Under and by virtue of the Municipal Claims and Tax Liens Act
of 1923, as amended, 53 P.S. Section 7101, at seq., Lower Allen
Township Authority (herein "Authority") files its claim for the
tapping fee and related costs levied in the construction, by the
Authority, of its Lisburn Area sanitary sewer system, in the total
amount hereinafter indicated, against the real estate described
herein, with the improvements thereon, if any, and sets forth the
following:
STATEMENT OF CLAIM
1. The name of the municipality by which this claim is filed
is LOWER ALLEN TOWNSHIP AUTHORITY, 120 Limekiln Road, New
Cumberland, Pennsylvania 17070, a body corporate and politic,
organized and existing under the laws of the Commonwealth of
Pennsylvania and created by the Township of Lower Allen, under the
Municipality Authorities Act of May 2, 1945, P.L. 382, as amended,
located in the Township of Lower Allen, County of Cumberland,
Pennsylvania.
2. The name or names of the owner or owners, registered,
apparent, or reputed owner or owners of the property against which
this claim is filed is/are:
James 0. Young and Paula J. Young, his wife.
3. A description of the property against which this claim is
filed is as followst
All that certain tract of land situate in Lower Allen
Township, Cumberland county, Pennsylvania, known as
1548 McCormick Drive and more particularly bounded and
described in Cumberland County Deed Book H-33-642, at
seq.
4. The Authority under and by virtue of which the tapping
fee was levied and the work done is as follows:
The Municipal Authorities Act enacted May 2, 1945,
P.L. 382, as amended; Lower Allen Township Authority
i Resolution No. 95-A-15, adopted August 3, 1995, and
} Resolution No. 95-A-17, adopted October 5, 1995.
5. The Authority constructed a sewer extension consisting,
inter AO, of collection and transportation facilities including
pump station and related and necessary facilities in the Lisburn
Sewer Service Area and completed the same on or about February 1,
1996.
6. Notice of the Tapping Fee Bill for the same, together
with notice of intention to file this lien, if the bill was not
paid, was duly given on March 26, 1996, by the said Authority to
said Owner or reputed Owners who have failed to pay the same.
7. The amount of the levy and tapping fee for which this
claim is filed is as follows:
Tapping Fee $6,000.00
Inspection Fee 18.20
Lien Preparation Fee 125.00
Lien Filing Fee 9.00
Lien Satisfaction Fee 5.00
Total $6,157.20
Plus 63 Interest From
March 26, 1996,
To Date of Full Payment
