NOW COMES the Plaintiff, DAUPHIN DEPOSIT BANK AND TRUST COMPANY, a
PeMSylvania Corporation, by its Attorney, ALBERT Z. BOGERT, ESQUIRE, and
files the within Complaint in Mortgage Frorec10sure as follows I
1. The Plaintiff, DAUPHIN DEPOSIT BANK AND TRUST COMPANY, is a
Pennsylvania Corporation with ita principal office at 213 Market Street,
Harrisburg, PennSYlvania 17105.
2. The Defendant, DENNIS O. MESSNER, is an adult individual, whose
last known address is 259 Susquehanna Avenue, Eno1a, Pennsylvania 17025.
3. The Defendant WENDY D. MESSNER, is an adult individual whose
last known address is 259 Susquehanna AvenuR, Eno1a, Pennsylvania 17025.
4. At all relevant times, the Defendants have been the real owners
of a tract or parcel of land with buildings and other improvements
thereon located at 259 Susquehanna Avenue, Eno1a, Cumberland County,
Pennsylvania 17025 (the "Premises"), being more specifically described
heI'einafter in Exhibit "A" attached hereto and made a part hereof.
5. On or about August 19, 1994, in consideration of a loan of
Fifty-six Thousand Nine Hundred Dollars ($56,900.00), made by Plaintiff
to Defendants, which funds were received by Defendants, the Defendants, as
Makars, executed and delivered to the Plaintiff, as Payee, a Mortgage
Note dated August 19, 1994, (the "Note"), in the principal amount Of

Fifty-six Thousand Nine Hundred Dollars ($56,900.00), and requiring the
payment of interest on the Principal at the rate of Seven and six hundred
twentY-five thousandths percent (7.625%) pllr year (the "Interest"). A
true and correct copy of the Note is attached hereto as Exhibit "B" and
made part hereof.
6. The Note Obligates Defendants to pay to Plaintiff the Principal
and Interest in equal, consecutive installment payments of Four Hundred
Two Dollars and Seventy-four Cents ($402.74) each (the "Installment
Payments) on the 1st day of each month beginning October I, 1994, until
the Principal and Interest are paid in full.
7. The payment to Plaintiff by Defendants of the Installment
Payments due under the Note is secured by a mortgage on the Premises
dated August 19, 1994, (the "Mortgage"), executed, conveyed and delivered
by Defendants, as Mortgagors, to Plaintiff, as Mortgagee, which Mortgage
was recorded on August 24, 1994, in the Cumberland County Recorder of
Deeds Office in Book 1229 at Page 893. A true and correct copy of the
Mortgage is attached hereto as Exhibit "e" and incorporated herein.
8. The Mortgage Obligates the Defendants to pay to Plaintiff on
the first day of each month, a sum sufficient to pay any ground rents,
real estate taxes, assessments, sewer and water rents, fire and other
hazard insurance premiums and mortgage insurance premiums due on the
Premises (the "Escrow Payments").
9. The failure of the Defendants, inter alia, to pay, when due and
payable, the Installment Payments or the Escrow Payments constitutes a
"default" as defined in the terms of the Mortgage.
10. The Defendants have failed or refused to pay the Installment
Payments due and payable on the first day of November 1, 1995 through May
1996. constituting a breach under the terms of the Mortgage.

11. 'nI8 terms of the Mortgage provide that upon the occurence of a
default by the Defendants, the Plaintiff may accelerate and demand
irrmediate payment of all sums secured by the Mortgage.

13. The Plaintiff has duly complied with tho provision of the
Emergency Mortgage Assistance Act of 1983 ("Act 91") in that the
preacribed notice of eligibility was sent to the Defendants by first
class mail on October 19, 1995. The temporary stay of enforcement of the
Mortgage by reason of Act 91 has expired in that the Defendant has failed
to file an application for assistance within thirty (30) days of the
face-to-face meeting with the Plaintiff or the designated Consumer Credit
Counseling Agency. A copy of said notiClil to the Defendlimt, DENNIS O.
MESSNER, is attached hereto as Exhibit "0" and made part hereof. A copy
of said notice to the Defendant, WENDY O. MESSNER, is attached hereto as
Exhibit "E" and made part hereof.

14. Written Notice of Intention to Foreclose, dated October 19,
1995, WilS sent to the Defendants pursuant to Section 403 (a) of the Act
of Jenuary 30, 1974, P.L. 13, No.6, as amended, 41 P.S. Section 403(a).
The appropriate time periocl has elapsed since the Notice of Intention to
Foreclose WilS served upon the Defendant. The Defendants have failed or
refused to cure the said defaUlts. True and correct copies of the
Notices and return receipt cards to the Defendants, are attached hereto
as Exhibit "F" and "G" and made a part hereof.
15. The Mortgage has not been assigned.
WHEREFORE, plaintiff demands jud~nt in the sum of Sixty-four
Thousand Seven HIUldred Thirty Dollars and Sixty-five Cents ($64,730.65),
together with interest accruing at the rate under the Note of Eleven
Dollars and Seventy-seven Cents ($11.77), per day, from May 22, 1996, and
