STIPULATION OF AQREEMENT
AND NOW, Ihis 14th day of August, 1996 comes the respondent Commonwealth of
Pennsylvania, Department ofTransportalion, Bureau of Motor Vehicles (hereinafter,
Department), by and through its attorney, Philip L. Zulli, and the petitioner, Barry Myers,
proceeding uro se, and files the following Stipulations:
I. On November 28, 1980, Twin Wheel Automotive (hereinafter, Station) was
appointed by the Department as an official inspection slation.
2. Robert B. Manning is the mechanic who worked at the Station during the period
in question,
3. Barry Myers is the owncr oflhe Station.
4, On April 5,1996, both the Station and mechanic Robert B. Manning, operator's
number 19-316-933, were suspended for two months for faulty and two months for improper
record keeping which were 10 run concurrenlly.
5, On April 5, 1996, the Station and mechanic Robert B. Manning were suspend~d
for one year for faulty inspection and one year for improper record keeping to run concurrently
with current suspensions,
6. On April 5, 1996, the Station and mechanic Robert B. Manning were suspended
for three years for faully inspection to run concurrently with the current suspensions.
7. On April 5, 1996, the Station was restored pending appeal.
8. On May 20, 1996, the Station and mechanic Robert n. Manning were suspended
permanently for furnishing a certificate of inspection without an inspeclion and fraudulent record
keeping 10 run concurrently with the current suspensions,

9. On May 24, 1996, the Station was restored pending appeal.
10, The Department has agreed that the Stalion experienced extenuating
circumstances due to medical problems and overly relied upon its mechanic Robert B, Manning,
11. The Department has agreed to reduce all suspensions specifically stated above to
three, two-month suspensions for faulty inspcction and one, two-month suspension for improper
record keeping. Said suspensions arc to run consecutively for a total suspension of eight months.
i 2, In exchange for the reduced suspensions, Petitioner Station has agreed to
withdraw all appeals and to abandon its attempt to avoid the suspension (by establishing another
official inspection station on the same premises). Petitioner Station agrees not to maintain an
official inspection station on the same premises during the period of the eight-month suspension,
and any other application submittcd will be reviewed in accordance with departmental
regulations,
13, Petitioner and Respondent agree to abide by all of the foregoing tenns and
conditions,
WHEREFORE, for the abovc reasons, Petitioner and Respondent respectfully requests
this Honorable Court to accept this Stipulation of Agreement and enter upon the record the
attached proposed order,
