That at all times herein mentioned Plaintiff was, and still is, the fee simple owner of the following described real property: 5040 Louise Drive, Suites 103, 104, and 105, Township of Upper Allen, County of Cumberland, Mechanicsburg, Pennsylvania, 17055. 4. On May 1, 1991, Defendant entered into a commercial lease agreement (the "Lease Agreement") with Plaintiff, as lessor, for office and graphic design and printing production space in suites 103, 104, and 105 of 5040 Louise Drive, Upper Allen Township, Cumberland County, MeC'hanicsburg, PA 17055 (thE! "leased premises"). A true and correct copy of said Lease Agreement is attached hereto, and made a part hereof, and marked as Exhibit "A," 5. By letter dated May 7, 1996, and delivered by overnight courier on May e, 1996, Plaintiff served Defendant with a notice in writing (the "Notice") signed by Plaintiff, that in accordance with the Lease Agreement, the Defendant had five (5) days to pay one (1) months rent, operating costs, and late charges due on or before May 12, 1996 or suffer an Event of Default requiring Defendant to quit, plaintiff's real property, and deliver up possession of the same. A true and correct copy of said notice is attached hereto as Exhibit "B." 6, That as of the date of this Complaint, more than twelve (12) days after the date of the Notice, Defendant has failed to pay the required rent, operating costs, and late charges. 2 . . 7. Further, Defendant has willfully remained in possession of the leased premises after notice to quit, has refused, and still refuses, to quit said premises, and still occupies the same. 8. Plaintiff has not confessed Judgment in Ejectment against Defendant in any jurisdiction. 9. Plaintiff is authorized by the warrant of attorney contained in the Lease Agreement to confess judgment in ejectment against Defendant, 10. The warrant of attorlley appearing in paragraph 18,1 of the Lease Agreement is lees that twent, (20) years old. 11. The Lease Agreement upon which judgment is being confessed was for commercial and not residential purposes and was freely negotiated by the parties thereto. WHEREFORE, Plaintiff demand~ judgment in ejectment against Defendant for immediate possession of the above described premises as authorized by the warrant of attorney appearing in paragraph 18.1 of the Lease Agreement.
