4. On July 19, 1996, the Petitioner filed preliminary
Objections to the Respondent's appeal.
5. The Petitioner did not include an Answer or
Counterclaim to the Respondent's claims at that time, nor was he
required to do so under the Pennsylvania Rules of Civil

On August 1, 1996, the Respondent filed a Praecipe to

On August 5, 1996, your Petitioner received from the

Respondent a Notice of Intent to Pursue a Default Judgment within
ten days, as if her Praecipe for Withdrawal had never been filed.
WHEREFORE, the Petitioner, Matthew J. Eshelman, respectfully
requests that this Honorable Court issue a Rule upon Respondent/
Defendant to show cause as to why the Praecipe for Discontinuan~e
should not be stricken off pursuant to Pennsylvania of Civil
Procedure 229(c); and
WHEREFORE, the Petitioner, Matthew J. Eshelman, respectfully
requests that this Honorable Court issue a Rule upon the
Respondent/Defendant to show cause as to why she should not be
required to respond to the Preliminary Objections filed in the
above-captioned matter; and
WHEREFORE, in the alternative, the Petitioner, Matthew J.
Eshelman, respectfully requests to be permitted to plead a

6. Paragraphs one (1) through eight (6) are included
herein by reference as if set forth in their entirety.
9. Plaintiff/Petitioner erroneously caused a Rule to be
issued upon Defendant/Respondent to file a Complaint.
10. Defendant/Respondent, without the assistance of
counsel, responded to the Rule by filing a Pro Se Complaint.

11. Upon consulting with counsel after receipt of
Plaintiff/Petitioner's preliminary objections, Defendant/Respondent
was informed that she was not the Plaintiff and had no duty to file
a Complaint. Accordingly, counsel, on August 1, 1996, entered an
appearance and a Praecipe to withdraw the Complaint.
12. The Prothonotary refused to honor the Praecipe to
withdraw as it failed to comply with Pennsylvania Rule of Civil
Procedure 237.1. (Counsel for Defendant/Respondent failed to attach
the appropriate notice to Plaintiff/Petitioner.)
13. On August 5, 1996, Counsel for Defendant/Respondent
filed a Praecipe with the appropriate notice.
14. Pa.R.C.P.D.J. No. 1004 requires a complaint to be
filed within twenty (20) days following the filing of an appeal.
15. The twentieth day following the filing of
Plaintiff/Petitioner's appeal was June 25, 1996.
16. Plaintiff/Petitioner has never filed and/or served
a Complaint upon Defendant/Respondent in regards to this action.
