendant's
apartment caused damage to a photocopier, model FP-2230, owned by
the Jantoses, such that required repairs would have exceeded the
cost of a replacemellt copier; consequently, the Jantoses incurred
reasonable replacement costs for the copier totalling $3,321.80,

The costs related to the replacement copier are partially set
forth in an itemized letter from Central Business Systems, Inc.,
dated November 27, 1995, a true and correct copy of which is
attached hereto as Exhibit'.c. and made a part hereof.
12. The water which lenked from the waterbed in Defendant's
apartment also caused the Jantoses to incur the following
consequential damages:

13. Defendant's negligence in failing tv maintain the
waterbed in proper condition and in failing to stop the water

leak promptly caused the various damages incurred by the Jantoses
and the Freeman Estate.
14. In addition or in the alternative, Defendant is
strictly liable for the damage caused by the waterbed and for the
various damages incurred by the Jantoses and the Freeman Estate.
15. Defendant is liable to the Jantoses in a total amount
of $10,454. 5l.
16. Defendant is liable to the Freeman Estate in a total
amount of $5,726.60.
17. The total amount claimed by Plaintiffs, exclusive of
costs and interest, does not exceed the monetary limit subject to
compulsory arbitration under Cumberland County local rules.
WHEREFORE, Plaintiffs demand judgment in their favor and
against Defendant in the amount of $10,454,51 as to the Jantoses
and $5,726.60 as to the Freeman Estate, together with costs and
interest.
