COMPLAINT
AND NOW, July 10, 1996, comes the Plaintiffs by the.ir
attorneys, GBISBNBERGER , COOPF.R, P.C., and file this Complaint
against the Defendant, Timothy Beining, as follows I
1. Plaintiffs are Ronald L. Foust and Alice Ann Foust,
individuals, husband and wHe, sui juris, who reside at 196
Silver Springs Road, Mechanicsburq, Pennsylvania, 17055,
2. Defendant, Timothy Beining, is an individual, sui
juris, who resides at 119 Hershey Road, Shippensburg,
Pennsylvania, 17257.
3. At all times mentioned, Defendant, Timothy Beining,
was, and now is, engaged in the business of rebuilding and
restoring roofs.
4. In June of 1994, Defendant entered an oral contract to
replace Plaintiffs' roof at their residence at 196 Silver Springs
Road, Mechanicsburg, Pennsylvania.
5. As Plaintiffs prepared to depart for the weekend and
upon hearing rain forecasted, Plaintiffs contacted Defendant and
requested he not start the roof replacement if the weather looked
questionable.

6. Upon Plaintiffs' return they found Defendant had
disregarded their request and was proceeding to remove shingles
and plywood from the roof in spite of an impending storm,
7. On or about June l7, 1994, Defendant, while engaged in
performing the reroofing contract, negligently, carelessly, and
without regard to established customer and practice, removed the
roof from the dwelling and thereby left the interior of the
dwelling virtually unprotected from the elements.
8. Plaintiffs allege when the storm began, Defendant was
unsuccessful in his attempt to cover the opening in the roof, and
water damage was sustained to the interior of the dwelling and
personal property, including drywall, carpeting, lamp shades and
blinds. Copies of replacement and repair invoices are attached
hereto marked for identification as Exhibit "A" and fully
incorporated herein by reference,
9. In action as aforesaid, Defendant caused damage to the
Plaintiffs' property in the amount of $3,806.90.
WHEREFORE, Plaintiff prays for recovery of Judgment against
Defendant, Timothy Beining, in the amount cf $3,806,90, together
with interest thereon from June l7, 1994.
