Defendant further denies that there was an agreement between Plaintiff and Defendant
subject to confinnation. Defendant also denies that Richard L. Stark had the authority to
enter into an agreement on behalf of Plaintiff, or had authority to bind Plaintiff with
regard to this matter, and demands proof thereof at any trial,
8. Denied, The agreement between 200 North Third, Inc, and Placey & Wright
re3ulted from the efforts of Defendant and not from the efforts of Plaintiff,
9, Denied. Defendant owes Plaintiff no commission, Plaintiff earned no
commission, and Defendant has not wrongfully withheld anything from Plaintiff.
10, Denied, Defendant owes Plaintiff no commission, is under no obligation to
pay Plaintiff any commission, and is obligated to pay Plaintiff no interest on any alleged
commission, Defendant denies that there was ever any agreement between the parties
which obligates Defendant to pay interest to Plaintiff and denies that Defendant has any
obligation to pay interest to Plaintiff whatsoever.
11. Defendant admits that Plaintiff made demand upon Defendant for the payment
of a commission and denies that such commission is due. Defendant did tender a
payment ofSl,750,00, as an attempted accord and satisfaction of the dispute between the
parties which arose from Plaintirrs demand for a commission, That offer of compromise
was rejected by Plaintiff and has now been withdrawn by Defendant and, as an attempt to
compromise a controversy between the parties, evidence of such attempt is not admissible
in these proceedings,
12, Admitted subject to the answer set f0l1h in paragraph II hereinabove.
13, Denied. Plaintiff is not entitled to payment of any commission from
Defendant and Defendant is proper in refusing Plaintiff's demands for such payment.
14, Admitted,
WHEREFORE, Defendant prays that Plaintiff's complaint be dismissed and that
judgment be entered in favor of the Defendant in this matter.

1.5. There was no agreement between Plaintiff and Defendant whereby Defendant
agreed to pay Plaintiff any commission for the transaction on which Plaintiff has now
brought this complaint
16. Defendant had prior discussions with the potential tenant, Placey & Wright,
which predated Plaintiff's involvement with that tenant. As a result, Plaintiff, who did
not introduce the potential tenant to the premises, to the lease, or to Defendant, did
nothing to earn a commission in this matter.
17. If Plaintiff is entitled to any commission in this matter, it is entitled to be paid
that commission only as rent is paid by Placey & Wright, as tenant, to 200 North Third,
Inc., as landlord and Plaintiff is not entitled to an advance, lump-sum payment of
commission,
WHEREFORE, Defendant prays that Plaintiffs complaint be dismissed and that
judgment be entered in favor of the Defendant in this matter,
