Your petitioner is an adult individual who resides at 709 Coolidge Street, New Cumberland, Cumberland County, PA 17070, 2, Your petitioner is licensed as a motor vehicle operator by the Commonwealth of Pennsylvania, Department of Transportation, Bureau of Driver Licensing, 3. By official notice dated May 1, 1996, your petitioner received notification from the Commonwealth of Pennsylvania, Department of Transportation, Bureau of Driver Licensing, that his driving privileges were to be suspended for a period of one year based upon an alleged chemical test refusal which allegedly occurred on April 9, 1996. (Attached as Exhibit "A" and incorporated herein by , r,. I'I! , , , with an attorney prior to performing any tests. 10. During this period, Harrisburg' Police Department read to your Petitioner an 0/ Connell warning. .", 11. Despite being provided this warning, your Petitioner remained confused about the applicability of his right to counsel. 12.
