COMPLAINT
AND NOW come the Plaintiffs, James A. Snyder and Donna M. Snyder,
through their attorney, Richard L. Webbp.r, Jr" and file this
complaint, averring the following:
1, Plaintiffs are JAMES A. SNYDER and DONNA M. SNYDER, adult
individuals residing at 20 Alters Road, Carlisle, Pennsylvania
17013.
2. Defendant is BRENT A. EMLET, an adult individual residing
at R.R. #1, Box 151, Landisburg, Pennsylvania 17040-5741.
3, Plaintiffs own real estate, together with a 2 unit
residential building situate thereon, located at 18 North High
Street, Newville, Cumberland County, Pennsylvania.
4. On or about April 12, 1995, Plaintiffs and Defendant
entered into a written Articles of Agreement. Attached hereto,
incorporated by reference herein, and labeled as Exhibit "A" is a
true and correct copy of the said Articles of Agreement
(hereinafter referred to aR "Lease").
5, The length of the Lease term was from May 1, 1995 to May
1, 1996.
6, The Lease provided that Defendant was to lease a
residential unit located at the second floor of the property
(hereinafter referred to as the "premises") for $280,00 per month,
payable on the first day of each month.
7. Defendant vacated the premises on or about March 6, 1996
and surrendered the keys at that time.
8, Defendant failed to pay rent to Plaintiffs for February
1996 and March 1996.
9, The Lease further provides as follows:
"The said premises are to be kept and maintained in as
good repair and condition as at pre, ,1nt and at the
expiration of this lease, they are to be surrendered in
like repair and condition, natural wear and damages
happening by fire, storm or other casualties only
excepted,
The premises are to be kept in a clean and sanitary
condition and all ashes or other garbage which may
accumulate thereon during the term are to be removed, and
in case of failure to remove the same the party of the
first part may collect as rent due and in arrears double
the cost of removal; the water, lighting or other service
for the use of the occupants of the said premises
furnished by any Public Service Company during the said
term shall be paid for by the said party of the second
part unless otherwise provided herein, or the same may be
collected by the said party of the first part as rent due
and in arrears."
10. After Defendant vacated the premises, Plaintiffs incurred
or will incur expenditures for damages and cleaning to the premises
as follows:
Repair of south living room wall
Cleaning
Removal of abandoned furniture
Disposal of abandoned furniture

11, The Lease further provides that Defendent is responsible
for advertising expenses if he vacates the premises prior to the
expiration of the above-described lease term.
12. Plaintiffs expended $39.13 for advertising expenses.
13, Plaintiffs incurred a fee of $7.50 resulting from a check
issued by Defendant that was returned for insufficient funds,
14, Plaintiffs are in possession of the security deposit paid
by the Defendant in the amount of $280,00.
15, On April 12, 1996, Plaintiff incurred filing fees at
District Justice Helen Shulenberger's office totaling $50.30,
16. Defendant therefore owes Plaintiffs the sum of $1,026.45,
calculated as follows:

17. Defendant has refused to pay Plaintiffs the amount owing,
or any other amount, in spite of requests by Plaintiffs to do so.
18. Plaintiffs have fully performed their obligations under the
terms of the Lease.
WHEREFORE, Plaintiffs respectfully request judgment in their
favor for $1,026.45, plus costs and other appropriate relief.
