STIPULATION AGAINST LIENS

THIS AGREEMENT made the 1Yt' day of \11l,tu:_- . 1996,
by and between FLOYD R, DARHOWER, hereinafter referred to aa Contractor, and HANS
PFISTER and LAUREL COHEN.PFISTER, husband and wife, hereinafter referred to as Owner,
whereby the former undertakea and agrees to erect and construct a single family dwelling on:
ALL THAT CERTAIN tract of land situate In South Middleton Township,
Cumberland County, Pennsylvan'la, bounded and described according to the Land Subdivision
for Warner/Hollinger prepared by CarlO, Bert, P,L.S., dated June 18, 1992, and recorded In the
Plan Book 66, Page 109, as follows, to wit:
BEGINNING et a point in T-613, Heisel'S Lene, at the Northwestern corner of Lot
No.6 on the above-referred to Plan; thence along Lots Nos, 2, 3, 4, and 6 on the above-referred
to Plan and passing through 4 iron pin sets, South 00 degrees 12 minutes 20 seconds East
679.37 feet to a concrete monument; thence along Lot No.1 on the above-referred to Plan,
South 64 degrees 46 minutes 30 seconds West 117.18 feet to an Iron pin; thence along Lot
No.7 on the above-referred to Plan, North 36 degrees 13 minutes 30 seconds West 626,74
feet to a railroad spike; thence In said T-613, Helsers Lane, North 66 degrees 04 minutes 00
seconds East 146.26 feet to a railroad spike; thence along same, North 64 degrees 46 minutes
30 seconds East 216.96 feet to a rallroed spike, the Point and Place of BEGINNING.
BEING Lot No.6 on the Lane Subdivision for Warner/Hollinger and containing 2.686
acres, excluaive of dedicated right-of-way.
BEING a part of the premises which Joyce S. Simpson, Executrix of tha Estate of
Mildred A. Kell, by her Deed dated June 29, 1992, and racorded in the Office of the Recorder
of Deeds In and for Cumberland County, in Deed Book "T", Volume 36, Page 164, granted and
conveyed unto Larry L. Warner and Kenneth S, Hollinger,
ALSO BEING the same premises which Larry L. Warner and Jonietta E, Warner,
husband and wifa, and Kenneth S. Hollinger and Anne L. Hollinger, husband and wife, by their
Installment Sales Agreement dated Septembar 16, 1993, and recorded Novembar 1, 1993, in
the Office aforesaid, in Miscellaneous Book 467, Page 1137, granted and conveyed unto Hans
Pfister and laurel Cohen-Pfister, Grantors herein,
NOW THEREFORE, THIS AGREEMENT WITNESSETH: Thet the said Contractor, for and
In consideration of the sum of One ($1.00) Dollar to him In hand paid by Owner, the receipt
whereof Is hereby acknowledged, and the further consideration mentioned In the agreament
aforesaid, for themselves and their subcontractors, and all parties sctlng through or under them,
covenant and agree that no mechanic's liens or claims thereto for or on account of any work
done or materials furnished by them or any of them under said contract or otherwise, for,

towards, in, or about the erection and construction of the said buildings on the lot abova
described, and the said Contractor, for themselves, their subcontractors and others under them
hereby expressly waive and rellnquiah the fight to have, file and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument, waiving the
right of lien, shall be an independent covenant.
