WHEREAS,
Hill, Pennsylvania,
executed or is about
BUILDER, INC., of
J. MICHAEL KILLMON AND KATHARYN L. KRAEMER, of Camp
the Owner, contemporaneously herewith has
to execute a contract with JIM MILLER CUSTOM
Dillsburg, York County, Pennsylvania, the
Contractor, for the construction of a dwelling house, and related
structures or improvements, upon that certain land situate in Lower
Allen Township, Cumberland County, Pennsylvania, more particularly
bounded and described as set forth in Exhibit "A" attached hereto
and made a part hereof.
NOW, this ~ day of.~~ , 2002 at the time
of and immediately before the execution of the said principal
contract, and before any authority has been given by the said Owner
to the said Contractor to commence work on, or to furnish or
purchase materials for the aforesaid buildings or construction, in
consideration of the making of said contract with said Contractor
and the further consideration of One Dollar to said Contractor paid
by said Owner, it is agreed that no liens or claims shall be filed
or made against said buildings and/or land, or any part, piece,
parcel or lot thereof, by said Contractor, or any sub-contractor,
or by any materialmen, workmen or other persons for or on account
of any labor provided or materials furnished or purchased, or any
extra labor or materials provided, furnished or purchased for said
buildings or construction, hereby expressly waiving any and all
rights to file or make such liens and claims.
AND, in furtherance hereof, the said Contractor does hereby
represent and warrant that as of the time of the execution hereof,
neither said Contractor, nor any sub-contractors, materialmen,
workmen or any other persons have commenced any work on, or
furnished or purchased any materials for the aforesaid buildings or
construction.
IN WITNESS WHEREOF, the said Owner and Contractor, each
intending to be legally bound hereby, have duly executed this
Stipulation on the aforesaid day, month and year.

EXHIBIT "A"
ALL THAT CERTAIN piece, parcel or lot of land situate between
Woodcreek Drive and the Yellow Breeches Creek in Lower Allen
Township, Cumberland County, Pennsylvania, said premises being known
as Lot No. 14 as shown on the Revised Preliminary/Final Subdivision
Plan for High Meadow, Phase IV, Lots 13, 14 and 15, and recorded in
the Office of the Recorder of Deeds in and for Cumberland County, in
Plan Book 78, page 99; and said premises being further bounded and
described as follows:
BEGINNING at a point on the Eastern right of way line of Woodcreek
Drive at the Southwest corner of lands now or formerly of Glenn and
Sandra Ressler; thence along said lands of Ressler the following
three courses: (1) North 63 degrees 20 minutes 44 seconds East a
distance of 116.39 feet to a point; (2) North 85 degrees 20 minutes
45 seconds East a distance of 210.83 feet to a point; (3) South 69
degrees 34 minutes 06 seconds East a distance of 180.48 feet to a
point in the Yellow Breeches Creek on the line of lands now or
formerly of Lester Bixler, said line also being the dividing line
between Lower Allen Township, cumberland County, and Fairview
Township, York County; thence along said line and in the Yellow
Breeches Creek South 21 degrees 14 minutes 11 seconds West a distance
of 154.32 feet to a point at the Northeast corner of Lot No. 13;
thence along said Lot North 76 degrees 45 minutes 58 seconds West a
distance of 225.20 feet to a point; thence along same North 85
degrees 38 minutes 54 seconds West a distance of 199.33 feet to a
point on the Eastern right of way line of Woodcreek Drive; thence
along said right of way line by a line curving to the left having a
radius of 305.00 feet an arc length of 71.63 feet and a chord bearing
of North 07 degrees 33 minutes 39 seconds West a distance of 71.46
feet to a point at the Southwest corner of said lands of Ressler, the
place of BEGINNING. CONTAINING 65,860.3 square feet (1.51 acres).
