(;;.J -, : ~ VJ ~j en U and continually allude and accuse defendant and her 11 year old daughter of causing damage to their property. D~fendant disputes this charge and contends that it was the intention of Chiara Kalbach from the day she signed the lease with Defendant to extort and to evict and thought she would, after 14 days of residence in the property, evict Defendant and keep the $1,750.00. . ($1,050 security deposit and $700 first months rent.) Defendant avers that Plaintiffs actions were/are criminal. The Plaintiffs were in possession of $1 ,050 of Defendant's. Defendant had just, reasonable and honorable cause to believe the Plaintiff would keep the $1,050. and fabricate damages to continue to extort the Defendant. Defendant contends that a hearing needs to be held in the Court for all facts in this case to be heard by the Court. WHEREFORE, Defendant move this Court to do the following: A. Retain the $2,100.00 in escrow until a ruling is made by this Court. a. Direct fact finding of the Plaintiffs actions and intentions against the Defendant. Chiara Kalbach rapped on my door, May 13th, at 10:15 o'clock P.M. and announced to me that I had a cat, I admitted same and infonned her it was my intention to give the cat away. She told me she wanted me out of the house inunediately, I responded with: "are you sure that is what you want"? She said "yes", I closed the door then. My daughter, in bed for the night, was awakened by the doorbell ringing and heard the conversation and became hysterical crying and saying "it's not fair we have to move again, we just moved...etc. etc. She was up until 1:00 A.M. crying and being upset by Mrs. Kalbach's invasion of our privacy at 10 P.M. with such an alanning, disrupting message on a school night. The following day, May 14, Robert and Chiara Kalbach entered the residence at approximately 2 P.M. Marcel was home alone. I was at work. They interrogated Marcel about activities and her life in an accusatory fashion and intimated her by these accusations and reprimands. They accused her of things she did not do, they reprimanded her repeatedly about these things that she did not do but they said she did do and demanded that she not do them anymore. They terrified her by making her find the cat, photographing the cat and other things in the house. She said they searched the house even inside all of the closets. They addressed themselves to her about things which only adults should converse, i.e. eviction and landlord/tenant matters. They left a type written note on the sideboard giving me notice to vacate the pmperty and repeatedly told her it was there and to make sure that I saw it. We had just moved and were not unpacked yet. My daughter was in the 5th grade and, of course, can read the note was extremely upsetting to her. They sat in their car watching the house for some time after they exited the property. My female child, then 10 years of age, has never recovered her nonnal sense of safety and security since this event. The Kalbach's had no reasonable cause to "inspect" the propeny. Mrs. Kalbach knew I had the cat and had no cause to come into the propeny, without notice the next day. They commandeered my home, my child and my right to privacy and security by taking over my home and my parental rights in my absence. The verbally abused and mistreated my daughter, unknown to me in my home. This had go to be a violation of something. Chiam Kalbach, by her own admission, was spying on me and had neighbors spy on me. She has stalked us and spied on us and genemlly has us scared of her. She is menacing and threatening. I had no right to privacy, safety, security and was ndtallowed to get settled and reside in the property without interference and hamssment. The previous landlord told the Kalbachs I had a cat. We only had had the cat for about three months. I got the cat to keep Marcel company for the I ~ hours before I arrived home from work. It did not work because the cat was unfriendly and not suitable as a companion, so I was trying to find a home for it. The women where I work took it when I said I was going to give it to the Humane Society. Due to the fact that the Kalbach's went forward with renting me the property knowing I had the cat, it appears that they planned what they did to me. Apparently she watched the house day in and day out until she, Chiam, saw the cat. She then proceeded to evict me and seems to have thought that I would simply pack up and move and she would keep the $1,750.00 ($1,050 security deposit and $700 first month's rent). There was criminal intent. They have repeatedly brought a video camem into the property and video taped not only the concrete structure, but all of my possessions as well. In May of 1996, the Defendant breached and violated the lease between the parties in the following ways: A. The Defendant kept a pet in the home; B. The Defendant had persons other than herself and her daughter residing in the home. 6. When Plaintiffs learned of Defendant's breach of the lease, they timely notified Defendant that they termir.ated the lease and directed Defendant to vacate the premises. 7 . To date, Defendant has failed and refused to vacate the premises and restore possession thereof to Plaintiffs. 8. Plaintiffs have expended their own funds and resources to remove Defendant from the premises and to enforce their rights as property owners, including costs paid to the office of District Magistrate Robert Manlove in the amount of $68.62. 9. Defendant disputes this charge and contends that it was the intention of Chiara Kalbach from the day she signed the lease with De(endant to extort and to evict and thought she would, after 14 days of residence in the property, evict Defendant and keep the $1,750.00. ($1,050 security deposit and $700 first months rent.) Defendant avers that Plaintiffs actions were/are criminal. The Plaintiffs were in possession of $1,050 of Defendant's. Defendant had just, reasonable and honorable cause to believe the Plaintiff would keep the $1,050. and fabricate damages to continue to extort the Defendant. Defendant contends that a hearing needs to be held in the Court for all facts in this case to be heard by the Court. WHEREFORE, Defendant move this Court to do the following: A. Retain the $2,100.00 in escrow until a ruling is made by this Court. B. Direct fact fmding of the Plaintiffs actions and intentions against the Defendant. Chiara Kalbach rapped on my door, May 13th, at 10:15 o'clock P.M. and announced to me that I had a cat, I admined same and infonned her it was my intention to give the cat away. She told me she wanted me out of the house immediately, I responded with: "are you sure that is what you want"? She said "yes", I closed the door then. My daughter, in bed for the night, was awakened by the doorbell ringing and heard the conversation and became hysterical crying and saying "it's not fair we have to move again, we just moved...etc. etc. She was up until 1:00 A.M. crying and being upset by Mrs. Kalbach's invasion of our privacy at 10 P.M. with such an alanning, disrupting message on a school night. The following day, May 14, Robert and Chiara Kalbach entered the residence at approximately 2 P.M. Marcel was home alone. I was at work. They interrogated Marcel about activities and her life in an accusatory fashion and intimated her by these accusations and reprimands. They accused her of things she, did not do, they reprimanded her repeatedly about these things that she did not do but they said she did do and demanded that she not do them anymore. They terrified her by making her find the cat, photographing the cat and other things in the house. She said they searched the house even inside all of the closets. They addressed themselves to her about things which only adults should converse, i.e. eviction and landlord/tenant matters. They left a type written note on the sideboard giving me notice to vacate the property and repeatedly told her it was there and to make sure that I saw it. We had just moved and were not unpacked yet. My daughter was in the Slh grade and, of course, can read the note was extremely upsetting to her. They sat in their car watching the house for some time after they exited the property. My female child, then 10 years of age, has never recovered her nonnal sense of safety and security since this event. The Kalbach's had no reasonable cause to "inspect" the property. Mrs. Kalbach knew I had the cat and had no cause to come into the property, without notice the next day. They commandeered my home, my child and my right to privacy and security by taking over my h0me and my parental rights in my absence. ....
