Winder, and answers Plaintill's Complaint as follows: I. Admilled. 2. Admilled. 3. Admilled, 4. Admitted. S. Denied. To the contrary, Defendant avers that Plaintil1's cau~ of action based on the Agreement is barred by the doctrine of duress, by the defense offailure of consideration, and by the defense of fraudulent misrepresentation with regard to this Contract. as is more fully set forth in paragraphs 10 through 27 of the within new matter, the averments of which are incorporated herein by reference. as if fully set forth, 6. Denied, To the contrary, Defendant avers that she owes nothing to Plaintiff under the terms of the agreement. I I. ~ 13. The threats and physical menace directed toward Defendant by the agent, servant or employtle ot'Koolvent continued for approximately lour hours, or from 1:00 to ~:oo p.m. on June 7, 1995. 14. Defendant executed the Contract under duress and as a result oflhe fear created by the threats and physical menace of the agent, servant or employee of Koolvenl. 15. Defendant did not want to contract with Koolvent and would not have done so exceptlbr the threats and physical menace of the agent, servant or employee of Koolvent. 16. As the Contract was executed under duress, Plaintil1's cause ofaction on the contract is barred by the doctrine of duress. 17, Under the terms oflhe Contract, both the document dated June 28, 199~ (Plaintil1's Exhibit "B") and the document dated June 7, 1995 (Defendant's Exhibit" A"), Koolvent agreed to install vinyl soffit and fascia on all eave~ and gables of Defendant's house, with the work to be of workmanlike quality, such work to include removal of existing gulters and reinstallation of gutlers after soffit and fascia had been put on the house. 18.
