Foreclose and of Defendants' rights under said Act wcre forwarded to Harold J, Eutzy and
Monica M, Eutzy dated April II, 1996, first class mail, certificate of mailing. addressed to 315
East Garfield Street, Shippensburg, Pennsylvania 17257, Copies of the aforesaid Notices are
attached hereto and marked Exhibits "C" and "D", Copies of the mailing receipts, postal forms
3817, evidencing the mailing of said Notices are attached hereto and marked Exhibit "E",
13, Defendants received delivery of said Notices on April 16, 1996. See 35 P,S.
11680.404c(e). Melion believes. and therefore avers, that Defendants have not applied for
assistance under the Act.
13, Pursuant to the Act of January 30, 1974, P,L. 13, No, 6, 41 P,S, ~1011tl~, and
in particular 1403 th~reof, Mellon gave wriuen notice to Defendants of its intent to foreclos~ by
letters dated April II, 1996, addressed to Howard], Eutzy and Monica M. Eutzy, 315 East
Garfield Street, Shippensburg, Pennsylvania 17257, certified mail, return receipt requested Nos.
Z-125-161-818 and Z-125-161-819 respectively, Copies of said notices are attached hereto,
made a part hereof, and marked Exhibits "F" and "0",
14. Defendant, Harold J. Eutzy received delivery of the afor~said notice on April 13.
1996 and Defendant Monica M. Eutzy received deliv~ry of the aforesaid notice on April 12,
1996, as evidenced by the signed certified mail receipt aUached hereto, made a part hereof, and
marked Exhibit "H".
16, As set forth above, Mellon has made repeated demands upon Harold J, Eutzyand
Monica M, Eutzy herein, to cure the default under the aforesaid mortgage and promissory note.
