The defendant is enjoined from harassing and stalking the plaintiff and
from harassing her relatives, and the parties' minor children.
The defendant is enjoined from entering the plaint iff' 's place of
employment.
The defendant is enjoined from removing, damaging, destroying or selling
any property owned jointly by the pllrlies or owned solely by the plaintiff.

Pa.C.S. 86113; ii) a private cri.inal ~>IIplaint under 23 Pa.C.S. 86113.1; iii)
a charge of indirect criminal conte.pt under 23 Pa.C.S. 86114, punishable by
i.prisoJIIIP.nt up to Mix months and Ii fine of $100.00-$1,000.00; IlIId iv) civil
conte.pt under 23 Pa.C.S. 86114.1.
This Order shall remsin in effect until modified or terminated by the Court
IInd can be extended beyond its original expiration date if the Court finds that
the defendant hai'l commi t ted an act of IIbuse or has engaged in II pattern or
practice that indicates risk of harm to the plAintiff.
The defendant is ordered to rei inquish to the sheriff's depsrtment any
weapons which he owns, possesses, or has used or threatened to use against the
plaint! ff. alld the defendant is prohi bi ted from acqui ring or possessing any
weapons for the duration of this Order.

b) In or about late April. 1<)96, the defendant told the plaint Iff
in a threatening Mnner that her IIIIlle friend had better "watch over
his left shoulder at all times." The plaint I ff feared that the
defendant would harm her friend If she did not stop seeing him.
c) On or about April 7, 19'16, the defendant threlltened the
plaintiff saying, "You know whllt I promised you on our anniversary;
I'll make It happen." The plaintiff feared for her life.
d) In or alxlut mid-August, 1'l'l5, during their anniversary dinner
the defendant threatened the plaint Iff saying, "If I can't have you,
no one will." The defendllnt feared for her safety.
e) In or about early AUsust, 1995, the defendant took his loaded
handgun out of his dresser drawer, waived it In the all' and
threatened, "This Is the answel"," and left the house wi th the gun.
The plaintiff thought the defendant was going to kill himself and
she also feared for her own safety.
5. On or about Jllnuary 21, 1996. the plaintiff and the part les' two minor
children left their residence at 929 Spring Circle, Mechanlcsburg. Cumberland
County, Pennsylvllnia, in order to avoid further abuse.
6. The 1>lalnt i ff bel ieves and therefore avers that she is in illllllediate
and present danger of abuse from the defendant and that she is In need of
protection from such abuse.
7. The plaintiff desires thot the defendont be prohibited froll having
any direct or indirect contact with the plllintiff Including. but not limited to,
telephone and written communi(:ations, except for the limited purpose of
faci I itat ing custody arrllngements.

her place of employment.

upon consideration of the within Counter-Petition for Protection
From Abuse,and upon findJ.ng that Defendant KEITH JEFFREY BOYER is
in immediate and present danger of abuse from Plaintiff KIMBERLY
KAY BOYER, the following Temporary Protective Order is enter.ed:
Plaintiff KIMBERLY KAY BOYER is enjoined from physically or
verbally abusJ.ng or threatening to abuse Defendant KEITH JEFFREY
BOYER.
Plaintiff is further excluded from the residence of Defend-
ant located at 929 Spring Circle, Mechanicsburg, Pennsylvania, or
any other residence established by Defendant as well as excluded
from the premises of Defendant's employer.
This Temporary Protective Order shall remain in effect until
a hearing on the matter is held. A hearing on this matter is
therefore scheduled for the 3rd day of ~, 1996 at iLQQ R. m.

COUNTER-PETITION FOR PROTECTION FROM ABUSE
AND NOW, comes Defendant KEITH JEFFREY BOYER through his
attorney James K. Jones, Esquire, and brings this Counter-Peti-
tion for Protection From Abuse, a statement of which follows:
1. Plaintiff has attempted tQ cause or has intentionally,
knowingly or recklessly caused bodily injury or serious bodily
injury, or placed by physical menace Defendant in fear of immi-
nent serious bOdily injury as evidenced by the following:
a. On February 14/ 1996, Plaintiff entered Defendant's
residence and thereafter punched him with her fist on the side of
his face causing swelling to the left side of his face while in
the presence of th~ parties' children;
b. On January 21, 1996, Plaintiff struck Defendant in the
back in the kidney area, thereby knocking him to the floor, and
thereafter struck him in the face causing Defendant's face to
swell and threw a table lamp against the wall;
c. Plaintiff has on various occasions slapped Defendant
causing him to suffer substantial pain.
2. Due to Plaintiff's past abuse, as well as his fear of
Plaintiff, Defendant desires to have Plainti f f excluded from his
residence and place of employment.
3. Defendant has expended various sums of money to retain
legal assistance and therefore requests that reasonable attor-
ney's f.ees be assessed against Plaintiff.
WHEREFORE, pursuant to the provisions of the Protection From
Abuse Act, Act of December 19,1990, Act. No. 1990-206 (23 Pa.
C.S. ~6101,et seq.), as qmended, Defendant requests this Court
to:
a. Direct Plaintiff to refrain from abusing Defendant;
b. Grant possession of the marital r~sidence to Defendant to
the exclusion of Plaintiff;
c. Prohibit Plaintiff from having any contact with Defend-
ant, including, but not limited to, restraining Plaintiff from
entering the place of employment of Defendant and from harassing
Defendant's relatives;
d. Order Plaintiff to pay to Defendant a reasonable at tor-
ney's fee; and
e. Such other relief as may be deemed just and proper.
