STIPULATION AGAINST LIENS
THIS AGREEHENT made thi8 J'" day of ./0''''1-
by and between Perkin8 Con8truction, a Penn8ylvania
Corporation, hereinafter referred to as Contractor,
, 1996,
AND
ClREOOM. COOK & SUZANNE C, COOK, husband and wife, hereinafter
referred to as Owners, whereby the contractor undertook and
agreed to erected and construct a dwelling on the certain lot
of ground 8ituate in Hampden Town8hip, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in
Exhibit "A" which i8 attached hereto and made part hereofand
known a8 Lot 219, Pha8e III, hampden Hearth, Mechanic8burg,
Penn8y1vania.
NOW THEREFORE, THIS AGREEMENT WTNESSETH: That the
8aid contractor, for an in con8ideration of the 3um of
($1.00) Dollar to Contractor in hand paid by Owner, the
receipt whereof i8 hereby acknowledged, and the further
con8ideration mentioned in the agreement afore3aid, for
itself, himself or themselves and its, his or their
3ubcontractor8, and all partie3 acting through or under them,
convenant and agree that no mechanic'3 liens or claim3 shall
be filed or maintained by them or any of them again3t the
said buildings and the lot of ground appurtenant thereto for
or on account of any work done or materia13 furni8hed by them
or any of them under 3aid contract or otherwise, for,
toward3, in, or about the erection and con3truction of the
said building3 on the lot above described, and the 8aid
Contractor, for itself, him8elf or the3elve8, its, his or
their subcontractor8 and others under them, hereby expres8ly
waive and rellnqui8h the right to have, file, and maintain
any mechanic's llen8 or claims against the 8aid buildings or
any of them, and .agree that thi8 in8trument, waiving the
right of lien, 8hall be an independent covenant.

DESCRIPTION and RECITAL
ALL THAT CERTAIN parcel of land situate in Hampden Township, Cumberland
countr' Commonwealth of Pennsylvania, more particularly bounded and
descr bed to wit:
BEGINNING at a 3/4 inch diameter rebar on the North right of way line of
Wallingford Way, said point being the Southwestern corner of Lot #218 and
being located from the centerline intersection of Wallingford Way and
Lawncrest Drive the following courses: South 74 degrees 50 minutes 43
seconds West, along the centerline of Wallingford Way, a distance of
58.77 feet to a point of curvature on the same, thence along said
centerline on a curve to the right having a radius of 130,11 feet and an
arc length of 53.23 feet to a point on the same, thence radially toward
the center of the curve, North 08 degrees 17 minutes 07 seconds East a
distance of 25.00 feet to the aforementioned point of beginning; thence
along the Northeastern right of way line of Wallingford Way on a curve to
the right having a radius of 105,11 feet, an arc length of 247,20 feet, a
delta angle of 134 degrees 45 minutes 15 seconds, a chord bearing North
14 degrees 20 minutes 13 seconds West and distance of 194.04 feet to a
3/4 inch diameter rebar on the same and being the Northwest corner of Lot
#220; thence South 36 degrees 57 minutes 34 seconds East, along the
Westenr line of Lot #220, a distance of 105.11 feet to a concrete
monument, being the common corner of Lot #218, #219 and #220; thence
South 08 degrees 17 minutes 07 seconds West along the Western line of Lot
#218, a distance of 105.11 feet toa 3/4 inch diameter rebar on the North
right of way line of Wallingford Way, the Point of BEGINNING. CONTAINING
12,991,23 square feet or 0,298 acres of land, more or less.
BEING Lot #219 on the Plan of Lots of Hampden Hearth Final Plan Phase
III, recorded in Plan Book 62, page 139, Cumberland County Courthouse.
BEING part of the same premises which The First Bank and Trust companr of
Mechanicsburg, Executor by Deed dated November 20, 1986 and recorded n
Cumberland County, in Deed Book I 32 page 83 conveyed unto H S Service
Corporation, a Penna. corporation, Trustee for Hampden Hearth Joint
Venture, a joint venture of H S Service Corporation, a Penna, corporation
and Equico Realty Group, a Penna, general partnership.
