through counsel for the argument scheduled in this matter, and
it appearing that the Defendant did not file an answer to the
Petition or to the Rule To Show Cause issued in response to the
Petition, the Rule issued by this Court on October 27, 1998, is
made absolute, the case is stricken from the plJrge list, and the

COMPLAINT
1. Plaintiff Sandra Harvey is an adult individual who
resides with her husband at 6036 Edwards Drive, Mechanicsbutg,
Cumberland County, Pennsylvania 17055.
2. Defendant Brendan Nelson is an adult individual whose
last known address is 4107 Mountain view Road, Mechanicsburg,
Cumberland County, Pennsylvania 17055.
3. On or about May 19, 1995, plaintiff entered into an
agreement with defendant whereby defendant agreed to perform
certain construction work at the plaintiff's residence. A copy of
that agreement is attached hereto and marked Exhibit. "A" and
incorporated herein as if set forth at length.
COUNT I - BREACH OF CONTRACT
4. Paragraphs 1 through 3 aroe incorporated herein as if set
forth at length.
5. The contract called for the defendant to replace one of
the plaintiff's basement walls and to eliminate a problem of water
Beepage into the plaintiff's basement. The defendant commenced
work aB per the terms of the agreement and the plaintiff paid him
a total of $5,600.00 to date for his work.

Defendant has breached his agreement to perform the work

in a quality and workman-like fashion in that:
a. The basement wall replaced by the defendant was
improperly installed and sealed and there is now more
water leaking into the basement than prior to the date
when the defendant commenced work;
b. The contract called for repairs to the concrete
patio which would need to have been removed for
excavation, but the defendant removed the entire patio
and did not install a patio according to the
specifications agreed upon;
c. The defendant improperly backfilled the area
around the basement wall which he replaced and the patio
which he installed which has resulted in laroe portions
of dirt being washed away from the basement wall and
underneath the patio;
d. The contract called for the extension of
downspouts on the plaintiff's home to direct water away
from the rear of the home's foundation, but defendant
failed to properly install these downspouts and now
every time it rains the water runoff through the
downspouts floods the plaintiff's backyard;
e. The contract called for the removal and
installation of a new sidewalk, but defendant improperly
installed the sidewalk and installed a much smaller

aidewalk than what the contract called forI and
f. All the work performed by the defendant was
done in such a fashion as to create more problems with
the structure than existed prior to the commencement of
the work by the defendant.
7. Defendant has ceased working at plaintiff's premises and
has not returned to complete the work since July 1995, despite
repeated requests by the plaintiff to do so.
8. The costs to complete the work originally contracted for
by the plaintiff with the defendant is $10,000.00.
9. Plaintiff has already paid the defendant $5,600.00.
10. Plaintiff seeks damages in an amount equal to $7,875.00.
WHEREFORE, plaintiff seeks damages for breach of contract
against the defendant in an amount of $7,875.00 plus costs as the
law may allow.
COUNT II - NEGLIOENT PERfORMANCE or CONTRACT
11. Paragraphs 1 through 10 are incorporated herein as if set
forth at length.
12. The work which was performed by the defendant was
performed in a negligent fashion which caused damage to portions of
plaintiff's property above and beyond what was called for under the
contract.
13. Defendant's negligence consisted of the following:
a. Removal of a central air conditioning concrete
pad which was not called for under the terms of the

contract and his failure to re-install this concrete pad
at the completion of his work;
b. Operating a large piece of heavy equipment on
the phintiff's property which caused damage to
plaintiff's driveway;
c. Leaving the landscaping of plaintiff's yard
graded in such a way as to channel the water runoff in
the direction of plaintiff's home; and
d. Improperly raising the elevation of plaintiff's
house in such a way as to cause structural damage to the
house.
14. Defendant's negligent performance of the work which he
did perform at plaintiff's houso has caused plaintiff damages in an
amount in excess of $10,000.00.
WHEREFORE, plaintiff prays this Honorable Court will enter
judgment in her favor and against the defendant on this count of
negligence in an amount in excess of $10,000.00 plus costs.
