Plaintiff is MELLON BANK, N.A., as Successor Trustee, for Pennsylvania Housing Finance Agency, pursuant to a Trust Indenture dated as of April 1/ 1982 ("Trust") / by its servicing agent Bank America having an office at P.O. Box 26388, Richmond, Virginia 23260-6388, 2. Defendants, CHARLES E. LOPERT and DIANE M. LOPERT are both adult individuals whose last known address is 907 Good Hope Road, Mechanicsburg, Pennsylvania 17055. 3. On or about October 30, 1991/ Defendants executed a Promissory Note ("Note") in favor of Sovran Mortgage Corporation- ("Original Mortgagee") in the principal amount of $49,500.00, the proceeds of which were used to purchase a residential property located at 907 Good Hope Road, Mechanicsburg, Pennsylvania 17055, which Note is attached hereto and marked Exhibit "A", 4. Contemporaneously with the execution of the aforesaid Note, in order to secure payment of the same, Defendants made, executed and delivered to Original Mortgagee, a certain real estate Mortgage whJ.ch is recorded in the Recorder of Deeds Office of Cumberland County. in Mortgage Book 1034, Page 147,. The mortgage was assigned to Corestates Bank, N,A. / as Trustee, for Pennsylvania Housing Finance Agency, pursuant to the terms of said Trust, and recorded as aforesaid in Book 406, page 1018 on November 4, 1991. Said mortgage evidences the terms of said Note, the balance of which is set forth in paragraph four of this Complaint. The Mortgage and Assignments are incorporated herein by reference. 5. Mellon Bank, N. A., i1g the Successor Trustee to Corestates Bank, N.A., under said Trust and has th~ power and authority to bring chis action in mortgage foreclosure. 6. The land subject to the Mortgage is: 907 Good Hope Road, Hampden Township, Mechanicsburg, Pennsylvania 17055, and is more particularly described in Exhibit "B" attached hereto, The Defendants are the sole owners of the said land, 7. The Mortgage debt is in default due to the fact that Defendants have failed to pay the installment due on October 1, 1995, and all subsequent installments thereon, and the following amounts are due on the Mortgage: (a) Unpaid principal balance (b) Interest at $10.89 per day from 9/1/95 to 6/1/96 (based on a contract rate of 8.350\) $47,608.91 2,972,97 (c) Accrued/Accumulated Late Charges and Late Charges at $18.72 per month (d) Escrow deficit 149,76 91,51 (e) 5% Attorney's Commission TOTAL 2.380.44 $53,203.59* *Together with interest at the per diem rate noted in (b) above after June 1, 1996. and other charges and costs to date of Sheriff's Sale, The attorney's fees set forth above are in conformity with the Mortgage documents and Pennsylvania law, and will be collected in the eVF.!nt of a third party purchaser at Sheriff's Sale. If the Mortgage is reinstated prior to the sale, reasonable attorney's fees will be charges that are actually incurred by Plaintiff. 8. No judgment has been entered upon said Mortgage in any jurisdiction. 9. Notice of intention to foreclose and to accelerate the loan balance has been given to the Mortgagors, in accordance with Section 403 of Pennsylvania Act No. 6 ot 1974, but t.he Mortgagors have failed to reinstate the Mortgage in accordancp. with the provisions thereof. A copy of the Notice is attached hereto and made a part hereof as Exhibit "C". 10. Defendants are not members of the Armed Forces of the United States of Amarica, nor engaged in any way which would bring them within the Soldiers and Sailors Relief Act of 11940, as amended, 11. Plaintiff is MELLON BANK, N,A., as Successor Trustee, for pennsyl van1.a'-Housing Finance Agency, pursuant to a Trust Indenture dated as of April 1,1982 ("Trust"), by its servicing agent Bank America having an off ice at P. 0, Box 26388. LOPERT and DIANE M, LOPERT are both adult individuals whose last known address is 907 Good Hope Road, Mechanicsburg, Pennsylvania 17055, 3, On or about October 30, 1991, Defendants executed a Promissory Note ("Note") in favor of Sovran Mortgage Corporation- ("Original Mortgagee") in the principal amount of $49,500,00, the proceeds of which were used to purchase a residential property located at 907 Good Hope Road, Mechanicsburg, Pennsylvania 17055, which Note is attached hereto and marked Exhibit "A", 4. Contemporaneously with the execution of the aforesaid Note, in order to secure payment of the same, Defendants made, executed and delivered to Original Mortgagee, a certain real estate Mortgage which is recorded in the Recorder of Deeds Office of Cumberland County, in Mortgage Book 1034, Page 147" The mortgage was assigned to Corestates Bank, N,A., as Trustee, for Pennsylvania Housing Finance Agency, pursuant to the terms of said Trust, and recorded as aforesaid in Book 406, page 1018 on November 4, 1991. Said mortgage evidences the terms of said Note. the balance of which is set forth in paragraph four of this Complaint. The Mortgage and Assignments are incorporated herein by reference. 5. Mellon Bank, N.A., is the Successor Trustee to Corestates Bank, N.A., under said Trust and has the power and authority to bring this action in mortgage foreclosure. 6. The land subject to the Mortgage is: 907 Good Hope Road, Hampden 'l'ownship, Mechanicsburg, Pennsylvania 17055, and is more particularly described in Exhibit "8" attached hereto, The Defendants are the sole owners of the said land. 7. Plaintiff has conducted an investigation in order to determine the whereabouts of the Defendant, through its attorney, by attempting to obtain a forwardIng address from the post office, the Department of Transportation, Credit Bureau, and also by attempting to obtain a phone number for the Defendant, but no information has been received from any of the sources. 4. The Sheriff, heretofore posted the Defendant's property with a Notice of Sale or Handbill. Notice of Sale was also sent notice of the Sale by ordinary and Certified mail. Sufficient notice has, therefore, been given to the Defendant. 5.
