THIS AGREEMENT mado the 29th ot May, 1996, by and between
B.L. BRADLEY & SON,
hereinatter reterred to as Contractor,
AND
ERIC D. BRADLEY , DARCY A. SCHAEFER,
hereinatter reterred to as Owner,
whereby the tormer undertook and agreed to erect and construct a
aingle tamily residence on that certain lot ot ground known aa:
Lot '5 on the tinal plan ot subdiviaion prepared tor RESE, Inc., by
John K. BiXler, lXI, R.S., dated October 15, 1994 and recorded in
Cumberland County Plan Book 69, Page 25, situate in South Middleton
Townshlp and Dickinson Township, Cumberland County, PA,
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the Raid
Contractor, tor and in consideration ot the sum ot One and 00/100
Dollar ($1.00) to Contractor in hand paid by Owner, the receipt
whereot is hereby acknowledged, and the turther consideration
mentioned in the agreement atoresaid, tor themselves and their
aubcontractora, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall be tiled or
maintained by them or any ot them against the said buildings and the
lot ot ground appurtenant thereto tor or on account ot any work done
or materiala furniahed by them or any ot them under aaid contract or
otherwia., tor, towarda, in, or about the erection and conatruotion ot
the said buildings on the lot above described, and the said
Contractor, tor themselves, their subcontractors and others under them
hereby expresaly waive and relinquish the right to have, tile, and
maintain any mechanic's liens or claims against the said buildings or
any ot them, and agree that this instrument, waiving the right ot
lien, ahall b. an independent covenant.
