STIPULATION AGAINST ~IINS
THIS AGRIIHINT made this "Y" day of 1\,1/\ t1 , 1996, by
and between NUSSIR HONl BUI~DIlRS, INC.. a Pennsylvania Corporation,
hereinafter referred to as Contz'actor,
AND
Philip J. progar and Kathy J. Progar, husband and wif.,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in Monroe Township, cumberland County,
Commonwealth of Pennsylvania, known as Lot #14 Heiser Road,
Mechanicsburg, Pennsylvania and more fully described in Bxh bit "A"
which is attached hereto and made a part hereof.
NOW THIRIPORI, THIS AGRIBMINT WITNESSITHI That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractoro, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of anr work done or materials furnished by them or any of
them under sa d contract or othexwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claimD against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL that certain tract of land situate in Monroe Township,
CUmberland County, Pennsylvania, being more fully bounded and
limited as follows to witl
BEGINNING at a surveyors pin on the eastern side of Heisey Road
also known as Township Road T-5601 thence in and aJ,ong the f.lastern
side of said roadway North zero (00) degrees twenty-three (23)
minutes five (05) seconds West one hundred feet (100) to a
surveyors pinl thence along lot ~13 North eighty-nine (89) degrees
thirty-six (36) minutes fifty-five (55) seconds East two hundred
(200) feet to a surveyors pin along other lands of the grantors
hereinl thence along the last mentioned lands South zero (00)
degrel!ls twenty-three (23) minutes five (05) seconds East one
hundred twenty five (125) feet to a fifty (50) foot wide right-of-
way at other lands of the grantors herefnl thence along the last
mentioned lands South eighty-nine (89) degrees thirty-six (36)
minutes fifty-five (55) seconds West one hundred seventy-five (175)
feet to a sUrveyora pinl thence along a curve to the right having

Lee Decker and Associates. Said plot plan is recorded in the
CUmberland County Court House in plot plan book 51 page 140.
BEING the same premiss which Oonald E. Oeckman and Marian R.
Deckman, husband and wife, by deed dated March 18, 1996 and
recorded in the Office of the Recorder of Deeds in and for
CUmberland County in Deed Book 136, Page 277, granted and conveyed
to Philip J. progar and Kathy J. Progar, hUllband and wife,
Borrowerll herein.
